Advisory note on decision on objection to refusal decision under the Noise Pollution Act

An objection has been lodged against the decision of the college in which additional noise protection façade measures under the Noise Abatement Act and the Noise Abatement Decree have been refused at the address Geldropseweg in Mierlo. The Objections Committee has advised that the objection is admissible and unfounded and that the contested decision should remain unchanged.

The College decides to declare the objection admissible and unfounded and to uphold the contested refusal decision unchanged, as per the attached draft decision.

December Circular 2022

At the end of 2022, the State published the December Circular. As usual, this Circular contains few changes from the September Circular. However, unlike usual, part of the 2023 energy surcharge has been brought forward, which has been incorporated into this circular.

The College decides:
1. To take note of the results of the December Circular 2022, including the accompanying council information letter.
2. To send the council information letter December Circular 2022 to the council.

Board proposal participation report neighborhood plan Mierlo Southeast

A neighborhood plan was created for the Mierlo Southeast neighborhood. This plan was adopted in the council meeting of February 7, 2022, RB GM2021-237684. Residents and social partners contributed to the Mierlo Southeast neighborhood plan. As stated in the Participation and Public Participation Ordinance of 2015, a report was prepared describing the participation process. This report can be sent to the council for information with an explanatory memo.

The college decides:
1. agree with the contents of the participation report neighborhood plan Mierlo Zuidoost
2. to forward the final report to the council for information
3. agree to make the final report public.

Advisory note on amendments to statutes Platoo

PlatOO Foundation requests the approval of the municipality to change its statutes. The reason for this are new laws and regulations and also the desire to have the possibility to include collaborative schools within the school board. The changes to the statutes do not affect the public character of the schools. Within the framework of the supervisory role of the municipality on public education, the municipal council must agree to changes in the statutes of PlatOO.

The college decides to approve:
1. The council proposal to amend the statutes of the PlatOO school board.
2. To submit this council proposal for approval to the Society Committee on March 14, 2023 and to the council on April 3, 2023.

Advisory note amended draft viewpoint cooperation agreement MRE 2023-2026

The college has put a council proposal on the agenda for the council meeting on Feb. 6, 2023, for the adoption of the view the council wishes to send to the DB of the MRE. The draft opinion was discussed in the general affairs committee on January 24, 2023. There the college was requested to present the draft opinion in modified form to the council on February 6.

The college decides to add the modified draft view (without shading) and an accompanying memorandum to the council proposal.

Advisory note on appointment of members of central voting committee

In connection with the introduction of the New Procedure for Determining Election Results Act on January 1, 2023, the existing chief electoral college (and thus central electoral college) expired by operation of law. A new central electoral committee must be established and its members appointed by the municipal executive.

The College decides:
1. To appoint the following persons as members of the central electoral committee of the municipality of Geldrop-Mierlo with effect from January 31, 2023:
o Mr. N.J.H. Scheltens, town clerk, also appoint as deputy chairman
o Mr. W.H.F. Geboers, registrar
o Mr. J.W.A. Bastiaans, department manager Services
o Mrs. B.J.K. Savelsberg-Kreijns, department manager Space
2. To appoint the following persons as deputy members of the central electoral committee of the municipality of Geldrop-Mierlo with effect from January 31, 2023:
o Ms. C.A.A.M. van Melick, department manager Samenleving
o Mr. M. Jeuken, team manager Support
o Ms. J. van den Elsen, Public Affairs team manager.
3. This appointment is for a period of 4 calendar years.

Article 36 questions were asked by GroenLinks about the tree felling on the Bekelaar in Mierlo as a result of the final plan for the Bekelaar redevelopment.

The College decides:
1. To approve the answer to the article 36 questions from GroenLinks about the tree felling on the Bekelaar.
2. To forward the answers to the questions to the city council.

Answering Art. 36 questions 2022.36.036 by DPM on Housing Service Dommelvallei Mierlo

Questions were raised by DPM regarding the housing of the Dommelvallei Service and the development of the current location.

The college decides to approve the response and forward it to the council.
