Advisory note on mandate under the Child Care Act

In every municipality, a large proportion of decisions consist of simple routine decisions. They are often implementation tasks based on co-management or council regulations and there are often no political aspects involved. Mandate is then an appropriate instrument to serve our citizens quickly and efficiently. This applies, for example, to the implementation of the Child Care Act. In this area, a number of powers lie with the college that lend themselves to mandate.

The College decides to approve the Child Care Mandate.

Advice note decision on objection felling trees on the Bekelaar in Mierlo

A notice of objection has been filed against the decision of the college granting an environmental permit for the felling of 20 trees in the public area in Mierlo. The Objections Committee has recommended that the objection be declared inadmissible and that the objections not be considered in substance.

The college decides to declare the objection inadmissible and not address the substance of the objections.

Advisory note BOB 2 complete Pankenstraat to Berkhouthof

'Fazantlaan - West' is the next expansion phase of the Luchen neighborhood in Mierlo. This urban development plan completes Luchen phase 2 and fills the transition area towards the outlying area and the wooded edge near the Luchenseheide with housing. The plan consists of 20 houses or bungalows that can be used for life and takes into account the incorporation of approximately 10 to 15 tiny houses. Due to the transition to nature and the outlying area, in line with the statement of your college to opt for quality, the plan is spacious. This is also in line with the provincial frameworks that apply to this area. Due to a lower housing density, there is plenty of room for experienceable greenery. The urban plan has been drawn up exclusively for land belonging to the municipality, so that realization can take place in the shortest possible time.

This urban plan forms the basis for the zoning procedure to be completed and the development of the development plan. After adoption of the urban development plan, local residents will also be informed and involved in the layout of the greenery and public space. In addition, this urban development plan establishes the location for the tiny houses.

The College decides:
1. To approve the urban development plan of Pheasant Avenue - West.
2. To agree to carry out an informative participation process for local residents.
3. To agree to inform the council with the attached council information letter.

Cover page college proposal adopt designation decision SGEB Energy House Smart Housing

It is mandatory for municipalities to have an energy desk. The Energiehuis Slim Wonen (EHSW) fulfills this role for our municipality, among others. In order to enable the future financing of the EHSW, the Municipal Executive of Geldrop-Mierlo decided on May 30, 2023, to submit a draft Designation Decision Services of General Economic Interest (SGEI) for the implementation of a municipal energy counter by the EnergieHuis Slim Wonen for public inspection for six weeks. This public inspection period has now passed and no views were submitted.

The College decides to adopt the Designation Order on Services of General Economic Interest (SGEI) for implementation of a municipal energy counter by the Energy House Smart Living without any changes.

Adoption of zoning plan Aardborstweg 14 Mierlo

In the meeting of May 16 your college approved the draft zoning plan 'Ruimte voor Ruimte Aardborstweg 14 Mierlo'. As of May 26, 2023, this plan has been available for public inspection for 6 weeks. During this period one new view has been submitted. We see no reason to change the plan.

The College decides:
1. To agree to the proposed response to the view.
2. To request the council to adopt the zoning plan 'Ruimte voor Ruimte Aardborstweg 14 Mierlo' unchanged.

Advisory note Draft GR ODZOB 2024 regulation

On July 17, 2023, the General Board of ODZOB submitted the Draft Joint Scheme ODZOB 2024 to you, with the request to make a proposed decision to adopt the new GR ODZOB 2024. Between the GGD, Metropoolregio Eindhoven, Veiligheidsregio and ODZOB alignment has taken place with the aim to act jointly where possible on process and content. The opportunity was also taken to update the text of the ODZOB GR where necessary, to harmonize it with the text of the joint regulations of the other two environmental services in Brabant and to draw up the regulation in accordance with the Instructions for Regulations.
The draft regulation should be submitted to your council for an opinion procedure.

The College decides:
1. To agree to Draft Joint Arrangement ODZOB 2024.

2. To agree with the draft letter prepared and to send it to the daily board of ODZOB.
3. To agree with the attached council proposal, with the decision points below:
a. To take note of the Draft Joint Scheme ODZOB 2024.
b. Not to express an opinion on the draft Common Scheme ODZOB 2024.
4. To forward the council proposal to your council for an opinion procedure.

Advisory note council proposal view GM on 2nd budget amendment DD 2023

On June 26, 2023, the Executive Board of the Dommelvallei Service adopted the 1st administrative report 2023 and, following this, submits the draft 2nd budget amendment to the councils for a view. In the draft council proposal it is proposed to the council not to send an opinion.

The College decides:
1. To agree to the draft council proposal;
2. To present this proposal to the council on September 25, 2023.

Council proposal Adjustment common regulation (GR) GGD

The current Common Scheme GGD Brabant-Zuidoost has been in force since 2021. In the meantime, the amended Common Regulations Act has entered into force, as a result of which the GGD Brabant-Zuidoost Joint Scheme needs to be adjusted. The colleges of the participating municipalities are now being asked to submit the draft regulation to the municipal council in order to give the municipal council the opportunity to express an opinion. To this end, the Executive Board has released a proposal for an updated version with an effective date of July 1, 2024.

The College decides:
1. To endorse the draft view;
2. To put the council proposal (including draft opinion) on the agenda for the council meeting on September 25, 2023.

Advisory note Decision on objection to compensation for planning damage

On behalf of an entitled party, a notice of objection has been filed against our decision to grant relief for planning damage. The purpose of this college opinion is to issue a decision on the objection.

The College decides to declare the objection admissible and unfounded and to deviate from the opinion of the Objections Committee.
