Board Proposal Answer Art. 36 questions D66 on marring streetscape by daily PBD bags on lampposts

D66 asks article 36 questions about the daily marring of the streetscape by premature presentation of PBD bags at the lampposts in the center of Geldrop. 

A direct solution is difficult. After all, experience, also outside the municipality, shows that this problem cannot be solved with just an isolated measure. It is an interplay between communication, collection facilities and system and human behavior. 

Using underground containers for PBD would ostensibly be a solution, but this means of collection is no longer supported by Verpact. Due to contamination from other waste in underground PBD containers, municipalities using this collection tool for PBD no longer receive compensation through the agreement with Verpact. 

In the short term, we can commit to an awareness campaign, continue monitoring and enforcement in the form of surveillance and warning stickers. Possibly remove crown rings, but that moves the problem rather than being a solution. In the long term, for PBD in specific areas of the municipality (such as the center of Geldrop), post-separation could be a solution. The use of this collection method is being considered in the creation of new waste policy.

The College decides:
1. To approve the attached response to written questions from D66;
2. Forward response to the City Council through the Municipal Clerk’s Office .

Advisory note formal decision B&W Program land policy and cost recovery 2025

This resolution establishes the new annexes to the "Land Policy and Cost Recovery Program" ("Schedule 2025").
The Municipal Executive is the competent authority to adopt (annexes to) programs as referred to in the Omgevingswet .
The 'Land Policy and Cost Recovery Program 2025', with its new annexes, was approved by the City Council on November 11, 2024. After its adoption, the new 'Land Policy and Cost Recovery Program 2025' can be published according to the rules of the Omgevingswet.

The College decides:
a. To adopt the 'Land Policy and Cost Recovery Program 2025' and the associated updated appendices.
b. To determine that this 'Land Policy and Cost Recovery Program 2025' will enter into force the day after its publication on the Digitaal Stelsel Omgevingswet.
c. To revoke the 'Program land policy and cost recovery, Municipality of Geldrop-Mierlo', as published on January 16, 2024, on the date mentioned under b.

Advisory note on mandate to revoke parking permits

Pursuant to Article 15 of the 'Parking Ordinance Geldrop-Mierlo 2023', the Municipal Executive is authorized to revoke or amend permits.
However, no mandate has yet been arranged for this purpose.

The college decides:
1. To revoke the mandate according to the 'Mandate Register 2024 Geldrop-Mierlo' for the Spatial Development Team under numbers 53 and 54 ('Parking Ordinance');
2. To grant a mandate to grant, refuse, revoke or amend parking permits and visitors' permits, to:
a. the manager of the Spatial Development Team, with the possibility of submandating;
b. the environmental law lawyers.

College proposal RIB Social return on investment (SROI).

Social Return on Investment (SROI) is a labor market instrument that can be used to achieve social objectives when awarding contracts. Municipalities enter into contracts with contractors (in all kinds of fields, from Health to lampposts). Depending on the content, duration and scope of this contract, it includes an SROI obligation. This means that a percentage of the contract sum is allocated to people with a distance to the labor market. In this way, contractors are motivated to contribute to an inclusive labor market. 

For the seven municipalities of the labor market region and the GR Peelgemeenten, the implementation of the SROI policy, the Policy Framework SROI 2024-2027, has been assigned to the regional Servicedesk Social Return. The Servicedesk was launched March 2024. Over the past year, the Service Desk has invested in Map contracts with an SROI obligation, advising on SROI in new contracts and monitoring and supporting clients in fulfilling their SROI obligation. With the attached council information letter we inform the city council about the initial results of the Service Desk and the direction for 2025.

The College decides to approve the attached council information letter Progress of Regional Social Return Service Desk and forward it to the City Council.

Advisory note Implementation rules Common bicycle storage and storage for mobility scooters

The municipality, like many other municipalities, wants to allow an equivalent solution for the realization of communal bicycle storage and storage for mobility scooters at residential buildings. This is allowed based on Article 4.7 of the Omgevingswet and the Building Works Environment Decree (BBL).

The college decides to adopt the implementing regulations common bicycle storage and storage for mobility scooters at a residential building.

Advisory note Programmatic approach to housing

The Municipal Executive has asked AT Osborne to advise on how the Municipality of Geldrop-Mierlo, with a clear internal and external division of roles, can realize the housing task more effectively and more quickly. They issued an advice on this, which was presented to the Space Committee on June 3. We subsequently prepared an administrative response to this advice. This was also briefly explained on June 3. Both the report, the administrative response to it and the accompanying council information letter can be sent to the council.

The college decides:
1. To take note of the advisory report by AT Osborne: Woningbouwopgave Geldrop-Mierlo, onderzoek en advies naar programmatische kaders voor versnelling woningbouw;
2. To adopt the accompanying administrative response;
3. To agree to the attached council information letter;
4. To forward the council information letter, including the report and administrative response, to the council.

Board proposal to develop Dommelstroom Intervention Team

In 2024 the cooperation regarding the Dommelstroom Intervention Team was evaluated. The immediate reason for this was the expansion of the team leader's hours, which until then had been paid from temporary subsidy funds. Led by an independent quartermaster, discussions were held between the Dommelstroom municipalities in the first quarter of 2025. The purpose of these talks was to sharpen the frameworks, goals and principles of the DIT. As a result, agreements were made about frameworks, goals and structure (governance) of DIT towards the future. The quartermaster put the agreements made on paper in the form of a final report. The final report and its results will be presented to your college.

The college decides:
1. To take note of the final report of the Dommelstroom Intervention Team working group.
2. To agree to the increase in hours for the DIT coordinator from 0.5 FTE to 0.89 FTE.
3. To agree to structurally include the additional costs in the amount of 15,200 euros for the DIT coordinator in the budget of 2026 and beyond.
4. To agree to include an amount of 10,200 euros regarding the difference between the budget and actual costs 2025 in the second interim report.
5. To take note of the next steps in professionalizing the cooperation DIT.
6. To agree to temporarily re-establish the "old" DIT covenant until 31-12-2025 with the option of tacitly extending it by one year.
7. To send the final report to the City Council for information along with a council information letter.

Adviesnota Jaarstukken 2024 Geldrop-Mierlo

Herewith we offer you the final version of the Annual Report 2024 Geldrop-Mierlo, including the draft audit report and the response to it by the college (draft). Compared to the auditor's version, the result of the general service has been adjusted downward by approximately € 180,000.

The college resolves:
1. To approve the 2024 annual report and submit it to the municipal council for adoption with the accompanying council proposal;
2. To take note of the draft audit report and agree to the college's response to it;
3. To adopt the 2025-2026 improvement plan for archive and information management;
4. To agree to inform the municipal councils about the 2025-2026 improvement plan;
5. To agree to send the 2025-2026 Archive and Information Management Improvement Plan to the Provincial Executive of North Brabant.
