College proposal DD Adopting strategic information security policy

The strategic information security policy 2025-2029 provides a basis for safeguarding information security and is also necessary to ensure continued compliance with legislation and regulations. The municipal executive is administratively responsible for safeguarding information security within the municipality. The municipal executive determines the strategic policy for information security for the municipality.

The current strategic information security policy is valid until the end of 2025 and is outdated. This policy was adopted by the Municipal Executive in March 2020 and extended in 2024 pending the new Cybersecurity Act. This policy must be updated before January 1, 2026.

The council decides:
1. To adopt the strategic information security policy for 2025-2029.
2. To withdraw the current strategic municipal information security policy for Dommelvallei organizations.
3. To grant the municipal secretary the mandate to establish subject-specific tactical policy rules applicable to the municipality.

Advisory note Annual subsidy 2026 - Heppie Thuis

Heppie (t)Huis is a (temporary) place of residence in Geldrop-Mierlo for young people who can no longer live at home. On September 25, 2023, the municipal council of Geldrop-Mierlo decided to extend the Heppie (t)Huis pilot project by five years. Heppie (t)Huis has been designated a Service of General Economic Interest under the Exemption Decree. Furthermore, on September 25, 2023, the municipal council also approved the basic amount of the subsidy, excluding indexation, for 2024, namely €856,812. This council proposal requests approval for the granting of a subsidy for 2026 to Heppie (t)Huis. 
With the indexation as applied within purchasing region 10 for Youth (5.13% compared to 2025), the total amount for a subsidy in 2026 will be €1,005,660.96.

The council decides to approve the granting of a subsidy for 2026 in the amount of €1,005,660.96 to Stichting Heppie (t)Huis in accordance with the accompanying grant decision.

Advisory memorandum BOB Youth meeting place Hudsonstraat

Objections to the granting of an environmental permit for the establishment of a youth meeting place on Hudsonstraat in Geldrop.

The board decides:
1. To declare the objections admissible.
2. To declare the objections unfounded.
3. To refuse the requests for reimbursement of legal costs.
4. To inform the objectors that this decision is subject to appeal before the court.

College proposal Annual subsidy 2026 Weeffabriek Foundation

The municipality provides annual subsidies to social organizations, primarily to organizations with professional staff. For most subsidies, the decision-making authority lies with the Strategy and Social Policy team manager. For some organizations, including Stichting Weeffabriek, this authority lies with the municipal executive. In this advisory note, we ask the municipal executive to make a decision on the subsidy for Stichting Weeffabriek for the year 2026.

The council decides:
1. To approve a subsidy of €541,949.00 to Stichting Weeffabriek.
2. To approve an additional subsidy for the years 2024 and 2025 of €107,000.00 as a result of the reclassification of rental categories and adjusted income. 
3. To agree to the further drafting of guidelines for the Weeffabriek in Q1 2026 if they wish to make use of (part of) the reserved financial buffer of €125,000.
4. Incorporate the amended rental classification, including the new category for structural use of flexible spaces and the classification of social tenants, into the performance agreements.

Council proposal Annual subsidies for professional organizations 2026

Every year, our municipality allocates subsidies to social organizations. These subsidies are allocated for one year, mainly to social organizations that work with professional staff. These subsidies are generally higher than €50,000 per year. A total of 32 subsidies have been requested for the 2026 subsidy year. The applications come from organizations such as the LEV Group, the Geldrop Castle Estate Foundation, the Leergeld Foundation, the Halt Foundation, the Dommeldal Basic Library, etc. In principle, the mandate to decide on the amount of subsidies to these social organizations lies with the Strategy and Social Policy Team Manager. This does not apply to Basisbibliotheek Dommeldal, Stichting MFA Mierlo, Stichting Landgoed Kasteel Geldrop, Stichting Weeffabriek, Stichting De Wiele, Stichting Kunstkwartier, and Stichting LEV-groep. As a council, you must make a decision on the subsidies for these organizations. Through this advisory note, we ask you to make a decision on the subsidies for these social organizations in the 2026 subsidy year. The decision on the subsidy to Stichting Weeffabriek is not part of this advisory memorandum. We explain why in the introduction.

The council decides:
1. To approve a subsidy of €312,767.75 to the Landgoed Kasteel Geldrop foundation
2. To approve a subsidy of €183,972.00 to the MFA Mierlo foundation
3. To approve a subsidy of €785,347.48 to the LEVgroep foundation
4. To approve a subsidy of €190,221.00 to the Wiele Foundation
5. To approve a subsidy of €403,069.10 to the Kunstkwartier Foundation
6. To approve a subsidy of €846,063.00 to the Dommeldal Library Foundation.

Advisory memorandum on the cooperation agreement for the Eindhoven-East and Maarheeze grid expansion

To prevent a lack of transport capacity on the current electricity grid and to guarantee security of supply in the Eindhoven Metropolitan Region (MRE), the existing high-voltage grid will be expanded by constructing a new underground 150 kilovolt (kV) high-voltage connection between the existing 150 kilovolt (kV) high-voltage substations in Eindhoven-Oost and Maarheeze. The new route for this underground power cable, which is yet to be determined, will also run through the municipalities of Nuenen, Someren, Geldrop-Mierlo, Heeze-Leende, and Cranendonck. It is therefore necessary to sign a formal cooperation agreement setting out the responsibilities and tasks of each of these six municipalities and the Province of North Brabant.

The council decides to agree to:
1. Enter into the Cooperation Agreement (SOK) for the Eindhoven-Oost and Maarheeze network expansion.
2. Request the mayor to mandate the portfolio holder Stravers to sign the SOK on behalf of the council.
3. The accompanying Council Information Letter and forward it to the council.

We inform the council every quarter about the progress of the Housing Stimulus subsidy via a council information letter with a quarterly report. The attached quarterly report covers the third quarter of 2025.

The council decides:
1. To take note of the attached council information letter and quarterly report;
2. To forward the council information letter with quarterly report to the council.

Advisory memorandum on draft amendment to the Environmental Plan

The initiators have ceased activities related to pig farming and converted the site into an agriculture-related business. From that moment on, the main branch will be the landscaping company or contracting company, and a 998 m² warehouse for static storage will also be built.

The council decides:
1. To approve the draft environmental plan amendment Sanghorst 9, Mierlo;
2. Not to have an environmental impact assessment drawn up for the draft environmental plan amendment Sanghorst 9.

Council proposal Early termination of lease agreement Lopersgroep Mierlo

The Mierlo running club has indicated that it wishes to terminate the lease agreement for its accommodation at the Oudven sports park in Mierlo due to the financial burden (approximately €5,019.94 per year). The standard notice period is one year. The association is requesting a customized solution so that they can terminate the lease earlier. This requires a council decision because there is no power of attorney for such a deviation.

The council decides to agree to early termination of the lease agreement with Lopersgroep Mierlo as of December 31, 2025, without observing the contractual notice period of one year.

Advisory note on agenda requests from the Society Committee

In previous meetings of the Social Affairs Committee, various commitments were made regarding the provision of information to the committee for the purpose of forming an opinion.
1. In the area of Strong Local Teams (SLT), also in relation to the insights gained from the working visit to the municipality of Heusden.
2. An update regarding the informal care information point (including young informal caregivers).

With the proposed agenda requests, the board provides the presentations that have been promised. Both presentations will be given to the board one week prior to the committee meeting. This ensures that the information is always up to date and that the board has ample opportunity to refine the presentations where necessary. 

The presentation on SLT and the municipality of Heusden is scheduled for Tuesday afternoon, January 6, and the presentation on the informal care information point is scheduled for Tuesday afternoon, February 3.

The council decides to approve:
1. The agenda request Update on Strong Local Teams in relation to the visit to Heusden - Society Committee January 2026.
2. The agenda request Update on the Informal Care Information Point - Society Committee February 2026.

Advisory memorandum Annual plan for the Helmond-de Peel work center 2026

Under the SUWI Decree (Decree on the structure of the work and income implementation organization), all municipalities in the Helmond-De Peel labor market region must adopt an annual implementation plan for employer services. This plan is integrated into the annual plan of the Helmond-De Peel Work Center and is submitted for decision-making with this proposal.

The council decides to adopt the 2026 Annual Plan for the Helmond-De Peel Work Center.

Advisory memorandum - appeal - roof terrace canopies

The District Court of East Brabant has ruled on two enforcement cases. The court upheld the appeals. This ruling is subject to appeal to the Administrative Law Division of the Council of State. This advisory note discusses this in more detail.

The council decides to lodge an appeal with the Administrative Law Division of the Council of State against the judgments of the District Court of East Brabant of November 10, 2025, in case numbers SHE 25/1909 and SHE 25/1935.

Advisory note Process description for parcel division

The purpose of this process description is to provide a framework for assessing the requests for plot division that we receive. The framework promotes uniformity in both substantive and procedural terms. This is an amended version, based on the comments and observations made by the Council on the 2024 version. In response to the previous version, the Council requested that we move from broad preconditions to a more compact version and align with similar assessment frameworks used by the municipalities of Helmond and Peel & Maas. This has led to the current version. Given the requests, this version is much more compact and easier to understand for the initiator.

The council decides:
1. To approve the process description for the plot division assessment framework.
2. To approve the attached council information letter and forward it to the Council.

Advisory memorandum on the 2026 Fees Regulation, section on driver's licenses

The government recently set the fees for driver's licenses for 2026. Based on Article 10 of the Fees Regulation, the municipal executive may still set these fees independently (without a council decision) for the coming year.

The council decides to approve the amendment to the schedule of fees in the 2026 regulations on administrative charges, section on driver's licenses.

Advisory memorandum on the Packaging Participant Agreement 2025-2030

On June 18, municipalities at the VNG General Meeting agreed to the new arrangements for the collection of packaging waste – the Packaging Cooperation Agreement 2025-2030. The agreements are only binding on a municipality after an individual participation agreement has been entered into. This advisory note concerns the conclusion of an individual participation agreement with Verpact for the Municipality of Geldrop-Mierlo.

The council decides:
1. To enter into the individual participant agreement with Verpact as referred to in Article 1.3 of the Packaging Cooperation Agreement 2025-2030.
2. To send the attached Council Information Letter.
3. To incorporate the financial consequences of the new agreements in the second interim report.

College advice on commuting arrangements

As of January 1, 2026, in accordance with the CAO municipalities and CAO Cooperating Municipal Organizations (SGO), it will be mandatory for employers to have a commuting allowance scheme. A joint scheme has been drawn up for the Dommelvallei organizations. Agreement on the scheme has been reached in local consultations with the trade unions and representatives from the organizations. This scheme will be submitted to the boards and councils of the individual Dommelvallei organizations for approval.

The council decides:
1. To adopt the Dommelvallei organizations' commuting travel expense reimbursement scheme, effective January 1, 2026.
2. To evaluate the scheme in November 2026 with regard to the use of private motor vehicles, in accordance with the agreement made in the Local Consultation.

On December 2, 2025, the GR Senzer update dossier was discussed and approved with amendments. The agenda request was missing from these documents. The council requested that the agenda request be placed on the agenda for December 9.
