Environment, permit or notification
What is it?
If your company's activities have an impact on the environment, you must apply for an environmental permit or file an Activities Decree notification with the municipality.
Permit or notification
You can use the Activities Decree Internet Module(AIM) to check whether you need a permit or a notification.
How does it work?
Your business has to deal with environmental regulations such as:
- sound
- energy
- waste
- air
- soil use
The Activities Decree determines which notification you must make or which permit you must apply for. There are three types of businesses.
Type A: no notification and no permit
Your company's activities have little or no impact on the environment. You do not need to report or apply for a permit.
Type B: notification
Your company's activities have many consequences for the environment. You must file a notification of the Activities Decree with the municipality. You must do this for starting, modifying or expanding your business.
Type C: permit
Your company's activities have a large-scale impact on the environment. You need a permit.
What to do.
Check through the AIM to see if you need to apply for a permit or make a notification.
Permit application
- Consult with the municipality about your plans before applying for the permit.
- Apply for a permit through Omgevingsloket online.
- You will receive an acknowledgement of receipt of your application.
- For a complex application, the municipality first makes a draft decision on your application.
- If you do not agree with this draft decision, you can give your opinion (view) to the municipality within 6 weeks. Please indicate why you do not agree with the draft decision.
- You will receive notification from the municipality whether you will receive the permit.
Report
- Make the notification at least 4 weeks before you start your activities.
- The municipality will send you an acknowledgement of receipt of your notification.
- If your report is not complete, the municipality may ask you for additional information.
How long does it take?
Permit application (regular application)
- Within 8 weeks, you will be notified whether you will receive the permit. The municipality can extend this period by 6 weeks.
- If the municipality does not decide within the deadline, you will automatically receive the permit.
- If you disagree with the municipality's decision, you can object within 6 weeks.
Permit application (complex application)
- Within 26 weeks, you will be notified whether you will receive the permit. The municipality can extend this period by 6 weeks.
- If you disagree with the municipality's decision, you can file an appeal with the court within 6 weeks. This is only possible if you have also submitted an opinion on the draft decision.
Notification
You can begin your activities 4 weeks after your notification.
