Advice note decision on objection

A notice of objection has been lodged against the decision of the college in which an environmental permit was granted for the erection of a garden fence at the front of a house at the Waleweinlaan in Geldrop. The Objections Committee has recommended that the objection be declared admissible, that the contested decision remain unchanged and that the request for reimbursement of the costs incurred in the objection be rejected.

The College decides:
1. To declare the objection admissible;
2. To leave the contested decision unchanged;
3. Reject the request for reimbursement of costs incurred in the objection.

Agenda request council presentation advisory right delegation and mandatory participation

In the run-up to the entry into force of the Omgevingswet (January 1, 2024), we are going through the process of arriving at council decision-making on the following three topics:
* Advisory right of council;
* Mandatory participation;
* Delegation.

The College decides:
1. To approve the attached council proposal with three attachments and forward it to the council.
2. To agree to the agenda request.

College recommendation objections site Arwen

On August 25, 2022, the Board of Mayor and Aldermen decided by traffic decree to reserve two parking spaces on Arwen for charging electric vehicles. This location is part of a proactive plan map. Two objections have been filed against this decision.

A hearing of the Objections Committee took place on December 12, 2022, and on January 10, 2023, the college received an opinion from this committee. The opinion pays attention to the opinion of the police. Receipt of this (positive) advice was delayed, causing a delay in the decision on the objection. Now that the college has received the advice of the police it can take a decision on the objections of Mr. Donker, Arwen 11 in Geldrop and Mr. Alders and Mrs. Van de Ven, Arwen13 in Geldrop. In this college decision, the college takes a decision on both objections. The advice of the Objections Committee advises the college to attach the (positive) advice of the police. Receipt of this advice has been delayed.

The College decides:
1. adopt the committee's opinion;
2. declare both objections admissible;
3. uphold the contested decision.

Advisory Note The Right Health In The Right Place (Grozzerdam)

In June 2022, the municipality of Geldrop-Mierlo received a request from the coalition 'Vital in Brainport' to be a co-applicant in the grant application: "The Right Health in the Right Place (JZOJP)", better known internally as GROZzerdam. On behalf of the college, this request was then informally responded positively. The JZOJP grant application was submitted in the fall and has since been approved by ZonMw.

Meanwhile, the 'Vital in Brainport' coalition in the region has started the fieldlabs for which the grant was intended. The various fieldlabs, of which Geldrop-Mierlo is one, are connected to each other through the regional coalition.

This advice addresses how best to deal with the possibilities of the fieldlab in Geldrop-Mierlo in relation to our existing local goals and activities.

The college decides to approve:
1. to take note of the grant application The Right Health in the Right Place (JZOJP).
2. to establish the five starting points for participation in the Fieldlab Geldrop-Mierlo.

Board proposal to relaunch municipal reception of Ukrainian refugees

Shortly after the outbreak of war, Bouwinfra made available a building on the Goorsedijk in Mierlo to accommodate Ukrainian refugees. The building was prepared in a few weeks. The war lasted longer than hoped. Reason to reassess the agreements with the parties involved and make a new start, as it were.

The College decides:
1. To approve the proposal to lease the property from July 1, 2023 to March 1, 2025 at the stated annualized rate.
2. To agree to the attached draft lease agreement.
3. To agree to the quotation from Strong House for the supervision of Ukrainian young adults in the lodging house.
4. To inform the City Council via a Council Information Letter.

Council proposal renovation or replacement new gymnasiums Strabrecht College

There are two possible scenarios, new construction of the gymnasiums at a new location or renovation of existing gymnasiums (thus implementing the existing agreements). In the proposal below we have tried to clarify the pros and cons of building new gymnasiums at a new location and renovating the gymnasiums. As an official organization, after considering these arguments, we have a slight preference for new construction of the gymnasiums at another location. However, we can also imagine that your college or the council may have a different consideration and choose renovation after all.

College decision:
To approve the council proposal to renovate or replace

New gymnasium Strabrecht College to the council proposing:
a. To approve replacement new construction for two gymnasiums Strabrecht College for life extension of at least 40 years;
b. For this an additional investment of € 2,165,564 including VAT

    to be made available.
The resulting structural capital costs amount to €64,967 in the first year after realization, assuming the current interest rate of 0.5%. These costs are not included in the current budget and will be charged to the structural budget result.
