College proposal council information letter elections March 15, 2023

In this council information letter we inform the members of the City Council changes in the Elections Act and the organization of the elections on March 15, 2023.

The college decides to approve the attached council information letter and forward it to the city council.

Objection high rent grounds Bosrand

On July 1, 2022, the college received by email a notice of objection on behalf of association the First Geldrop Men's Club. The objection is directed against the college decision of June 13, 2022 (sent on June 22, 2022). In that decision the set rent for the terrain at the Bosrand, which is rented by the Eerste Geldropse Menclub for the purpose of practicing equestrian sports with an amount of € 1,529.20 (2010), including annual indexation, is maintained until a new accommodation policy gives cause to revise this rent. The Advisory Committee on Objections has been asked to issue an opinion, how to deal with this objection. In this advice note, the college is informed of the advice and asked to adopt the committee's advice.

The college decides to adopt the opinion of the Advisory Committee on Objections and declare the objection of the First Geldrop Men's Club inadmissible.

Mandate Register 2023 Geldrop-Mierlo

On February 15, 2022, the Mandate Regulations and the associated Mandate Register were adopted. In doing so, it was agreed that the mandates will be reviewed annually and adjusted as necessary. The purpose of the periodic adjustment is to keep the register current and legally correct and to grant mandates that make the best possible business.

The College decides:
1. To adopt the Mandate Register 2023 Geldrop-Mierlo.
2. To revoke the Mandate Register 2022 Geldrop-Mierlo established on February 15, 2022.

Planning P&C cycle 2023

Presented is the approach and planning of documents from the P&C cycle. By means of a council information letter we also want to inform the council about this.

The College decides to approve sending the attached council information letter to the City Council through the Municipal Clerk’s Office.

Advisory note on withdrawal of educational use Strabrecht College

With the commissioning of the new building of Strabrecht College, the educational destination for the old location has lapsed. As a logical consequence, the municipality becomes the legal and economic owner of the land again. This is done by withdrawing the parcel in question from its educational destination. This proposal provides for this.

The College decides:
1. To approve the proposed withdrawal from the educational purpose.
2. To register the attached statement with the Land Registry.

Advisory note on protocol and regulations administrative approach to undermining crime

We want to ensure that our residents and entrepreneurs can rely on us to protect their privacy and comply with the rules laid down by law. In order to arrive at a responsible way of exchanging information between departments, careful consideration of interests and decision-making by those responsible in the administration and civil service are required. The purpose of the privacy protocol is to provide the board and official organization with a framework for weighing up the sometimes conflicting interests and making decisions about this, in which there is a careful weighing up of interests regarding which data are shared and recorded at which stage of the process.

The College decides:
1. To adopt the 'privacy protocol and explanation data sharing administrative approach undermining crime Geldrop-Mierlo 2023'.
2. To inform the council by means of the attached council information letter.

Advisory note on redevelopment of Duck Pool 4

Earthmoving company Harm van der Ham wants to settle at Eendenpoel 4 in Mierlo. This former agricultural business location (vab) is currently for sale. The establishment of an earth-moving company conflicts with the current zoning plan. Your college is therefore asked to take a position (in principle) on this matter.

The college decides to cooperate in principle with the establishment of an earthmoving company at Eendenpoel 4 in Mierlo, provided that:
a. The company plot is limited to a maximum of 5,000 m² and a maximum of 850 m² of company buildings is allowed.
b. Outdoor storage is limited to a maximum of 500 m².
c. An appropriate contribution will be made to quality improvement of the landscape.

Council information letter sports park Oudven

A motion was passed on sports park Oudvensestraat and the Alderman agreed to return to it in the month of February.

The College decides:
1. To agree to the council information letter.
2. To forward it to the council.

Advisory note Option/development agreement Genoenhuizerweg 6

In 2019, the municipality of Geldrop-Mierlo acquired the plot at Genoenhuizerweg 6 in Geldrop and an option/development agreement was signed with Vastgoedregisseur B.V. In October, your college approved the urban design for the site. Following these decisions and in order to develop the site for housing, a new agreement with Vastgoedregisseur is required and the zoning plan needs to be revised.

The College decides:
1. To approve the attached option/development agreement for the Genoenhuizerweg 6 project.
2. To initiate the zoning procedure for the Genoenhuizerweg 6 project.

Advisory note Building Service Dommelvallei

On February 9, 2023, a plan was presented during the Intake Table by the initiator for Dorpsstraat 210 (Dommelvallei Service Building). Through this advisory note, feedback is given to the Board of B&W, given the current political dynamics surrounding the Dommelvallei Service Building. And we explain the follow-up.

The College decides:
1. To take note, that in response to the building becoming vacant no later than December 31, 2024, a plan was presented at the intake table regarding Dorpsstraat 210.
2. To use the given presentation as input for the Area Program Center Mierlo to be elaborated.

Board proposal Art 36 questions by VVD and PvdA on Dommelvallei Service

Follow-up questions were asked by VVD and PvdA about the decision to relocate the Dommelvallei Service and redevelop the site. Attached is the response.

The college decides to approve the answers to the art 36 questions on the housing of the Dommelvallei Service and forward them to the council.

Board proposal Art 36 follow-up questions SAMEN on waste calendar

In response to SAMEN's earlier response to questions about the waste calendar, follow-up questions were raised by this group. The response was prepared in consultation with Cure.

The college decides to agree to the response and distribute it through the Municipal Clerk’s Office Office.

Board proposal Art 36 questions PvdA progress implementation assignment future Hofdael

On Feb. 2, 2023, the council president received questions from PvdA regarding the progress of implementing the mandates of the council proposal for the future of Hofdael. This proposal answers those questions.

The college decides to approve the answers to the submitted Section 36 questions and offer them to the proposer through the Municipal Clerk’s Office .

Advisory note rental agreement Korein BV

With retroactive effect, a new rental agreement is concluded for the premises at Deelenstraat 1 in Geldrop. The current rental agreement will be terminated after signing the new rental agreement.

The college decides to approve the lease agreement with Korein B.V. for the location Deelenstraat 1 in Geldrop with an effective date of January 1, 2018.

Advisory note request Silfo for two new gymnasiums in Great Forest area development

The Great Forest is an area where much has already happened in recent years and much is going to happen. Since the summer of 2020, the students of the Strabrecht College classes in a new school building. The old school building will be demolished at the end of 2021, and right now Anna is constructing the Heath building with 84 care homes. As a municipality, we are hard at work building housing on the site of the old school building. In order to take the next step in these developments, it is necessary to withdraw the land no longer used by the school from its educational use. An advisory note for this is also in this meeting cycle. In addition, the financial settlement of the new building has yet to take place. Thus, the business case for the new building Strabrecht College completed. In parallel, a new request from the Strabrecht College in which they want to build two new gymnasiums, instead of renovating the current ones. This as part of a total area development, which also includes housing. With this proposal you are asked to adopt a positive attitude towards this development.

The college decides to cooperate with Silfo's request for two new gymnasiums for Strabrecht College with a positive basic attitude.

Advisory note on temporary rental space

Potje Knor childcare has asked if they may make temporary use of the spaces in the building at Beneden Beekloop 92 in Geldrop until the completion of the temporary housing. The temporary use must be laid down in a fixed-term rental agreement.

The college decides to approve the temporary lease agreement with Kinderopvang Potje Knor B.V. for the location Beneden Beekloop 92 in Geldrop with an effective date of March 1, 2023.

Advisory note WOO request green spaces

On June 9, 2022, a request was made under the Open Government Act (hereinafter "Woo") requesting that documents related to the policy on the sale of green spaces/shredded green spaces and the municipality's decision-making in this regard be made public. Following the advice of the Objections Committee (hereinafter 'the Committee'), this memorandum indicates which documents are and are not disclosed under the Woo.

The College decides:
1. To agree with the committee's advice regarding the sharing of documents in which personal data, cadastral data and addresses have been anonymized and information is disclosed only if no ground for refusal applies.
2. To agree with the committee's advice to concretize the search.
3. To deviate from the committee's advice under Article 5.2 subsections 2 and 3 Woo with regard to the disclosure of draft policies and documents of external consultants.
4. Not to share again documents that have already been made public.
5. To agree with the decision on objection.
