College proposal Informational presentation Reform Agenda - IZA - GALA

The informational presentation to the Society Committee will focus on three major agreements: the Youth Reform Agenda, the Integrated Health Agreement (IZA) and the Healthy and Active Living Agreement (GALA). These accords require action from our council and will have significant impact on the social domain. We want to thoroughly inform the council about the goals, challenges and intended approach of each agreement so that we can effectively plan and respond to these developments.

The college decides to approve the presentation Reform Agenda Youth - IZA - GALA for the Society Committee on March 5, 2024.

RIB ruling RvS BP Bogardeind 85 to 123

The Administrative Law Division of the Council of State has declared the appeals against the zoning plan "Bogardeind 85 to 123" unfounded.1 Zoning and exploitation plan are thus irrevocable.

The college decides:
1. To send the attached council information letter to the council;
2. To reimburse litigation and court costs in accordance with the ruling.

Opinion Final Design redevelopment Heggestraat Nieuwendijk

On December 16, 2013, the City Council adopted the Center Vision and the Consultation Memorandum on Parking (amended). This provides for a phased implementation of an integral redesign of the public area in the center of Geldrop. Meanwhile, the preliminary design for the redevelopment of the Heggestraat and Nieuwendijk has gone through the formal public participation procedure and the final design can be established. Execution of the work is foreseen in 2024.

The college decides:
1. To agree to the final design for the redesign of Heggestraat and Nieuwendijk in accordance with the attached drawing, dated 24-01-2024;
2. To agree with the introduction of a parking regulation on the area at the back of Korte Kerkstraat, by designating this road section for parking by permit holders within the window times Mon-Sat from 9:00 am to 6:00 pm;
3. To agree with the additional required investment amount of € 110,000 and to report this to the council at the 1st interim report 2024.

Advisory note Regional official instruction on compulsory education

Pursuant to the Compulsory Education Act 1969, mayor and aldermen are required to adopt an official instruction for the compulsory education officer/roughline of education (formerly RMC). The current regional official instruction dates from 2018 and needs to be updated and then reestablished.

The college decides to adopt the regional duty instruction for the compulsory education officer/Transit Point 2024.

Advisory note on contract takeover Preschool Monitor

The municipality of Geldrop-Mierlo has had a service agreement with the Peutermonitor since 2019. The Dommelvallei Service was informed by the Peutermonitor in December 2021 that a new organizational structure will apply to the Peutermonitor as of January 1, 2022. The service agreement with the municipality was signed by Innovation Zero13 B.V. on behalf of the Peutermonitor at the time. Due to the new organizational structure at Peutermonitor, the formal contracting party will change to Peutermonitor B.V.. The municipality of Geldrop-Mierlo has been asked to cooperate in writing with this contract takeover. This explicitly does not change the existing agreements.

The college decides:
1. To agree to cooperate in the contract takeover regarding the service agreement on the Toddler Monitor;
2. To have the mayor sign the attached document granting written cooperation to the contract takeover as counterparty.

Advisory note view and RIB NRD

Defense has concluded the process of reopening De Peel Air Base, which began in 2019. They have started implementing the National Defense Space Program (NPRD). This program includes all space requirements of the Ministry of Defense. On December 18, 2023, Defense published the Note on Scope and Detail for this purpose. Until February 12, 2024, interested parties can submit views.

The College decides:
1. To adopt the view of the Municipality of Geldrop-Mierlo on the NRD, which has been coordinated with 13 regional municipalities, and to submit it to the Ministry of Defense.
2. To inform the Council about the opinion and future participation moments in the process National Defense Space Program by means of a Council information letter.

Advisory note Updating PGB in Youth and Social Services Regulation

On August 16, 2023, the Central Appeals Council (CRvB) ruled on the informal pgb rates in the social network within the Wmo. These rulings have implications for the regulation and must therefore be adjusted. A similar provision applies to the Youth Act as in the Wmo, so there is a good chance that the rulings relate to this as well.

The college decides to submit the council proposal Update PGB Regulation Youth Aid and Wmo including policy rules to the city council for adoption.

Advisory note on adoption of zoning plan Genoenhuizerweg 6

The municipality wants to make housing development possible on the plot at Genoenhuizerweg 6 in Geldrop. Previously, urban development frameworks were established for this purpose and agreements were made with Vasgoedregisseur B.V. about the development. After the informal participation process was completed in the spring and summer of 2023, the formal procedure was started in November by publishing the draft zoning plan. The zoning plan is now ready for adoption.

The college decides:
1. To agree with the proposed response to the views;
2. To request the council to adopt the 'Genoenhuizerweg' zoning plan as amended;
3. To request the council to adopt the 'Genoenhuizerweg Image Quality Plan' for the plan area.

Lease agreement Crossroads with attachments_signed

The unaccompanied minors taken in at the Akert are subject to compulsory education. Jan van Brabant college provides the NT2 education. However, this school year there is no room at their location in Helmond. We have rented two classrooms in the Kruispunt for education. Users of the classrooms are Jan van Brabant College and COA. The liability is passed on to them and this is laid down in an agreement.

The college decides to conclude the attached agreement with the users, the Jan van Brabant College and COA regarding the indemnification of liability the premises 't Kruispunt for the spaces rented by us in 't Kruispunt for educational purposes.

Advice note cooperation deviation environmental plan

The municipality has received an application to build 25 apartments on the parcel Hoog Geldrop 24-26; formerly the GAM garage. There is also serious soil contamination on the plot. The plan deviates from the environmental plan and the developer requests our cooperation with the deviation.

The college decides:
1. Not to agree to the underlying plan;
2. To agree to a development to residential provided the development meets the following preconditions:
a. Mill protection zone; we are not prepared to deviate from the mill protection zone from the zoning plan Woongebieden Zuid-west and it is the responsibility of the initiator to comply with the standards of the mill protection zone, such that the interests of the Molenstichting Geldrop-Mierlo with regard to 't Nupke' are included in coordination with the Molenstichting and that prior to contacting the Molenstichting the official employee dealing with the mill biotope is informed;
b. Parking: the plan must comply with the Nota Parkeren;
c. To take into account the urban development preconditions in the further elaboration;
3. To make use of the authority from the Water Storage Ordinance to draw up a custom regulation (art 2.2) and to set the required storage volume at 30 liters per m2.

Advisory note on redesigning St. Joseph Square

The college approved the final design for the redevelopment of the public space around St. Joseph Church in 2021. In 2023, the developers started the conversion of the church. Following the actual start construction, the final design was reviewed again. In doing so, it was found that the design no longer meets current policy standards. Consider the greening and water tasks of the municipality of Geldrop-Mierlo. The new design is more climate robust. The biggest change in the design is the elimination of a separate lane for parking at the elementary school. This creates more space for greenery.

The college decides to approve a new preliminary design St. Joseph Square and release it for public participation.
