Through the annual report 2023 Purchasing Region 10fortheJeugd we would like to inform you about the state of affairs.

The College decides to approve sending the attached Council Information Letter to the City Council.

Advisory note Implementation plan SUWI law

The Wet Structuur Uitvoeringsorganisatie Werk en Inkomen (SUWI Act) stipulates that municipalities (in our region Senzer) and the UWV annually draw up and implement an implementation plan jointly. This cooperation takes place under the name of the werkgeversservicepunt (WSP) The direction of this lies with the central municipality, but the law stipulates that all municipalities in the labor market region must have the implementation plan adopted separately by their college.

The college decides to approve the adoption of the SUWI Law 2024 Implementation Plan.

This council information letter informs the council about the National Ombudsman's report on the caravan and pitch policy. It also indicates the follow-up steps.

The college decides:
1. To approve the attached council information letter.
2. To forward the council information letter to the council.

Board proposal Adjustment common regulation GGD after view

As of July 1, 2022, the Common Regulations Act has been amended. This makes it necessary to amend the GGD Brabant-Zuidoost Joint Scheme. After the councils were given the opportunity to present an opinion, GGD has tightened up some changes. The college is now asked to agree to the Joint Scheme 2024. The Joint Arrangements Act stipulates that colleges do not proceed to amend an arrangement except after obtaining the consent of the municipal councils. The consent can only be withheld due to conflict with the law or the public interest. The proposal indicates how the opinion of Geldrop - Mierlo has been dealt with. This is for information purposes because no arguments can be derived from it to withhold consent.

The college decides:
To submit the council proposal Adjustment Joint Regulation GGD Brabant-Zuidoost, containing the following decision points, to the council for decision-making: 

  1. To take note of the Common Scheme GGD Brabant-Zuidoost 2024 after view 
  2. To authorize the College to adopt the amendment to the Common Regulation GGD Brabant-Zuidoost 2024.

After obtaining the consent of the council, agree to the Common Scheme GGD Brabant-Zuidoost 2024 and notify GGD.

Advisory note Amendment to purchase agreement the Waag

Compaen has requested a deviation from Article 8a of the purchase agreement. Article 8a states that 20 homes will be rented to the 55+ target group. The request relates to letting 9 of these homes to starters. The 'starters' target group is also a target group that has difficulty entering the housing market. This also creates a good mix (caregiver-caregiver).

The college decides:
1. To agree to amend the purchase agreement.
allowing 9 of the 20 apartments to be allocated
to the target group starters.
2. To agree to the draft letter in order to subsequently send it

Advisory note decision on objection to air conditioning unit

The environmental permit for an air conditioning unit was objected to because of the noise it makes. The Environmental Department has indicated that the air conditioning unit does indeed make more noise than is permitted under the 2012 Building Code. The Objections Committee recommends that the contested decision be rescinded and that the environmental permit be denied upon reconsideration.

The college decides:
1. To declare the objections to the environmental permit for the air conditioning unit well-founded;
2. To deny the permit for this air conditioning unit, as applied for, on reconsideration as yet;
3. To supplement the statement of reasons, among other things in connection with the entry into force of the Omgevingswet;
4. To inform those concerned that this decision can be appealed to the court.

Oudvensestraat sports park planning area A

Due to the need to modernize the clubhouse HC Mierlo, a zoning plan has been prepared to allow for the replacement and expansion of the clubhouse. The (draft) zoning plan was available for review for 6 weeks starting December 13, 2023, and must be adopted by the council.

The college decides:
1. To request the council to adopt the zoning plan 'Sportpark Oudven' with plan identification number NL.IMRO.1771.BPSportparkOudven-ON01 unchanged.
2. To agree with the proposed response to the views;

Advisory note title complaint DI - LenV

It concerns the handling of a complaint. The complaint concerns the passive response to a report of a groundwater withdrawal and the failure to respond adequately and timely to written (follow-up) questions. The complaint was submitted to the independent Complaints Committee. The committee has issued an opinion after which the college must make a decision on the complaint. This is done in this advisory memorandum.

The College decides:
1. To declare the complaint founded in accordance with the opinion of the Grievance Committee.
2. Notify the complainant in accordance with the draft offered.

Advisory Note Regional Administrative Agreements Protected Housing

From its role as central municipality, Eindhoven municipality receives the resources for the customized provision of Protected Housing (BW) for the Eindhoven region (15 municipalities). For the implementation of BW Administrative agreements have been made and mandates issued by our municipality to the municipality of Eindhoven. It is proposed to re-establish these agreements until 1-1-26 at the latest and thus ensure a uniform regional approach in outline and implementation in the field of BW.

The College decides to agree to:
1. the extension of the existing Administrative Agreements for Protected Housing until no later than January 1, 2026.
2. the mandates for Protected Housing to be issued to the Municipality of Eindhoven until January 1, 2026 at the latest.

Advisory memorandum Contracting help with household from 1-1-25

On January 1, 2025, the current agreement with care providers of Household Assistance will expire, there is no possibility to extend it. At the same time, the agreements in neighboring Dommelvallei+ municipalities (Waalre, Nuenen and Son en Breugel) will also expire. The college is asked to agree to the cooperation between these municipalities to reach a joint agreement as of January 1, 2025. In addition, it is advised to join the rate setting as prepared at the regional level by Bizob.

The college decides to agree to:
1. To jointly work towards one agreement for Household Care as of January 1, 2025 with the Dommelvallei+ municipalities.
2. To apply the regional rate setting as prepared by Bizob in that agreement.

Advisory note Additional budget again Sustainability Incentive Loan

The Sustainability Incentive Loan is running so well that the available budget is again insufficient. This advisory note is about requesting additional budget to keep sufficient funds available to provide new loans.

The college decides:
1. To agree to provide an additional credit of € 1,000,000 for the provision of Incentive Loans for Sustainability to individual residents and to pay this in parts to SVn if the budget of the Incentive Loan for Sustainability is insufficient to approve a new loan.
2. To offset the interest result and implementation costs of these additional loans annually against the Housing Provision, in the same way that current incentive loans are funded.
3. Agree to the council proposal proposing this to the City Council.
4. To agree to the agenda request.

Advisory Note Annual Grant 2024 Foundation De Wiele and Improvement Plan Future Foundation De Wiele

This advisory note proposes approval of the grant amount for the year 2024 for De Wiele Foundation and agreement to an improvement trajectory as a result of the council decision "Future Weeffabriek 2024." As a result of the council decision "Future Weeffabriek," De Wiele Foundation has been separated from the Weeffabriek and the Weaving Museum. Improvement plans for both the Weeffabriek and the Weaving Museum have been drawn up and approved by the council. Stichting De Wiele would also benefit from a thorough study and improvement plan to make the foundation future-proof and to substantiate the accrual of the foundation's subsidy. There is therefore a need for an improvement plan, for which Bureau Berenschot, an expert in developing the Igloo Model, can be engaged to guide this process. This advisory memo seeks approval to provide an amount for this research project.

The college decides:
1. To approve a subsidy of € 172,939.00 to Stichting De Wiele
2. To agree to the start of an improvement plan, under the guidance of agency Berenschot, for a future-proof Foundation De Wiele and to make a maximum of € 25,000.00 available for this purpose.
