Personal data
The Municipality of Geldrop-Mierlo processes personal data for the performance of its statutory and public law tasks. Personal data are data that provide characteristic information about a person, such as name, address, email address or telephone number. A passport photo and camera images can also contain personal data. The municipality holds your personal data because you use our services and/or because you provide these data to us. The processing of this personal data is subject to the General Data Protection Regulation (AVG).
Personal data processed by municipal police officers as part of the investigation of criminal offenses do not fall under the AVG, but under the Police Data Act (Wpg). Personal data that fall under the Wpg are called police data.
The protection of your personal data
Everyone has the right to the protection of his or her personal data. The municipality abides by the rules set forth in the General Data Protection Regulation (AVG). This means that the municipality:
- treats your personal data with care and keeps it confidential;
- collects and processes your personal data only if certain Requirements specified in the law are met;
- uses your personal data only for the purpose for which you provided it;
- Does not share your personal data with third parties without your consent, unless the law permits it;
- takes steps to ensure that your personal data is accurate and current;
- strives to process as little personal data as possible. Only those personal data are to be processed that are necessary to perform its task;
- Does not retain your personal data longer than necessary;
- Does not use your personal data for commercial purposes.
The Personal Data Authority checks whether the municipality complies with this. The Personal Data Authority is an independent organization established by the government.
Duty of confidentiality
Only employees of the municipality authorized to do so have access to personal data. They have a duty of confidentiality.
Security measures
The municipality takes measures to prevent misuse, loss, and other undesirable actions with personal data. These measures comply with applicable municipal security standards.
Your rights
As a municipality, we record and use various personal data about you. You have three important rights under the AVG that allow you to influence this:
- right to information
- right of inspection
- right to change, delete, object and restriction
You can exercise these rights for your own personal data or the personal data of your child up to 16 years of age. There is no charge for exercising these rights unless a request is excessive or unfounded.
Right to information
You have the right to be informed about how we process your personal data. For example, there is general information on the website about the requirements for processing personal data and how we safeguard your privacy. In addition, you are entitled to specific information about the processing of your personal data. If possible, we will provide you with this information when we capture your personal data.
Right of inspection
At your request, you can find out whether we process personal data about you. If so, we will give you an overview of your personal data with information about what we do with it and why. If you wish, you can obtain a copy of your personal data. If the document is too voluminous, we may choose to allow you to inspect it at City Hall.
Right to change, delete, object and restriction
Change personal data:
At your request, we can change your personal data if it is not or no longer correct, or complete it if it is incomplete.
Removal and deletion of personal data:
We may delete your data at your request under certain circumstances. For example, if the personal data is no longer needed and the retention period has not yet expired. Following on from this is the right to be forgotten (erased). If it is possible, we can ensure that your personal data, which we have posted or had posted on the Internet, are deleted. Your personal data processed in other organizations' systems are also covered by this right.
You have the following rights under the Wpg:
- The right to clear information about what we do with your personal data
- Inspection: you can request what data we process about you
- Correction and addition: you can ask us to change your data
- Destruction: you can ask us to destroy your data.
Object to processing:
You can object to the processing of your personal data in certain cases and ask us to stop processing immediately.
Limitation of processing:
You can request to restrict the processing of your personal data, that is, temporarily stop its use. This may be necessary if you need time to verify the personal data, or because there is a dispute about the lawfulness of the processing.
Exercising your privacy rights

You may also submit a written request to the College of Mayor and Aldermen of the Municipality of Geldrop-Mierlo, Postbus 10.101, 5660 GA Geldrop. Attach a copy of proof of identity to your written request (make a secure copy with the copyID app).
Treatment
There is also a difference between the AVG and the Wpg in the handling of your request.
Within one month of receiving the request under the AVG, we will assess whether your request is justified. If your request is very complex, it may take longer to implement. But even then, you will receive a notice within one month informing you that more time is needed to assess your request. You will receive a decision. If your request is denied, you can appeal. If you cannot resolve the matter with the municipality, you can file a complaint with the Personal Data Authority.
If you submit a request for inspection under the Wpg, you will receive a response from us within 6 weeks of receipt. In cases specified by law, we may delay our substantive response for up to 4 to 6 weeks.
If you submit a request for rectification or destruction you will receive a response from us within 4 weeks.

Permission
In most cases, personal data are processed for the performance of a statutory or public law task. In some cases, your consent is required for the processing of your personal data. It will then be explained to you in clear and understandable language what the consent request is about. The data will be used only for the purpose for which it was originally intended. If it does prove necessary to use the data for other purposes, the municipality will inform you of this. You are free to give or refuse the consent. If you refuse, you will still be helped. If you do give permission, you may withdraw it at any time.
Processing Register
The municipality maintains a processing register. The processing register contains information about the personal data the municipality processes.
This register includes the following information, among others:
- Who is responsible for the personal data (e.g., the board of mayor and aldermen);
- A description of the categories of personal data the municipality processes (e.g., name, address, phone number or BSN);
- the purposes for which the municipality processes the personal data (for example, to issue a passport, grant a license or provide a benefit);
- A description of the categories of persons the municipality processes (e.g., applicant for a license or benefit recipient);
- the retention period of personal data;
- The categories of recipients to whom your data were provided (e.g., the UWV).
When the municipality outsources work
In principle, your personal data is not shared with third parties, but it may happen that the municipality outsources work to an external party. That external party may then process your personal data on behalf of the municipality. In that case, the municipality remains responsible for your personal data and makes written agreements with that external party about the security and confidentiality of your data.
Basic registration of persons
In addition to the AVG, there is the Basic Registration of Persons Act. The basic registration of persons is the population register, in which the municipality records the personal data of its residents. You also have the right to view, correct, supplement or change your personal data recorded in the basic registration. You can view your personal data by logging in with your DigiD to the municipality of Geldrop-Mierlo. You can do this through our website. This is the only way to request access to your personal data digitally. To correct, supplement or change your personal data, you must come in person to the municipality. The Municipality of Geldrop-Mierlo uses cookies to improve and analyze its website. For example, we measure how often visitors come to our website, the duration and which pages are visited. Therefore, we do not answer questions via WhatsApp and chat that require privacy-sensitive information. In this case, we will ask you to continue contacting the municipality by other means. Data Protection Officer
The municipality is required to employ a Data Protection Officer. The Data Protection Officer monitors compliance with privacy laws by the municipality. He or she works with the Authority for Personal Data for this purpose. Camera surveillance public hall city hall and municipal sports halls
Cameras have been installed in the public hall of City Hall and at the 3 sports halls. The purpose is to protect the safety and health of employees, visitors and users.
Only moving images are recorded without sound. When images are taken, these images can be used as evidence in incidents. In such a case, charges can be filed.
Secure emailing through ZIVVER
Gemeente Geldrop-Mierlo uses ZIVVER to securely exchange messages and files via email. ZIVVER encrypts messages with sensitive content, such as personal data, financial data or medical data. It is also possible to send large files. More information can be found on the webpage Safe mail via ZIVVER.
