Advisory note on appointment of member of Platoo Supervisory Board March 2023

The board of PlatOO Board of Public and General Accessible Education has submitted a request to approve the appointment of Ms. Kerstin Vogel as a member of the Supervisory Board. It is proposed to approve this appointment of Ms. Kerstin Vogel.

The College decides to approve the appointment of Ms. Kerstin Vogel as a member of the PlatOO Supervisory Board.

Explanatory Memorandum on Poverty Reduction Update 1.2

On March 14, 2023, the Society Committee held an image-forming discussion on the poverty reduction update. In response to the comments, suggestions and questions submitted, one concrete goal has been added in the draft update on poverty reduction, one goal has been tightened and a number of policy choices and interventions have been clarified. The enclosed explanatory memorandum explains the changes. It also addresses several other points raised at the Society Committee meeting.

The college decides to approve:
1. Changes to draft update on poverty reduction version 1.2;
2. Explanatory Memorandum describing and explaining these changes.

Advisory note rejecting grant application SHGM

In recent years Stichting Huurdersbelangen Geldrop-Mierlo (hereinafter: SHGM) existed as an umbrella tenants' organization of all tenants' organizations of the locally operating housing corporations (Woonbedrijf, Wooninc. and Compaen). Private tenants were also represented. Among other things, it acted as an advocate on behalf of the tenants of the three housing corporations. SHGM has received an annual subsidy from the municipality for carrying out its work since 2007. SHGM has again applied for a subsidy for the coming years. Because two of the three tenant organizations have indicated that they no longer wish to be represented by SHGM, SHGM no longer meets the Requirements for granting a subsidy. For this reason, on December 21, the college notified SHGM of its intention to reject the grant application for the period 2023- 2027. In response, SHGM submitted views. The college must make a decision on the application for the subsidy as well as respond to the views expressed.

The College decides:
1. To reject SHGM's grant application for the years 2023 - 2027.
2. To adopt and send to SHGM the attached letter "Decision to Reject Grant Application from SHGM".

Answering council questions VVD - Environmental permits granted by operation of law in 2021 and 2022

On March 8, 2023, Mrs. M. Leenders, VVD Geldrop-Mierlo group chairman, asked written questions under article 36 RvO. These questions concern permits granted by operation of law in the years 2021 and 2022.

The college decides to approve the attached answer to the written questions of Ms. M. Leenders, VVD Geldrop-Mierlo group chairman, dated March 8, 2023.

Advisory note on land prices 2023

Land prices are submitted to you annually for determination.

The college decides to approve:
1. To assume the current land prices per m2 excl. VAT as described below in option/purchase agreements in accordance with appraisals.
2. To continue the working method for the additions and markdowns to be applied, whereby:
a. Surcharges of 5 to 20% apply for plots with a free location at the front, side or rear or a good orientation of the plots.
b. A graduated scale applies from:
i. 500 m² for lots for detached houses (every 100 m² 10% discount);
ii. 300 m² for semi-detached houses (every 50 m² 10% decrease)
iii. 160 m² for row houses (every 25 m² 5% decrease)
3. To set the land price for ground-level and stacked social rental housing at €350 gross per m² or per m² GFA, as the case may be.
4. For land prices for houses in the rental sector to apply a discount compared to the owner-occupied sector of:
a. 20% for ground-level and stacked social rental (net € 280 per m² with a maximum rental sum up to € 808.06).
b. 20% for low middle rent (with a maximum rent sum up to € 898.71)
c. 10% for high middle rent (with a maximum rent sum up to € 1000,-)
d. 0% for expensive rent
5. To set the land price for tiny houses at € 460,- per sq. m., the common land belonging to the project at € 230,- per sq. m.
6. To use the following rates for land prices for the various business plots: a. Spaarpot Zuid € 195 per m²
b. Rielsepark € 225, - per m².
c. Bijenkorf € 205 per m²
7. To apply the following rates for unregistered land use:
a. € 139.- per m² for ground strips at the side or rear of the house up to a total plot area of 1000 m²
b. € 89.- per m² for strips of land to the side or rear of the dwelling if the total plot size exceeds 1000 m².
c. € 89,- per m² for strips of land in front of the building line with the exception of the driveway.
d. € 39,- per m² for strips of land used as driveways.

Advice note college response Brabant

On January 31, 2023, Gedeputeerde Staten sent a letter outlining the Brabant approach to national tasks and the spatial proposal. From the MRE cooperation now comes the proposal to respond to this in a regional context. It is proposed to set up an official working group and to organize the administrative coordination through the portfolio holders' consultation Space and Housing. You as a college are asked whether you agree with the proposal.

The college decides to agree to send the elaborated response to the executive board of the MRE cooperation.

Advisory note agreements parking lot area development Great Forest

The Grote Bos is an area where much has already happened in recent years and much is going to happen. Since the summer of 2020 the students of Strabrecht College are taught in a new school building. The old school building was demolished at the end of 2021 and at the moment Anna is realizing the Heide building with 84 care homes. As a municipality, we are hard at work building housing on the site of the old school building. As part of the area vision, the parties involved have agreed to jointly realize the parking task (and the associated access). To do this, it is necessary to lay down a number of arrangements in agreements. These concern the realization of the parking spaces and the contribution, settlement and exchange of land. To be able to conclude these agreements, the present college decision is necessary.

The College decides:
1. To approve the letter of intent for the Grote Bos parking lot.
2. To agree to the exchange agreement with the supply of land near the Grote Bos parking lot.
3. Because of the motivation described under "legal consequences" decide to conclude the land transactions one-on-one with the parties.
4. Mandate Poho to make minor and textual changes to the agreements.

College proposal robust legal protection system

Society is becoming increasingly complex. At the same time, we as a government expect the resident to be more self-reliant and more knowledgeable about all kinds of schemes and facilities. Meanwhile, the group of vulnerable people who depend on these schemes and facilities is growing. They are often dependent on a minimal income and depend on various sources, each with their own rules and Requirements. Social counselors help these residents in an approachable way with information, support and targeted advice. Their work is part of broad social work, but also requires specialized socio-legal knowledge and skills. The Rijksoverheid also considers it important that people have nearby support to find their way and be able to obtain justice, for example when they get lost between implementing agencies. In order to enable municipalities to organize more robust legal protection for their residents, the Cabinet is making subsidies available for this purpose. This so-called POK subsidy 'Robust Legal Protection. system' we want to work to make social counselor work accessible to residents of Geldrop- Mierlo. The aim is to ensure that residents with socio-legal questions or problems in Geldrop- Mierlo can easily find help and get good support.

The College decides:
1. To agree to the deployment of social counselors so that residents with socio-legal questions or problems in Geldrop- Mierlo can easily find help and receive good support;
2. Agree in principle to withdraw POK funds Robust Legal Protection System of € 52,483 from the first budget line FCL 6080001 and to allocate it to FCL 6630018 'broad poverty reduction';
3. Agree with the intended uses of POK funds Robust Legal Protection system: * Subsidy to foundation LEV group a € 43.853,60,- in 2023 for social counsel work in Geldrop- Mierlo; * Of these funds € 8.629,40-,- in 2023 to be used for start-up pilot 'Financial Workshop' Geldrop- Mierlo for which a separate advice note will be submitted to the college;
4. To approve the attached council information letter;
5. To forward it to the council via the Municipal Clerk’s Office .

RIB Sports Hall De Kievit

During the 2023 budget discussion, D66 withdrew a motion with a commitment from the college that there would be a council information letter on why a relocation of De Kievit Sports Hall to the Strabrecht College grounds is not desirable.

College decision:
- To agree with the content of the council information letter.
- To forward the council information letter to the council.

Self-evaluation BRP and Travel Documents 2022

Every year, every municipality must perform a self-assessment as part of the implementation tasks of the BRP Act and the Passport Act. This is called the self-evaluation BRP and the self-evaluation Travel Documents.

The College decides:
1. To take note of the management reports final results BRP and Travel Documents.
2. To sign the Municipal extracts BRP and Travel Documents and send them to the National Office for Identity Data.

Advisory note B&W future perspective allotments de kleine dommel

The allotment complex of De Kleine Dommel in the Hulsterbroek in Geldrop lies within the contours of the Nature Network Brabant (NNB), as a result of which the allotments would actually have to be relocated before 2028 (the year in which the NNB should, in principle, be fully realized). The allotment association would like to remain at the current location, despite its location in the Brook Valley and the desire to raise the ground and stormwater levels within the NNB. A memorandum has been prepared to outline the ecological future prospects of the allotment complex. For this, advice was sought from the forest group Zuid Nederland, water board de Dommel and the Province, among others.

The college decides:
1. to take note of the memorandum ' Ecological future perspective allotment garden complex de kleine Dommel in Hulsterbroek / Geldrop';
2. to agree to keep the allotment garden complex de Kleine Dommel at its current location;
3. to submit an amendment request for a re-delineation of the Nature Network Brabant for this purpose to the Province of North Brabant.
