Advisory Memorandum on the 2025 Annual Report on Legal Quality Assurance

A legal quality assurance system cannot exist without a periodic review of the municipal organization or parts thereof for legal quality and legal risks. The preparation of an Annual Legal Quality Assurance Report is an instrument for this.

The Executive Board has decided to take note of the 2025 Annual Report on Legal Quality Assurance and the agreements with CMT as set forth in Chapter 8 of the Annual Report.

Response to the Advisory Memorandum on Questions Regarding Article 36: “Samen Woonzekerheid” Informal Care

Samen has posed seven questions regarding housing security for family caregivers living with their loved ones.

The council has decided to approve the response to the Article 36 questions submitted by Samen regarding housing security for informal caregivers living with the person they care for.

Policy Paper on Article 36: Questions from SAMEN Regarding the Non-Use of Programs

SAMEN has submitted questions under Article 36 regarding the lack of use of minimum income programs and the preparations for the Proactive Service Act bill.

The council has decided to approve the attached response to the written questions submitted by SAMEN.

Memorandum on the Appointment of a New Member and the Reappointment of Members (3) of the Social Chamber and the Complaints Committee

There is an advisory committee responsible for providing advice on appeals. Since 2022, the Appeals Committee has consisted of a Social Chamber and a General Chamber. There is also an advisory committee responsible for providing advice on complaints. The composition of the Complaints Committee is the same as that of the Social Chamber. 

The chairs and members of both chambers and the Complaints Committee are appointed for a term of four years and may be reappointed once for the same term. The chair and members of the General Chamber were recently (re)appointed. The chair of the Social Chamber, who also serves on the Complaints Committee, has indicated that he or she will not seek reappointment. The other members of the Social Chamber and the Complaints Committee have indicated that they would like to be reappointed. One new member has been sought.

The Board resolves:
1. As of July 21, 2026, to reappoint three members of the current Social Chamber of the Appeals Commission and the Complaints Commission for a term of four years, and to reappoint one of them as chairperson rather than as a member, all in accordance with the appointment resolution attached as an appendix to this proposal;
2. As of July 21, 2026, to appoint a (new) member of the Social Chamber of the Appeals Commission and the Complaints Commission for a term of four years, in accordance with the appointment resolution attached as an appendix to this proposal;
3. To approve informing the council by means of the attached council information letter.

Policy Memorandum on the Use of BOPA During the Transition Phase of the Environmental Plan

Since 2024 Omgevingswet the Omgevingswet has been in effect Omgevingswet new tools to facilitate development. One such option is the issuance of an environmental permit for an activity not covered by the environmental plan (hereinafter: BOPA). The municipality has until January 1, 2032, to convert the temporary environmental plan into a final environmental plan. This advisory memorandum requests that, during this transition phase, the BOPA instrument be used to permit a different use in addition to the construction activity, in order to prevent delays in development projects.

The council has decided to approve the use of an environmental permit for a BOPA as a tool for initiatives that require a change in land use in conjunction with construction activities during the transition phase from the temporary to the final environmental plan.

Memorandum on Converting a Cash Advance into a Long-Term Loan

In July, the total of €27 million in short-term cash loans will be partially converted into a 5-year linear loan of €20 million (and the remainder into shorter-term cash loans). We intend to finance future investments primarily with short-term cash loans and, taking the cash limit into account, convert these into one or more long-term loans in a timely manner. The council resolves:
1. to enter into a 5-year linear long-term loan of €20 million, maturing on July 21, 2026
2. to authorize the Finance Alderman to sign the aforementioned loan agreement pursuant to Article 171(2) of the Municipalities Act.

SAMEN has submitted questions under Article 36 regarding the temporary housing of unaccompanied minor asylum seekers at the Spaarpot.

The council has decided to approve the attached response to the written questions submitted by SAMEN.

Advisory Memorandum: Decision on the Application for an Environmental Permit for Mierloseweg 54

On December 19, 2025, an application for an environmental permit was submitted for the activity “Deviation from the rules in the environmental plan,” for the development of 24 apartments behind Mierloseweg 54 in Geldrop. During the assessment of the environmental permit application, several issues arose that stand in the way of granting the permit. Nevertheless, in accordance with the “yes, provided that” principle, officials examined the possibilities for the requested development while ensuring that the quality of the physical living environment remains safeguarded. However, this did not lead to the desired result. Given the course of the process and the complexity of the proposed development, the municipal executive is asked to make a decision on the application for an environmental permit.

The council resolves:
1. To refuse, with justification, the requested environmental permit to deviate from the rules in the environmental plan, for the development of 24 apartments on the lots behind Mierloseweg 54, known in the land registry as Municipality of Geldrop, Section F, numbers 3276, 3274, 3272, and 2025, is hereby rejected with justification.
2. To apply the uniform public preparatory procedure, as referred to in Section 3.4 of the General Administrative Law Act, to the processing of this application for an environmental permit, and to make the draft decision available for public inspection for a period of six weeks.
