The budget proved insufficient, and we closed the desk at that point. This prompted an update of the process agreements. The council decides: | |
4 | Advisory memorandum on termination of lawsuit regarding preemptive rights for Molenstraat 4 On November 25, 2025, your council decided to purchase the property at Molenstraat 4 for the redevelopment of the 'post office location'. The former owner, CHEOPS, had previously filed a lawsuit against the municipality in which they contested the right of first refusal. With the purchase of this location, this dispute has already been settled, as both parties now declare. With the signing of this 'declaration of waiver and termination', this case is also formally closed in court. The council decides to agree to the termination of the dispute with case number C/01/414339 at the District Court of East Brabant concerning the previously established right of first refusal at Molenstraat 4 in Geldrop and to sign the attached declaration of renunciation and termination that regulates this. | |

6 | Advisory memorandum on written questions from SAMEN regarding participation and decision-making on public play and sports areas in the Skandia school environment On January 26, 2026, an additional design session was held for local residents on the layout of the public play and sports area in the Skandia school environment. Following this design session, SAMEN received feedback from residents living near the lawn on Ziggenstraat/Beemdstraat in the Skandia neighborhood that they felt they had not been sufficiently heard in this process. SAMEN has submitted a number of written questions about this. In this advisory note, the council is asked to approve the answers to the questions, after which they can be forwarded to the Municipal Clerk’s Office. The council decides: | |
7 | Advisory memorandum Status of refugee reception framework and legal obligations Feb 2026 With this advisory note, we ask the council to approve the sending of a council information letter on the current situation regarding the Refugee Reception Framework. The letter informs the municipal council about, among other things, current developments and the approach to the task of housing status holders, the task set out in the Distribution Act, the state of affairs regarding other target groups (such as Ukrainian displaced persons/end of the Temporary Protection Regulation (RTB)), a uniform legal basis for financial compensation and uniformity in funding, and the consequences of the D66, VVD, and CDA coalition agreement for municipal tasks in the field of asylum and migration. 11 | Advisory memorandum on draft amendment to the Geldrop-Mierlo Environmental Plan (Genoenhuis subarea) II Since the Omgevingswet came into force Omgevingswet January 1, 2024, the municipality automatically (by operation of law) has one environmental plan. This environmental plan replaces all existing zoning plans (and management regulations). We must convert this temporary environmental plan into a fully-fledged environmental plan by 2032 at the latest. The conversion from a temporary to a new environmental plan will be done in stages and on an area-by-area basis. The first change relates to the Genoenhuis residential area in Geldrop. In addition, the preparatory decision taken by the council last year on business units in industrial estates will also be incorporated into the present plan. 12 | Advisory memorandum on new lease agreement for De Weijer sports canteen The lease agreement for the sports canteen located at De Weijer sports hall will automatically expire on July 4, 2025. In connection with the MFA foundation's desire to continue the operation of the De Weijer sports canteen on a structural basis, a new lease agreement must be concluded for a period of four years from September 1, 2025, to August 31, 2029. The council decides to approve the new lease agreement with the MFA foundation for the operation of the De Weijer sports canteen, so that the lease agreement with the MFA foundation will run until August 31, 2029. | |
