Advisory note DVO special assistance with GR Senzer

Since 2015, the seven municipalities in the labor market region of Helmond, Geldrop-Mierlo and Peel municipalities have placed tasks from the Participation Act, and the Social Employment Act (Wsw) on a regional basis in the joint arrangement Senzer (hereafter: GR Senzer).

As of January 1, 2023, Senzer will implement the Participation Act on the basis of delegation. For parts of the special assistance, individual income supplement and study supplement, the implementation tasks have not been formally established.

This proposal aims to formalize Senzer's implementation of these services through a service agreement (DVO) with retroactive effect as of January 1, 2025. The formalization also means that the associated implementation costs will be charged on to the Municipality of Geldrop-Mierlo as of January 1, 2025. Previously, only the actual benefits were charged on.

The College decides:
1. To agree to the attached Service Agreement (DVO) for the period 2025-2027;
2. To adopt the accompanying mandate decision;
3. To cover the costs of €20,928 per year excluding VAT from FCL 6630002 Special Assistance and to transfer, as cover for these costs, the necessary budget from FCL 6650001 participation projects for this purpose and to process this in the 1st turap 2025.

College proposal Application for authorization to suspend transfer of building permits

Municipalities must transfer building permits granted under the 1995 Archives Act to the Regionaal Historisch Centrum Eindhoven (RHCe) after 20 years. As long as the building permits have not been transferred, there is an illegality especially since the permits are not publicly accessible. Both the RHCe and the Interadministrative Supervision (IBT) of the province monitor this. The College hereby requests authorization from the Provincial Executive to suspend the transfer of the building permits for 5 years.

The College decides to request authorization for suspension transfer of building permits from the Provincial Executive.

Advisory Note on Implementation of Waste Ordinance.

In 2022, the "Waste Regulation Geldrop-Mierlo 2021" was adopted. A new ordinance requires an implementation decree. Due to circumstances, an implementation decree had not yet been established for this waste ordinance. The adoption of the implementation decree is a power of the Municipal Executive.

The college decides:
1. To adopt the 'Implementation Decree Waste Regulation Municipality of Geldrop-Mierlo 2025', belonging to the 'Waste Regulation Geldrop-Mierlo 2021'.
2. To perpetuate the current locations for waste containers as designated locations.
3. To repeal the 'Implementation and Designation Decisions for the Waste Regulation with Annex', as adopted on July 27, 2004.
4. To publish this decision on 'overheid.nl'.

Advisory note decision on objection allowing parking 2 wheels on sidewalk

On February 8, 2024, the Municipal Executive decided by traffic decree to allow parking with two wheels on the sidewalk in Griendstraat, 't Geluk
and Ziggenstraat in Geldrop. These traffic decrees were published in the Municipal Gazette on February 8, 2024 (nos. 54938, 55612, 55615).

On March 4, 2024, March 11, 2024, March 12, 2024, March 13, 2024, March 14, 2024, March 15, 2024, March 18, 2024, March 2024, March 21, 2024, March 26, 2024 and March 27, 2024 objections were filed against these
traffic decrees. These objections were heard at a hearing of the Objections Committee on May 13, 2024.
The objections are summarized in the College's statement of defense (Attachment 6) and the opinion of the Objections Committee (Attachment 7).

This advisory memorandum advises the College of Mayor and Alderman on the decision to be made on the objection

The College decides:
1. To declare inadmissible the objections of the objectors listed under B1 and B2 in Annex 4 of this advice note.
2. Declare the objections of the objectors listed under A in Annex 4 of this advice note admissible.
3. Revoke the contested decisions and adopt the decision on objections.

Advisory note decision on objection to traffic decision 2024-19 GPP by license plate

The college of mayor and aldermen has decided by a traffic decree on May 23, 2024, to designate an individual disabled parking place by license plate near the Ellenaar 5 in Mierlo. This traffic decision was published on the same day in the Municipal Gazette (no. 223748).

An objection to the traffic decision was filed on June 11, 2024. This objection was considered at a hearing of the Objections Committee on November 25, 2024.

This Advisory Note advises the College of Mayor and Alderman on the decision to be made on the objection.

The College decides:
1. To declare the objection of June 11, 2024 admissible.
2. To uphold the contested decision and adopt the decision on objection.

Advisory note on decision on objection Grote Bos

On November 13, 2024, the Municipal Executive responded by letter to the objector's request for the installation of noise-reducing asphalt and
the establishment of a truck ban in the Grote Bos in Geldrop.

On December 6, 2024, the objector filed a notice of objection to this decision. This objection was heard at the hearing of the Objections Committee on February 10, 2025.

This advice note advises the Municipal Executive on the decision to be taken on the objection.

The College decides:
1. To declare the objection inadmissible with respect to the noise-reducing asphalt section.
2. To uphold the contested decision for denying a truck ban and to adopt the decision on the objection.

Advisory note view on draft budget 2026 VRBZO

The Executive Board of Veiligheidsregio Brabant-Zuidoost (VRBZO) has sent the enclosed draft budget 2026 to the councils of the participating municipalities with the request to express their views on it before June 8, 2025. Pursuant to the Joint Regulation Veiligheidsregio Brabant-Zuidoost, the board is obliged to give the councils of the participating municipalities the opportunity to express their views on the draft budget.
The board will take the submitted views into account when preparing the decision-making on the budget in the General Board.
Decision-making in the General Board is scheduled for July 2, 2025.

The college decides:
1. To agree with the council proposal view on draft 1st amendment budget 2025 Security Region Brabant-Zuidoost, in which the following decision points are presented to the council:
1. To take note of the draft budget Security Region Brabant-Zuidoost 2026;
2. To adopt the prepared view on the draft budget Security Region Brabant-Zuidoost 2026.

Opinion on objection to rejection of urgency decision

By decision dated January 20, 2025, the objector's application for an urgency decision was denied. A notice of objection was filed against this decision. The objection was referred by you to the Objections Committee (hereinafter referred to as the Committee). On March 31, 2025, the committee recommended that the contested decision be upheld and that no urgency be granted.

The College decides:
1. To declare the objection admissible;
2. Declare the objection unfounded and uphold the contested decision and not grant urgency.
