The decision list of the public college meeting of April 23, 2024 is adopted accordingly.

Advisory note extending DVO ODZOB 1 July 2024-1 July 2025

For the period 2019-2022 ODZOB and the participants have made agreements with each other in a service agreement (DVO) about the way in which client and contractor want to implement the basic and request tasks and the program of collective tasks. The obligation arises from art. 6 of the current Joint Regulation ODZOB (GR ODZOB) to make written agreements with each other about this. 

Spring 2022, ODZOB has, by order of its board, evaluated the current DVO 2019-2022 between the participants and ODZOB. Based on the evaluation of the current DVO, the main conclusion was: The current DVO is a good working agreement framework. This view is widely shared by the participants and organization ODZOB. The DVO had a term until January 1, 2023 and has been extended through addendum 2022 until July 1, 2024.

The effort was aimed at submitting the update of the DVO to the General Board at the same time as the new GR ODZOB in a decisive manner. However, the updating of the DVO by July 1, 2024 is no longer considered realistic.

Based in part on the evaluation, the ODZOB AB agreed on March 7, 2024 to extend the existing agreement for the period July 1, 2024- July 1, 2025.

The College decides:
1. To agree to extend the existing DVO for the period July 1, 2024 - July 1, 2025.
2. Authorize Mayor Jos van Bree to sign the Addendum to Service Agreement 2019-2022 (regarding extension July 1, 2024 - July 1, 2025).

The College decides:
1. To approve the attached response to SAMEN's written questions.
2. To forward the response through the Municipal Clerk’s Office to the City Council.

Advisory Note Annual Report 2023

Through a cycle, the province annually monitors the quality of the municipality's performance of statutory VTH tasks. It checks whether we are doing this well and, if necessary, indicates points for improvement, with the aim of continuing to develop and optimize the quality of licensing. The annual report is part of the VTH policy cycle. It is a useful tool to reflect on the results achieved, to take stock and, on this basis, to make adjustments in the coming period.

The college decides:
1. To adopt the 'Annual Report on Licenses Geldrop-Mierlo 2023'.
2. To inform the Council by means of a council information letter.
3. To inform the Province of North Brabant about this.

College proposal Draft Cure 2025 budget

On August 28, 2024, the General Board of Cure will consider its 2025 budget. The Executive Board of Cure now submits the budget first to the councils of the three municipalities to give them the opportunity to submit an opinion. A view has been prepared to be presented to the council on June 10, 2024.

The college decides to propose to the council to:
1. To take cognizance of the Draft Cure 2025 Budget;
2. To agree with the drafted view and submit it to the city council for approval;
3. To incorporate the financial consequences in the municipality's multi-year budget.

Board proposal amendment GR Cure

As of July 1, 2022, the Joint Arrangements Act (Wgr) has been amended. The purpose of this amendment is to strengthen the democratic legitimacy of joint arrangements and the framework-setting and controlling role of municipal councils. The amended legislation must be incorporated into all joint arrangements by July 1, 2024. This obviously also applies to the GR Cure. Your council gave its views on the draft amendments to GR Cure on February 19, 2024. The views of all three councils of the municipalities participating in GR Cure have been incorporated. All three councils explicitly requested that it be established that participation is in principle through the participants in GR. This has been adopted but with an amendment at the suggestion of the Valkenswaard municipality; instead of 2/3 it is now 1/3 of the councils that can ask the Executive Board for a separate participation process. If the number of participants in the arrangement increases, then a separate participation process can be conducted at the request of 50% of the councils. Valkenswaard's proposal was adopted by Cure because if such a request comes from one city council, in practice such a request will be honored. This is in the interest of good mutual cooperation and that each other's requests and interests are carefully weighed.

The college decides to approve the attached draft council proposal with attachments.

Gijzenrooi area process - target image

In late 2022, the Spatial Planning Committee agreed to a number of follow-up steps in the ongoing Gijzenrooi area process to arrive at a supported target image for the Gijzenrooi rural area. In 2023, a lot of hard work was done to further shape this target image (including a sketch session with area partners and a residents' evening in December 2023). The results have now been incorporated into a draft target image for the Gijzenrooi area. Based on the presentation, we would like to discuss this image-forming with the Space Committee.

The college decides:
1. To take note of the draft target image for Gijzenrooi (and the accompanying presentation) and the accompanying memo for the members of the Space Committee;
2. To put the presentation and the draft target image on the agenda for the Space Committee on May 28 in accordance with the attached agenda request.

Advisory note amending bowl boundary Geldropseweg

As a result of the traffic decision taken on November 22, 2022 and amended on December 10, 2022 to close the Brugstraat in Mierlo to through traffic, the traffic intensity on the Geldropseweg will increase. This will also result in a possible increase in noise pollution. In the appeal lodged against this decision it was agreed that we will change the current speed regime on the Geldropseweg between the current bowl boundary and the bridge over the Eindhovensch Kanaal. A speed regime of 50 kilometers per hour is only possible within the built-up area boundary and therefore by changing the existing bowl boundary.

In addition, the Municipality of Helmond will soon replace the bridge over the canal. During this replacement Helmond will change the city limit. There will be a logical continuation of the speed if we let our bowl boundary connect

The college decides to establish the new boundary of the traffic engineering built-up area limit on Geldropseweg in Mierlo, in accordance with the map appendix attached to the decision.

College proposal 1st turap 2024

The 1st Interim Report 2024 shows the development of budgets in the first 3 months of 2024. Overspends and underspends expected to differ from the budget at the end of the year are presented to the council. Once approved, the changes are made to the budgets.

The college decides to approve the overruns and underspends as included in items A and B and the credit report.

Events Principles

New event policy choices are currently being developed to replace the old version from 2010. The process will be done in 3 steps: the Events Basic Principles, the Events Policy Choices and the Events Implementation Program. All fall under the theme of Economic Strength. This advisory note deals with step 1 in this process, which is the Events Basic Principles. After judgmental discussion in the AZ Committee, these Basic Principles for Events should be adopted by the Council.

The college decides:
1. To agree to the Events Principles.
2. To agree to the Council Proposal Events Principles and forward them to the council.

Advisory note Local Accessibility Agenda

This proposal is to inform the Board and Council of the documents that make up the Local Accessibility Agenda. Attached is a council information letter to further inform Council members of the status and content of the Local Accessibility Agenda.

The college decides:
1. To take note of the local accessibility agenda.
2. To forward the local accessibility agenda to the Space Committee for an image-forming session.

Cooperation Agreement (SOK) Regional Mobility.

On Jan. 22, the draft Regional Mobility Cooperation Agreement was discussed in the Spatial Planning Committee and was subsequently approved in the council meeting on Feb. 19. On March 20, 2024, the adjusted Cooperation Agreement Regional Mobility with the Note of Views was discussed in the regional poho mobility. Based on the received views the final Cooperation Agreement was drafted by the MRE. The memorandum of views provides a reaction to the views and indicates which views led to an amendment.

The college decides:
1. To approve the final Cooperation Agreement Regional Mobility, version March 20, 2024;
2. Subsequently, with a positive opinion, to request the City Council's authorization to agree to enter into the Regional Mobility Cooperation Agreement on behalf of the municipality;
3. After obtaining the consent of the City Council, agree to enter into the Regional Mobility Cooperation Agreement;
4. Authorize the Alderman Mobility to sign the Cooperation Agreement on behalf of the College on June 19, 2024 during the Mobility poho, after which the Cooperation Agreement will be published and enter into force.
