Agenda request society committee task force on social domain

Every quarter the council is informed about the progress of the social domain task force through a report and a presentation in the society committee. The presentation this time will focus mainly on comparisons with other municipalities. The quarterly report will probably be shared with the council the week of the committee meeting.

The College decides to approve the agenda request for the November 18 Society Committee to explain the progress of the Social Domain Task Force.

Advisory note adjusting policy rules charging infrastructure and concession fee

The operating contract of existing charging poles installed between 2017 and 2020, known as phase B1, expires. A decision needs to be made on how to organize the continued operation. In addition, the province is asking the municipality to decide whether we want to introduce a so-called concession fee for the supplier and operator of the public charging stations of the current concession B3.

The college decides:
1. to participate in the tender for a new operating contract of existing public charging infrastructure led by the Province of North Brabant;
2. to grant a mandate to the general director of the Province of North Brabant to take the necessary decisions within the framework of the tender, mentioned under 1.
3. Request the Mayor to grant power of attorney to the General Manager of the Province of North Brabant to represent the Municipality of Geldrop-Mierlo in the tender, mentioned under 1, and to sign and manage the agreement resulting from the tender.
4. To refrain from introducing a concession fee as of January 1, 2026 for the operation of the Phase B3 public charging stations.

Board proposal framing Market Square

On September 30, a letter of intent was signed with Whoon/Rialto regarding the redevelopment of Market Square. October 7, the city council was updated on this. It was agreed with the council to involve them in area developments in advance. The attached framework-setting council proposal has been drawn up for this purpose.

The college decides:
1. To approve the attached council proposal and memorandum;
2. To approve the attached agenda request.

Advisory note repealing Building Ordinance Geldrop-Mierlo 2012

With the entry into force of the Omgevingswet on 1-1-2024, Section 8 of the Housing Act will be repealed. This formed the basis for municipal building regulations. In recent years, many parts of the municipal building regulations were already deleted. The remaining rules of the building regulation were transferred before 1-1-2024 to the temporary environment plan (a.o. the Bridal Estates), the Quality of the Living Environment Decree, the Building Quality Assurance Act and the municipal Heritage Ordinance and Ordinance on the Environmental Quality Advisory Committee. The "Building Ordinance Geldrop-Mierlo 2012" can now be repealed.

The college decides:
1. To submit the attached council proposal to repeal the 'Bouwverordening Geldrop-Mierlo 2012' to the city council;
2. After the council decision is taken, to process this repeal on overheid.nl and to publish the repeal via the Gemeenteblad.

Policy rules on compulsory self-housing

The City Council introduced a self-occupancy requirement for affordable new construction owner-occupied housing in 2022 and later established a seven-year conservation period in the Target Group Ordinance. The college has now adopted new policy rules that bring this term into line with it and provide clearer, more legally tenable provisions on the penalty and chain of custody clause. The new policy rules apply after the Feb. 7, 2022 decision is repealed. The earlier proposal was discussed in committee in late August and withdrawn at that time. Comments made by the committee have been incorporated into this new proposal.

The college decides:
1. To adopt the policy rules on compulsory self-housing of affordable new-build owner-occupied dwellings in Geldrop-Mierlo;
2. And to put them into effect after the city council has repealed the council decision on compulsory self-housing of February 7, 2022;
3. To propose to the city council to repeal the council decision on compulsory self-housing of February 7, 2022.

Advisory note on continuation of Joint Arrangement PlusTeam 2022

The Impact Analysis Strategic Assignment 'Dissolution GR PlusTeam and set up local teams' concerns an elaboration of the scenario in which the municipalities of Geldrop Mierlo and Waalre dissolve the GR PlusTeam 2022 and independently take up the task execution. The analysis also explores the Requirements and possibilities of continuing the cooperation in a different way. This proposal asks the college to declare its intention to dissolve the GR PlusTeam 2022. In doing so, it is also asked to give the City Council the opportunity to offer a view on this.

The Municipal Executive decides:
1. To express its intention to dissolve the Joint Scheme Public Body PlusTeam 2022;
2. To instruct the Municipal Secretary to advise the Municipal Executive before February 1, 2026 on whether or not to continue the cooperation on PlusTaken with the Municipality of Waalre in a qualitative and reliable manner;
3. To give the municipal council, with the council proposal attached as an appendix, the opportunity to express an opinion on the intention to dissolve the GR within eight weeks;
4. To thereby propose to the municipal council not to submit an opinion.
