Memorandum on the Decision Regarding the Appeal Against the Removal of 6 Oak Trees Along the Bus Lane on Mierloseweg

Six oak trees must be removed to make way for the construction of the Mierloseweg bus lane. An objection has been filed against the tree-cutting permit. The Appeals Committee recommends upholding the contested decision, with additional justification. This additional justification pertains to the obligation to provide compensation (replanting).

The Board decides:
1. To declare the appeal admissible;
2. To uphold the contested decision, with additional reasoning;
3. To include the compensation obligation as a condition in the permit.

Advisory Memorandum on Street Naming for the Veilingterrein Housing Development (3667981)

A new street is being built as part of the Veilingterrein housing project. This street needs to be given a street name. This is necessary in order to assign addresses to the homes that will be built here.

The council has decided to approve the street name “De Kersenboom.”

Advisory Memorandum on the Decision on the Objection Regarding Barrier 3 Environmental Permits That Were Set Aside

Three applications for environmental permits at the “De Barrier” business park have been set aside. These applications concern a restaurant, an energy hub, and a car wash. The applicant has filed an objection to the three decisions to set the applications aside. The Appeals Committee has determined that the deadline for setting the applications aside had expired. For this reason, the appeal is well-founded. A decision must now be made on the three applications. In addition, the appellant has issued a notice of default to the municipality because a decision on his appeal was not made in a timely manner. As a result, the municipality is liable to pay a statutory penalty.

The Board decides:
1. To declare the appeals admissible and to revoke the three contested decisions, in accordance with the recommendation of the Appeals Committee; 2. To reject the three applications upon reconsideration and to initiate a comprehensive procedure for this purpose;
3. To grant the portfolio holder the authority to draft the final text of the three draft decisions that will be made available for public comment; 
4. To award the objector reimbursement of legal costs for two legal issues, in the amount of €1,294, in accordance with the recommendation of the Appeals Committee;
5. In connection with the failure to decide on the objection in a timely manner, to set a penalty payment in the amount of €1,442.

City Council Proposal on the Guiding Principles for the 2027 Program Budget and the 2028–2030 Multi-Year Forecast

Before you is a proposal to establish the guiding principles for drafting the 2027 program budget and the 2028–2030 multi-year budget estimate (hereinafter: the 2027–2030 multi-year budget). These guiding principles form the framework within which the municipal executive prepares the budget based on existing policy.

The college decides to agree to the attached council proposal.

Policy Memorandum: Inventory, Appraisal, and Deaccessioning of Municipal Art, Design, Kitsch, and Heritage

The municipality houses various works of art, antique furniture, designer furniture, and historical objects, which are scattered across the Dienst Dommelvallei Mierlo facilities and a rented off-site storage space. A solution is needed for these artifacts to prevent them from remaining in storage indefinitely and to ensure they are put to appropriate use. There is a lack of policy, as well as a lack of insight and legal and financial knowledge, to make decisions regarding these objects.

The council resolves:
1. To approve the hiring of experts for inventory and appraisal;
2. To approve the hiring of experts to deaccession and dispose of artifacts by transferring them to foundations, museums, heirs, or through sale;
3. To approve the development of a policy for the future management of such objects and to entrust its implementation to the Facilities Management team.

Advisory Memorandum on the 2025 Financial Statements of Geldrop-Mierlo

We hereby present to you the final version of the 2025 Financial Statements for Geldrop-Mierlo, including the draft auditor’s report and the municipal executive’s response to it (draft). Compared to the auditor’s version, the result for general services has been adjusted downward by approximately €104,000.

The Executive Committee resolves:
1. To submit the 2025 annual financial statements, along with the accompanying council proposal, to the municipal council;
2. To approve the response to the draft auditor’s report.
