Cover page Policy rules special assistance Participation Act 2023 Geldrop- Mierlo

Due to an objection procedure energy allowance from September 2022 it has become visible that there is a discrepancy in the Beleidsregels bijzondere bijstand Participatiewet 2020 Geldrop- Mierlo. Schulinck has advised to make a textual adjustment to the Policy Rules so that there can no longer be any confusion about this. Your college has adopted the textual adjustment below as of October 4, 2022 (case number 1400169).

Textual adjustment per October 4, 2022: Article 9, paragraph 4: Resources mentioned in article 31 paragraph 2Pw are released, apart from the resources mentioned in paragraph 3.

However, the Objections Committee seems to believe that the above adjustment still does not provide sufficient clarity. They seem to be of the opinion that the current policy rules provide as much room to dispute the determination of the carrying capacity provision. They attribute this to the fact that it does not explicitly state to which rules "....the resources listed in paragraph 3.... apply.

Coordination will be sought with the chairman of the Objections Committee to clarify the intent of the current policy rules. In addition, we would like to indicate that we have once again made a textual adjustment which should ensure that there can no longer be any confusion about the determination of the carrying capacity provision.

Proposed textual adjustment as of June 1, 2023: Article 9, paragraph 4: Resources mentioned in article 31 paragraph 2 Participation Act are released, apart from the resources mentioned in paragraph 3 of these policy rules.

After adoption of the present textual adjustment 'Beleidsregels bijzondere bijstand Participatiewet 2023 Geldrop-Mierlo', these will be published in the prescribed manner and the Beleidsregels bijzondere bijstand Participatiewet 2020 Geldrop- Mierlo will lapse simultaneously with this.

The College decides:
1. To agree with textual adaptation of the Policy Rule Special Assistance Participation Act 2023 Geldrop-Mierlo;
2. To publicly announce the policy rules adopted by you in the prescribed manner.

Cover page Evaluation Evaluation Sports Vision "Geldrop-Mierlo: Intertwined with sport" and recalibration Local Sports Agreement

On December 10, 2018, the City Council decided to adopt the current sports vision "Geldrop-Mierlo: Intertwined with Sports." This policy plan was adopted for a period of 4 years and was recently evaluated. The municipality also concluded a Local Sports Agreement with several partners in 2020 for the period up to 2023. Recently, this agreement has been recalibrated.

The college decides to approve:
1. The evaluation of the Sports Vision "Geldrop-Mierlo: Intertwined with sport".
2. To designate the recalibrated Local Sports Agreement as an evaluation of the current Local Sports Agreement.
3. The council information letter dated July 4, 2023.
4. To forward the council information letter with associated attachments to the council.

Advisory note OVA Indexation

As part of the Youth Reform Agenda, national contract standards have been developed to reduce the administrative burden. One of these aspects concerns indexing. The proposal is to use the indexation in the national contract standards for the Youth Care contracts within A 10 for Youth. With this we follow the developments of the Youth Reform Agenda and offer a clear and uniform indexation to the youth aid providers. For 2024, the indexation rate is set at 6.43%.

The College decides:
1. To agree to adjust the indexing provision within A 10 for Youth in accordance with national contract standards effective 1-1-2024 and to amend the indexing provision in the agreement accordingly.
2. Not to make interim adjustments in the future due to amended collective bargaining agreement provisions, as these will be reflected in subsequent annual OVA indexation which is an important basis for indexation.
3. To set the indexation rate for the Youth Care contracts at 6.43% for 2024.
4. Cover the contribution for the indexation from the budget Suppository Wage and Price Development.
5. To incorporate the financial consequences of € 180,854 in the 2024 budget.

Advisory note Taking stand with a mobile environmental site

Department of Spatial Planning will start in July with a trial with a Mobile Environment Street; at 4 locations in the municipality a manned container will be placed once a month where residents can hand in small amounts of bulky waste. This stems from the Waste and Resource Plan Geldrop-Mierlo 2022-2025, which was adopted by the City Council in October 2021. Pursuant to the APV (Article 5.13), a stand permit is required for placing the mobile environmental street. However, in the Stand Places Policy Geldrop-Mierlo 2016, some of the chosen locations are not designated as such as a stand location. In addition, the policy states that the majority of the locations allow 1 stand location, almost all stand locations at the designated locations are licensed, this means that by placing a mobile environmental street will exceed the number of stand locations per location. 

The College decides:
1. To deviate from the stand policy Geldrop-Mierlo by granting permission for the occupation of a stand with a mobile environmental street from July 7, 2023 until January 1, 2024 at non-designated stand locations Genoenhuis (Laan van Tolkien) and Sporthal de Weijer.
2. To deviate from the Geldrop-Mierlo 2016 stand location policy by granting permission for a stand location with a mobile environmental street from July 7, 2023 to January 1, 2024 to exceed the number of stand locations per location (Braakhuizen Noord/parking lot Lidl).

Through this infographic, we chart the progress of the Sustainability Program adopted by the City Council in February 2023. This progress report is intended to keep the City Council informed of the status of the projects in the program, and to show council members where outside of the program further work is taking place.

Cover page college proposal Art 36 questions

The CDA Group has asked article 36 questions about the encouragement of recycling cans and bottles. The answers to the questions boil down to the fact that it is actually too early to make any concrete statements on this. Particularly the volunteers of the IVN have the impression that the number of cans in litter has decreased, but that is not endorsed by everyone.

The college decides to approve the attached response to the questions and distribute it to council members through the Municipal Clerk’s Office Office.

Advisory note deployment Berenschot

It is requested that an independent party be deployed in the 'Future Weeffabriek' support process. This independent party will have a connecting role in jointly establishing new agreements between the Municipality of Geldrop-Mierlo and the Board of the Weeffabriek Foundation with regard to clear assignments and simplified financial flows.

On the recommendation of the foundation board, consultancy firm Berenschot was asked to make a tender to advise on a future-proof operation for social cultural center the Weeffabriek. In the process, we feel an independence in the process guidance is necessary to create speed. The consultancy focuses on the operation of the Weeffabriek. This includes building management, cultural and social programming and commercial exploitation (catering and rental). They do not advise on real estate or installations. Berenschot names 2 options in the assignment description. We recommend option 1.

The college decides
1. To approve the use of the consulting firm Berenschot as an independent party in the creation of a new clear assignment to the Weeffabriek and to arrive at clear financial flows.
2. To agree to option 1 in the advice on a future-proof operation for the Weeffabriek.
3. To charge the costs of € 15,714 to the SPUK funds.
