Advisory note supplemental grant request LEV group MB 2023 kids

LEVgroep receives a subsidy for the guidance of asylum status holders who are obliged to integrate. No funds are provided for the guidance of children; the guidance of children is assumed to be done within the hours of guidance of the parents. Due to the changed ratio of the proportion of adults to the proportion of children, LEV group is in a bind. It receives fewer resources, but has more work. A better balance must be brought into this, for now and in the future.

The College decides:
1. To approve the supplemental grant application from LEV Group;
2. Not to disburse the required funds, but to settle them after the end of this grant year with the advance already granted;
3. To agree to change the way in which the required funds for social assistance are determined, distinguishing between adults and children starting in 2024.

Advisory note tolerance decision charging cable over sidewalk

In adopting the Charging Policy on 13-12-2021, the council adopted an amendment providing for a waiver option from the APV for people with disabilities to allow them to (safely) lay the charging cable from the charging station at their home to their car across the sidewalk for charging their electric car.

On May 3, 2023, a person with a disability applied for such a waiver. Review of this application revealed that it is not legally possible to grant a waiver under the APV at this time. In order to make such a waiver possible, a policy rule should be included under which Requirements a waiver can be granted.

The charging policy will be updated in early 2024, at which time this policy rule will also be adopted. The most appropriate way to bridge the intervening period is to issue a permit to the applicant for this waiver.

The college decides to issue a tolerance decision, temporarily allowing (to bridge until the policy rule is adopted) the installation of a charging cable across the sidewalk from a residence on Magalhaesstraat in Geldrop.

College proposal to extend agreement on health and safety services

On January 1, 2022, the Dommelvallei organizations and the PlusTeam entered into cooperation with arbodienst ArboNed for the duration of 2 years, with the option to extend the agreement to 2 times 2 years. An evaluation took place in April 2022 and May 2023. A report of this evaluation is attached for your information.

The agreement ends on January 1, 2024. It is proposed to extend the agreement, with some adjustments to the services. These adjustments are explained in this proposal.

The College decides:
1. To extend the service agreement with health and safety service ArboNed for 2 years (from January 1, 2024 to January 1, 2026).
2. To terminate the structural deployment of the coach sustainable employability, freeing up €16,000 in health and safety resources.
3. To use part of these funds to organize a Social Medical Consultation (SMO).

Information note participation in relation to adjustment of joint arrangement ODZOB

The amended Wgr originally made it possible to include in a joint arrangement that no possibility for participation is offered. In the proposed draft regulation of the GR ODZOB, the possibility for participation is not offered. However, an adopted amendment by Member Bromet (House of Representatives) on citizen participation has resulted in the need to include some form of participation in the amendment to the joint scheme. 

The final draft regulation of the GR ODZOB will include a modified provision on participation that complies with the legal framework of the amended Wgr.

The college decides to take note of the inclusion of a modified provision on participation in the final draft GR ODZOB regulations.

College recommendation decision on objection to traffic decision 2022-10 _ 2022-13

On August 25, 2022, the Board of Mayor and Aldermen decided by traffic decree to reserve two parking spaces on Arwen for charging electric vehicles. This location is part of a proactive plan map. Several objections were filed against this decision.

A further investigation revealed that, for the time being, the location is not suitable to be designated as a proactive charging location for electric vehicles. To meet the objections in a legal sense, the college issued a withdrawal decision on February 23, 2023. This decision no longer designates location Zaailand as a proactive charging location. Due to the lack of a litigation interest, a withdrawal request was sent to the objectors on June 29, 2023. Almost all objectors formally withdrew the objection as a result of this decision. However, one objector, Mr. S. Bolk, Zaailand xx in Geldrop, explicitly indicated by email on June 30, 2023 that he was not withdrawing his objection. 

The Objections Committee issued its opinion on September 19, 2023, recommending that the objection be declared inadmissible.

In this college decision, the college makes a decision on the objection.

The College decides:
1. To accept the committee's opinion;
2. To declare the objection inadmissible;
3. Uphold the contested decision.

Advisory note Rules of Procedure for Objection and Complaint Committee.

On October 24, 2023, your college decided to propose that the council adopt an updated version of the Complaints and Objections Committee Ordinance. It regulates matters concerning the committee. What it does not regulate is the conduct and organization of the hearings. That is the purpose of these Rules of Procedure. Previously we had no such regulations. But practice has shown that there is a need for one.

The college decides to adopt the Rules of Procedure for hearings Objections and Complaints Committee Geldrop-Mierlo 2023.

College proposal Help to Measure

The attached council information letter provides an update on the current status of Help on Measure Q4 2023 (action item Ibabs 6167). The overview document attached to the RIB concerns the media campaign, also gives your college an atmospheric impression in which we would like to include you.

The college resolves to approve the Council Information Letter Help to Measure Q4 2023, and forward it to the council through the Municipal Clerk’s Office .

College proposal Adjustment of PlusTeam Joint Arrangement

The current Common Scheme PlusTeam has been in force since 2022. In the meantime, the amended Joint Arrangements Act has come into force, the Joint Arrangement PlusTeam needs to be updated. To this end, the General Board has released a proposal for an updated version with an effective date on the day after publication.

The college resolves to submit the council proposal Modification of Common Scheme PlusTeam, containing the following decision points, to the council for decision:
1. To take note of the amended Common Scheme PlusTeam;
2. Not to express an opinion on the draft of the regulation;

The college decides to approve:
1. The answer to the asked article 36 questions by GroenLinks about connection to MijnOverheid.
2. To forward the answers to article 36 questions to the Council.

Advisory note rental space Tournooiveld

Stichting Wooninc has asked if they may temporarily use the common room in the building at Tournooiveld 10 in Geldrop until the Jonkvrouw is completed. The temporary use must be laid down in a fixed-term rental agreement.

The college decides to approve the lease agreement for a maximum of 1 year with Wooninc for the Tournooiveld 10 location in Geldrop with an effective date of November 28, 2023.
