Memorandum on the decision regarding the objection to the dismissal of the application for an environmental permit for Heuvel 13-14

Objection to a decision to dismiss an application for an environmental permit to convert the retail property at Heuvel 13-14 into two residential units. The Appeals Committee recommends that the objection be declared inadmissible.

The Board decides:
1. To declare the objection inadmissible.
2. To uphold the contested decision.

Memorandum on the Sale of Enexis Land (2026)

Enexis Netbeheer BV (hereinafter referred to as “Enexis”) intends to install transformer stations at four locations within our municipality. The land is still owned by us, and Enexis wishes to acquire ownership of this land through a transfer of title. To this end, four draft purchase agreements have been drawn up.

The council has decided to approve the four purchase agreements in accordance with the attached drafts.

Policy Memorandum: LEV Group Ukraine Refugee Assistance Grant 2026

LEVgroep supports refugees from Ukraine who are being housed in reception centers within the municipality of Geldrop-Mierlo. A small group is staying with host families. Given the ongoing war, the situation is not expected to change in the short term. Ukrainian refugees are therefore expected to remain in the Netherlands through 2026. To continue providing the necessary support, LEVgroep has again applied for a grant for 2026 to assist Ukrainian displaced persons in the municipality of Geldrop-Mierlo.

The Municipal Executive decides:
1. To approve the granting of a one-time subsidy to LEVgroep for the reception and support of Ukrainian refugees, in accordance with LEVgroep’s proposal “Subsidy Application: Ukraine Initiative 2026”.
2. To cover the costs thereof, namely an amount of €255,529.76, from the government reimbursement for the reception of displaced Ukrainians (project 40095/610/99/38103).

Policy Memorandum on the LEV Group Integration Grant

LEVgroep receives an annual grant for its work in the area of integration. This advisory memorandum presents a proposal to your council for the award of a grant for the year 2026. LEVgroep provides social guidance and facilitates social participation within the Self-Reliance Pathway in accordance with the provisions of the 2021 Integration Act.

The council has decided to approve the granting of an annual subsidy of €256,172 to LEVgroep for integration programs in 2026.

Information Note on Volunteer Awards for March 20, the Day Against Discrimination & Racism

March 21, 2026, is the International Day for the Elimination of Discrimination and Racism. This is an important day because, in Geldrop-Mierlo, we want everyone to be able to participate, regardless of age, background, religion, preferences, or disabilities. The Discrimination Hotline and the Inclusive Weaving Table have taken the initiative to use this day to highlight volunteers who are committed to an inclusive society. The goal is to make this an annual event: a moment when a day dedicated to addressing discrimination and racism is instead used to share a positive story about how volunteers make society more inclusive and stronger. Through this, we aim to highlight inclusion in a positive light while emphasizing the importance of volunteer work. In addition, the human rights flag will be raised at City Hall around this day.

Policy Paper on Cooperation Between the Municipality and School Boards in the Establishment of Integrated Child Centers

An Integrated Child Center (IKC) is a multifunctional facility that houses educational institutions, childcare providers, Health social services organizations that work together. This requires collaboration among the various users. This collaboration can be structured in various legal ways. For educational buildings, the most common ownership structures are the municipality as the owner of the entire property, a school board as the owner of the entire property, or joint ownership through the division of condominium rights. For all IKCs yet to be built in our municipality, the form of ownership still needs to be determined. Following that, it can then be determined which party should be designated as the project owner.

The council resolves:
1. To establish that the municipality will be the owner and lessor of the IKC to be built, and to apply this principle in all current and future discussions regarding the construction.
2. To establish that the municipality will act as the project owner for the construction of the IKC, and to apply this principle in all current and future discussions regarding the construction.

Answers to Article 36: Questions About Couples Therapy During Divorce

On February 19, 2026, the GroenLinks parliamentary group submitted questions regarding awareness of the program “Saving on Youth Care through Relationship Therapy in Divorce Situations.” The attached appendix contains the response to these questions.

Memorandum on the Urgent Request for an Exemption from the Right of First Refusal for Luchen West


On November 4, 2025, the municipal executive decided to establish a right of first refusal on the land in Luchen West. This right of first refusal was confirmed (extended) by the city council on February 2, 2026. The right of first refusal now applies, in principle, for a period of 3 years, after which it will be extended several times—provided that an environmental vision, program, and/or environmental plan is adopted in a timely manner—up to a total period of 16 years. The effect of the right of first refusal is that the land in question may not be transferred without first being offered to the municipality. The Omgevingswet an exception under which the municipal executive may decide to grant an exemption from this obligation to offer the land to the municipality. On December 30, 2025, one of the owners submitted a written request for an exemption from the obligation to offer one of the parcels subject to the right of first refusal. This concerns a cadastral parcel, half of which is owned by the woman in her private capacity and the other half by her husband’s private limited company. The woman requests cooperation to transfer the land into a private limited company to be established by her. The request states as justification that, due to legal and tax considerations, this will make the agricultural business of the applicant and her partner more future-proof. Since the present request is not listed as a ground for exemption in the Omgevingswet, it is up to the council to decide whether or not to grant the request. To this end, an assessment must be made as to whether there are compelling reasons to grant Omgevingswet from the obligation to submit a proposal, pursuant to Article 9.10 of the Omgevingswet , for the contribution of the parcel to the BV. Because the present request is very specific, an official inquiry was made to our in-house counsel. Our in-house counsel’s advice indicated, among other things, that it was advisable to request further justification from the petitioner. After all, the submitted request was not substantiated in concrete terms. Consequently, an official meeting took place with the petitioner on February 5 to obtain more concrete information regarding the request. During the meeting with the petitioner, no specific further justification was provided. It was agreed that a written further justification would be provided. A meeting report was prepared and sent to the petitioner on February 5. This meeting report specifically requested a further justification, as agreed between the petitioner and the officials. On March 2, a detailed justification regarding the previously submitted request was received. This justification states that an exemption is necessary to make the applicant’s and his spouse’s agricultural business more future-proof. Specifically, it is explained that transferring the parcel to the B.V. is more tax-efficient and creates a separation between the applicant’s business assets and private assets, meaning they are no longer jointly and severally liable as a partner in the VOF but rather the B.V. The applicant has expressly requested that a decision on their request be made by March 20. The incorporation of the B.V., along with all related matters, must be formalized by the notary before April 1. This is why a decision must be in place before March 20.

The Municipal Executive resolves:
1. Not to grant the applicant an exemption from the obligation to offer the right of first refusal.
2. To approve the transmission of the attached draft decision to the applicant.

Additional guidelines for refugee reception under the Distribution Act

Under the Distribution Act, the municipality has been assigned a quota of 137 refugees to accommodate. On February 24, 2025, the City Council adopted the refugee reception guidelines. To ensure continued compliance with the statutory quota and to guarantee continuity, additional guidelines are being submitted to the City Council for adoption.

The Municipal Executive resolves:
1. To take note of the supplementary principles and frameworks for the reception of refugees in general and unaccompanied minor asylum seekers (AMVs) in particular.
2. To approve the council proposal “Additional Frameworks for Refugee Reception under the Distribution Act” and to submit this council proposal, including the additional principles and frameworks, to the municipal council for decision-making, containing the following decision points:
a. To establish the additional principles and frameworks for the reception of unaccompanied minor foreign nationals (UMFs);
b. To instruct the municipal executive:
· To use a temporary reception site—located where emergency reception took place earlier in 2024 and which is suitable for this purpose—until a permanent facility is realized;
· To prepare a permanent reception facility for 54 unaccompanied minor asylum seekers within these frameworks;
· To investigate whether a second location is necessary and desirable in the context of the overall target;
3. To approve the agenda request regarding the Supplementary Frameworks for Refugee Reception under the Distribution Act.
