Article 36: Questions from SAMEN

SAMEN has submitted written questions regarding the housing construction subsidy. We have answered these questions, and they can be shared Municipal Clerk’s Office the council through the Municipal Clerk’s Office once the executive board has approved them.

The council has decided to approve the response to SAMEN’s Article 36 inquiry 2026.36.012 regarding housing subsidies.

Decision on the complaint 

On March 16, 2026, the board received a complaint. The complainant alleges that there has been improper administration due to what the complainant claims is a refusal to engage in dialogue.

The council has decided to approve the decision not to consider the complaint, in accordance with the attached draft decision.

Delegation Decision on Geldrop-Mierlo 2026

It has been agreed with the council that a new Delegation Resolution will be adopted after each council term so that each new municipal council can decide for itself which powers are to be delegated to the executive board. In the context of administrative law, delegation is “the transfer by an administrative body of its power to make decisions to another party, who exercises this power under its own responsibility.” Unlike a mandate, delegation breaks the legal pattern of authority. This is because delegation shifts political responsibility, as the authority is exercised by the executive board under its own responsibility. For this reason, delegation to civil servants is also prohibited. The transfer of authority enhances an administration’s effectiveness through a faster and more efficient working method.

The Executive Board has decided to approve the council proposal titled “Geldrop-Mierlo Delegation Decision 2026,” which includes the following decision points:
1. To adopt the Geldrop-Mierlo Delegation Decision 2026;
2. To repeal the Geldrop-Mierlo Delegation Decision 2021 and the Delegation Decision on the Environmental Plan and Preparatory Decision 2023.

Policy Paper on Extending the DVO Scheme for the Reception of Displaced Persons from Ukraine Until 2026

Senzer is responsible for distributing living allowances to displaced Ukrainians in our labor market region. The Temporary Protection Directive (TPD), under which Ukrainians may reside in EU member states, has been extended until March 4, 2027. In light of this, the addendum to extend the service agreement with Senzer is being submitted to your council for a decision.

The council has decided to approve the extension of the service agreement (DVO) titled “Regulation on the Reception of Displaced Persons from Ukraine” with Senzer until March 4, 2027, as set forth in the attached addendum.

Board Proposal: Additional Responsibilities Agreement for Youth Services Procurement

When the “Een 10 voor de jeugd” Youth Region was established, the objective was to continue existing cooperation and (procurement) tasks. Because the work at that time was based on a draft bill and an Administrative Order that had not yet been finalized, a discrepancy arose between this objective and the scope of the current joint arrangement following the final adoption of the law and regulations. To ensure the continuity of regional cooperation on the procurement of youth care and to prevent legal issues in the current contracts, it is necessary to assign additional tasks to the public body. The additional tasks are referred to as “plus tasks” in the attached regional proposal and the agreement. These are tasks for which there is currently no formal mandate included in the joint arrangement, but which were already being carried out regionally and jointly prior to the establishment of the youth region. The plus tasks supplement the basic tasks. Although these activities are in fact structural tasks, a structural assignment requires a formal amendment to the Joint Arrangement. Since this is a lengthy process, this proposal suggests first mandating these tasks as “plus tasks.” The procedure for amending the Joint Arrangement will be carried out at a later date, so that these tasks can ultimately be formally incorporated into the mandate of the public body.

The Executive Committee resolves:
1. To approve the signing of the attached Amendment to the Mandate Decision for the “A 10 for Youth 2026” Youth Region;
2. To inform the City Council via the attached Council Information Letter.

Memorandum on the Grant Application for the Second Tranche of the Beethoven Project in Appelaar

Beethoven Wonen is a regional partnership program between the national government, the Eindhoven Metropolitan Region (MRE), ASML, and the province of North Brabant. The goal of this partnership program is to jointly accelerate the construction of housing in the Brainport region, in addition to the objectives outlined in the existing Southeast Brabant Regional Housing Deal. Beethoven Wonen consists of subsidy schemes designed to stimulate affordable housing construction. A subsidy application for the Appelaar site was previously submitted under Beethoven Wonen. This application was not approved. Given the social importance of the redevelopment and the financial shortfall in the real estate operations of the housing association Woonbedrijf, we propose to reapply for a subsidy for the Appelaar site in a subsequent tranche.

The Municipal Executive decides:
1. To approve the attached “Grant Application for the Appelaar site regarding the Grant Scheme for Accelerating Housing Construction in the Eindhoven Metropolitan Region: Real Estate Development (VEX),” including appendices;
2. To request the City Council, following the grant of the subsidy, to withdraw the co-financing—which is already available and is claimed against the Land Development Reserve—from the Land Development Reserve and to administer it separately;
3. To approve the submission of this (renewed) subsidy application for Appelaar in the next tranche;
4. To approve the attached council information letter.
