Advisory note PDO Spechtlaan 4

Objection regarding the refusal to grant an environmental permit for an environmental planning activity for a padel court at Spechtlaan 4 in Mierlo.

The College decides:
1. To declare the objection admissible.
2. To declare the objection unfounded.
3. Inform the objector that this decision can be appealed to the court.

Advisory note memo answering questions D66 about ovonde Oudvensestraat

D66 asked a question about traffic safety at the new roundabout on Oudvensestraat. According to D66 it would be better for traffic safety to not connect the Oudvensestraat for car traffic to the oval and to construct an alternative route for this. In the attached memo we give a substantive reaction to this.

The College decides:
1. To approve the attached memo on the Oudvensestraat ovonde;
2. To forward the memo to the City Council.

Answer 2025.36.008 Questions DGG on 2nd walk-in evening Center Impulse Lommerrijk

Replying to the written questions (ex. Article 36 RvO) of the DGG in response to the walk-in evening "Centrumimpuls Lommerrijk dated February 25, 2025.

The College decides to agree to answer the questions and forward to the City Council.

Advisory note PDO Bishop van Mierlostraat

The denial of a request for enforcement has been objected to (2237531). This advisory memorandum is for decision on the objection received.

The College decides:
1. to declare the objection admissible;
2. to revoke the contested decision insofar as it concerns the rejection of the request for enforcement action against the camper van and instead decide to impose an administrative coercive order in accordance with the attached concept;
3. to revoke the contested decision insofar as it concerns the rejection of the request for enforcement action against the plank on the partition wall and instead decide to impose an administrative coercive order in accordance with the attached concept;
4. To uphold the remainder of the contested decision;
5. To award the objector compensation for the costs incurred in the objection pursuant to Article 7:15 of the Awb in the amount of 2 procedural points (lodging the objection and appearing at the hearing) with an average weighting, being (2x €624) €1,248.

Advisory note on land prices 2025

The land policy states that we annually submit the land prices to you for determination. The valuation report has been prepared by Stec Groep for Geldrop-Mierlo and we hereby submit it to you for approval.

The college decides to approve:
1. In option/purchase agreements in accordance with appraisals to assume the current land prices per m2 excl. VAT;

2. To continue the practice for the entries and exits to be used, whereby: 

a. Surcharges apply from 5 to 20% for lots with an unobstructed front, side or rear location or good orientation of the lots; b. A graduated scale applies from: 

i. 500 m² for lots for detached houses (every 100 m² 10% decrease); ii. 300 sqm for semi-detached houses (every 50 sqm 10% decrease)

iii. 160 m² for row houses (every 25 m² 5% reduction); 

3. Set the land price for ground-level social rental apartments at €25,000 per plot (starting point is average plots of about 90 m2, which means continuation of the price of about €280 per m2) and €25,000 in land value per social rental apartment;

4. For land prices for housing in the rental sector to apply a markdown compared to the owner-occupied sector of 10% for middle rental (with a maximum rent up to €1184.82);

5. For land prices for the various business lots, a separate appraisal order will be prepared in the coming months, continuing the 2024 prices from: 

a. Spaarpot South € 195 per m². 

b. Emopad € 185, - per m²

c. Beehive € 210 per m² 

6. To continue the following rates for unregistered land uses: 

a. € 139 per m² for land strips at the side or rear of the house up to a total plot area of 1000 m² 

b. € 89,- per m² for land strips at the side or rear of the house for a total plot area of more than 1000 m² 

c. € 89,- per m² for ground strips in front of the building line with the exception of the driveway. 

d. € 39 per m² for land strips used as driveways 

7. To set the land price for utilities at €230 per m2 with a maximum area of 100m2 and with a minimum selling price of €2,000.
