Advisory note on Municipalities Preferential Rights Act west side market square

In the context of the ongoing planning for the center of Geldrop, it is in the interest of the municipality of Geldrop-Mierlo to take a preferential position with regard to an important location in the core shopping area. It concerns the location on the west side of the Marktplein. This plot is currently in use in accordance with the planning destinations. The location is used as a supermarket, other retail, catering, other center purposes and upstairs apartments. Within the framework of the new plans being prepared, the location occupies a key position, both in terms of the intended spatial interpretation and in terms of the phased development of this part of the core shopping area. For the intended area development, a non-agrarian zoning will be assigned to this parcel that deviates from its current use. This deviating use refers to destinations and functions that fit in with the structural / environmental vision for the center of Geldrop that is currently being prepared.

The College decides:
1. To establish a provisional preferential right pursuant to Article 6 of the Municipalities Preferential Rights Act, to which Articles 10 - 15, 24 and 26 of the Wvg apply, to the plots of land as shown on the attached list and ground plan drawing, which preferential right will in principle apply for a period of three months after publication of this decision in the Municipal Gazette. Another non-agricultural use is envisaged for the plots in question, which deviates from the current use.

2. A municipal preferential right has not previously been established on the plots in question.

3. To propose to the Council of the Municipality of Geldrop-Mierlo to perpetuate the provisional preferential right and to designate the land as subject to a municipal preferential right on the basis of Section 5 in conjunction with Sections 2 and 3 of the Municipal Preferential Rights Act,
indicating that a structural/ environmental vision will be adopted at a later date.

4. To inform the (association of) owners of the plots concerned and those entitled to limited rights to the plots, about the preferential right and its consequences.

5. To declare Article 4:11 sub c of the General Administrative Law Act (Awb) applicable and to omit the hearing of interested parties pursuant to Article 4:8 Awb.

6. The provisional preferential right in principle applies for three months after publication in the Municipal Gazette, therefore until January 5, 2024, unless the council decides within this period to perpetuate this provisional designation.

Advice note request in principle Overakker 14 in Mierlo

Initiator would like to realize one dwelling on the Overakker 14 parcel in Mierlo and asks your college to make a statement of principle about this.

The College decides:

1. To grant, in principle, the request to amend the zoning 'Residential' on the Overakker 14 parcel in Mierlo in such a way that the construction of one additional dwelling is made possible on the site;
2. To attach the following Requirements (a. through i.) to cooperation and to include these Requirements in the attached plan cost letter;
a. The new dwelling shall have a gutter height of no more than 3 meters;
b. The new dwelling shall have a ridge height not exceeding 7.5 meters;
c. The dwelling capacity is a maximum of 650 m3;
d. The gable roof will be required over the entire volume giving the main building a simple rectangular volume with one ridge direction parallel to the road;
e. The entire parcel of the Swinkels family is part of the development;
f. The landscaping of the entire parcel shall be implemented and maintained in accordance with the attached incorporation plan
g. The tree on municipal land in front of the new house shall be preserved.
h. Strengthening the cultural-historical and urban design of the built-up area by preserving the tree on municipal land and positioning the new house.
i. It must be demonstrated that the plans are environmentally possible.

Council proposal tax ordinances 2024

Annually, by December 31, the ordinances and rates for municipal taxes for the following year must be adopted and published.
In the attached draft council proposal, we submit to you the adjustments to the 2024 ordinances and rates.

College decision:
- To approve the tax ordinances;
- To submit the council proposal for tax ordinances 2024 to the council for decision.

Every quarter the council is informed about the progress of the social domain task force.
Attached is the progress report through Q2 2023.

The College decides:
1. To approve the contents of the attached quarterly report Taskforce Social Domain Q2 2023.
2. To forward this to the council by means of a RIB. If the council sees fit, it may decide to put it on the agenda for substantive discussion.

The college decides to approve:
