Construction of driveway or entryway

What is it?

If you want to make an entrance to your business or home, you need an environmental permit. For example, if you want to make an entrance from the road to your garage. You also need an environmental permit if the driveway crosses water, such as a ditch.

Requirements

It is prohibited without an environmental permit:

  • create an entrance from the road;
  • change the road (by lowering the sidewalk, for example);
  • Changing an existing driveway.

What to do.

  • You notify the municipality that you want to build or change an entrance or exit driveway. Do this at least 4 weeks before you want to start building.
  • Through Omgevingsloket you can find out if you need to apply for an environmental permit. You can submit the application online immediately. Use your DigiD. You can also download and print the form.

Companies can only make the application online. Please use eRecognition.

What does it cost?

An environmental permit is required for the construction of a driveway/excursion; there are fees associated with this:

  • dues
  • construction costs

Construction costs for a driveway/exit are determined by:

  • the location
  • the width
  • the distance between the connecting roadway and the plot boundary
  • the current road implementation
  • the possible presence of a gully, a light pole, a ditch and/or a tree

Once the environmental permit is granted, the actual construction costs will be determined. You will receive a construction cost invoice for this purpose.

If you still waive having the driveway made, 40% of the fee will be refunded to you if the driveway has not yet been made.

How long does it take?

Environmental permit application (regular application)

Within 8 weeks you will receive notification of whether you will receive the environmental permit. The municipality can extend this period by 6 weeks. If the municipality does not decide within the period, you will automatically receive the permit (by operation of law).

If you disagree with the municipality's decision, you can object within 6 weeks.

Environmental permit application (extended application)

A decision period of 26 weeks applies to extended applications. This period can also be extended once by 6 weeks. In this procedure, you do not receive the permit by operation of law.

The municipality makes a draft decision on your application. Everyone can give their opinion (views) on it within 6 weeks. If you do not agree with the draft decision, state why in your opinion. You will automatically be informed whether you will receive the permit.

If you disagree with the municipality's decision, you can file an appeal with the court within 6 weeks. This is only possible if you have also submitted an opinion on the draft decision.

Objection and appeal

You can object to the decision on your application. Do this within 6 weeks. Do you then disagree with the decision on the objection? Then file an appeal with the court.
