Advisory note on application for grant LEV group integration 2024

LEV Group receives an annual subsidy for its work in the field of integration. This advisory note explains a proposed grant award. Since the change of the mandate regulation in 2021, the college has to approve grants to eight professional organizations, including LEVgroep. LEVgroep provides social guidance and social participation in the Self-Reliance Route in the manner prescribed in the Integration Act 2021.

The College decides To agree to provide an annual grant of € 295,261 to LEVgroep for Integration 2024.

Advisory note Renewing DVO Living Allowance Senzer 2024

In August 2022, the seven municipalities in the labor market region agreed with Senzer that Senzer will take care of the living allowance of Ukrainians who are hosted in our region. The DVO -after renewal in January 2023- has a term until March 4, 2024. The Reception of Displaced Persons Ukraine scheme has been extended until March 4, 2025. The provision by Senzer is appreciated by the seven municipalities. By extending through an addendum no later than March 4, 2024, there is no need to draft an entirely new DVO.

The college decides:
1. To agree to the addendum to the service agreement (DVO) "Arrangement for the reception of displaced persons Ukraine", which mainly deals with the extension of the DVO with Senzer until March 4, 2025;
2. To agree to pay for this from the state reimbursement received by the municipality for displaced persons in municipal and private shelters.

Advisory note Adjustments district division Geldrop-Mierlo

Both the college and CBS indicate that the classification of our neighborhoods and districts could be better. The current classification dates from October 2010. In recent months, a citywide working group has been working on adjustments to the current neighborhood classification. The adjustments came about on the basis of a matrix of considerations drawn up at the beginning of the process. In creating the new division, it was taken into account that in principle no new adjustments will be necessary for the next 15 years.

The college decides:
1. To adjust the current district division according to the attached new district division. This includes:
a. To divide Mierlo into 4 smaller districts namely: Neerakkers, Kerkakkers, Luchen and Mierlo-Dorp.
b. To designate a number of areas as outlying areas:
- Gijzenrooi;
- Area around the 4 new Mierlo neighborhoods;
- Corner left at the top of Zesgehuchten, between the Eindhovenseweg and the Rielseheideweg;
- Area to the right of the Coevering.
c. Make two minor adjustments in Geldrop.
2. To inform the council about the adjusted district division with a council information letter.
3. To agree to the costs and charge them to the neighborhood development plans.

Advisory note on penalty payment for failure to make timely decision on objection

On August 22, 2022, the college issued a (collective) traffic order to reserve parking spaces for electric vehicle charging. A revocation decision was made for three locations to accommodate objections from interested parties. As a result of this revocation decision, the objections received were decided too late. All objectors were immediately informed of the withdrawal decision. Subsequently, a letter was sent requesting the withdrawal of the submitted objection, as the college had met all objections with the decision. The objections were withdrawn, however, one objector sent an interim notice of default to the municipality. Due to the untimely decision on the objection, we owe the full penalty to the complainant. The college has yet to make a formal decision on the untimely decision on the objection. This advisory note deals with the decision to be made on this notice of default.

The College decides to decide that the petitioner of the objection received on September 5, 2022 is entitled to a penalty payment in the amount of € 1,442 for not deciding on the objection in time and to this end to agree to the attached draft decision.

College Proposal RIB Help to Measure

The attached council information letter provides an update on activities and developments around Help to Measure in the first quarter of 2024 (action item Ibabs 6167). It also includes an update on the municipal income statement, the child care allowance recovery operation and a look ahead to the second quarter. The 2023 energy allowance fact sheet shows a numerical intermediate position on the number of ex officio awards and individual applications through January 2024. An intermediate position because the application period of this scheme runs until April 1, 2024. The attached memo concerns the municipal income statement and reflects the original goal, process completed and current result. The money paper (draft) attached gives your college a preview in which we would like to take you. The money paper will be distributed door-to-door in Geldrop-Mierlo in the week of March 4.

The college decides to approve:
1. Council information letter Help to measure quarter 1 2024, and to forward it to the council via the Municipal Clerk’s Office ;
2. Fact sheet interim energy allowance 2023, and to forward it to the council via the Municipal Clerk’s Office .
and to take note of:

Advisory note National rates Certified Institutions

Youth protection is under pressure nationwide due to a faltering system within the Certified Institutions (GIs), increasing family problems, changing views on youth protection and an increasing workload. GIs are experiencing absenteeism, staff turnover and recruitment problems. To alleviate workloads, adequate staffing and appropriate funding are crucial. To address these challenges, the five youth care regions of Brabant have strengthened cooperation between each other and with the GI's. At the national level, the national government, the VNG and GI's have reached agreement on exploring and establishing a national tariff for GI's. Commissioned by the Ministry of Justice and Security (J&V), KPMG conducted research into the average costing and forms of funding for the GI's. With the results of the studies, administrative agreements and a corresponding guideline were reached on a national tariff from January 1, 2024 (see Appendices 5a and 5b). After a lengthy process, the agreements on a national tariff for the GIs as of 2024 have been a fact since October 18. In Southeast Brabant, Jeugdbescherming Brabant (JBB), William Schrikker Groep Jeugdbescherming & Jeugdreclassering (WSG), Leger des Heils Jeugdbescherming & -Reclassering (LdH) and Jeugd Veilig Verder (JVV) operate. This proposal presents to your college the agreements on the national tariff with the aforementioned GIs.

The college decides:
1. To set the tariffs for the Certified Institutions as of January 1, 2024 as follows:
a. Jeugdbescherming Brabant: the national base tariff increased with a generic surcharge of 3% for the availability function and innovation and a surcharge for special pupil costs of €363,53 for Supervision (OTS) and Guardianship (VO), without walk-in path.
b. William Schrikker Jeugdbescherming & Jeugdreclassering: the national base rate increased with a generic surcharge of 2% for the purpose of buffer capacity and a surcharge for special pupil costs of €442,- for OTS and VO with a walk-in period of 1 year.
c. Leger des Heils Jeugdbescherming & Jeugdreclassering: the national base rate increased with a generic surcharge of 2% for the purpose of buffer capacity and a surcharge for special pupil costs of €363,53 for OTS and VO without walk-in path.
d. Jeugdbescherming Regio Amsterdam, operating under the trade name Jeugd Veilig: the national base rate increased with a surcharge for special pupil costs of €363,53 for OTS and VO, without walk-in path.
2. To agree to enter into the "Addendum to the Agreement for the Provision of Services for Youth Protection and Youth Rehabilitation between [GI] and the Municipality of Eindhoven (on behalf of the Southeast Brabant regional municipalities)" in accordance with decision point 1 for the four GI's for the establishment of tariffs 2024, which are an inseparable part of the current JB-JR agreements (appendices 2a through d).
3. To agree to enter into the "Supplementary Agreement Service Provision Youth Protection and Youth Rehabilitation between (name GI) and the Municipality of Eindhoven (on behalf of the regional municipalities of Southeast Brabant)" in response to new rate agreements 2024 supplementary to the Addendum d.d. n.t.b. drawn up and published in this context with the four GI's in accordance with the first decision point. (Annex 3a through d).
4. To request the Mayor to give power of attorney to the Mayor of the Municipality of Eindhoven with the right of assumption and substitution by a member of the College of Mayor and Aldermen of Eindhoven to sign the addenda and agreements mentioned in decision point 2 and 3. Those agreements and addenda are also binding on the Municipality of Geldrop-Mierlo.
5. To agree to inform the city council via the attached council information letter.

Advisory note rental property Fire Station

At the end of 2022, the municipality of Geldrop-Mierlo bought back the apartment right regarding the spaces within the property located at Bijenkorf 15 in Mierlo. This part of the property is used as a fire station by the Safety Region Brabant Zuid-Oost (hereinafter referred to as: VRBZO).

The college decides to approve the lease agreement with VRBZO for the location Bijenkorf 15 in Mierlo with an effective date of January 1, 2022.

Advice note opinions Wmo Advisory Council February 2024

Over the past period, the Wmo Advisory Council has sent three requested opinions and one unsolicited opinion to the college. This advice proposes a response to these (un)requested advices. The advices concern: policy choices inclusive living, the flag protocol, implementation program living and Health and the mobility scooter policy. In accordance with agreements with the Wmo-Adviesraad, a copy of the response letters from the college also goes to the City Council. A Council Information Letter has been prepared for this purpose.

The college decides to approve:
1. The response to the requested advice from the Wmo Advisory Council, CPM and Seniors Interests regarding the Inclusive Living policy choices and the flag protocol;
2. The response to the requested advice from the Wmo Advisory Council regarding the Housing and Health implementation program;
3. The response to the Wmo Advisory Council's unsolicited advice regarding the mobility scooter policy;
4. The council information letter informing the City Council of the three responses to the unsolicited advice.
