Environmental Plan
Under the Omgevingswet , every municipality will have a single environment plan. This will replace all zoning plans. The environmental plan contains all rules in the field of spatial planning. And all rules that ensure a healthy and safe living environment.
The municipality will automatically have an environmental plan when the Omgevingswet Act takes effect. This is called an environmental plan by operation of law. This includes all current zoning plans. The municipality will gradually convert this temporary environmental plan into a full environmental plan that will be ready by 2032 at the latest. The municipality of Geldrop-Mierlo has drawn up a plan of approach for this transition. In the environment plan you will find which function an area has and which rules apply. For example, what the maximum building height is and how much noise is allowed. The rules from the environment plan can be viewed via the omgevingsloket. You can then search for a Map and see per location what rules and policies apply to that location.
Deviation from the environmental plan
Do you want to deviate from the environmental plan? Then apply for an environmental permit. To build or remodel yourself, you often also need other environmental permits and, in certain cases, you must file a building notification.
There are several procedures when granting an environmental permit, namely:
- A permit for an environmental plan activity, as defined in the environmental plan;
- A permit for an out-of-plan environment plan activity, where the initiative does not fit within the possibilities and rules of the environment plan.
Amend environmental plan
You can also request an amendment to the environmental plan.
If the change you are proposing fits within the policies or rules of the environmental plan, the municipality will more readily cooperate.

Transitional law
A zoning plan that is submitted for public inspection before January 1, 2024, is still handled under old law. Right now, we advise initiators to prepare new initiatives such as an out-of-plan environmental plan activity or environmental plan amendment, taking into account the new standards and requirements under the Omgevingswet.
The municipality will still use the technical standard TAM-IMRO for the first part of 2024 and gradually switch to STOP-TPOD. However, plans must meet the legal and content requirements under the Omgevingswet.
