Advisory note decision on request for compensation for planning damage

On December 1, 2021, we received a request for planning compensation.
This opinion addresses the decision on this request.

The College decides:
1. To declare the request for relief from planning damage manifestly unfounded.

2. To grant the request for an award of €1442 for default.

3. On account of the appeal lodged with the court, pay the costs associated with this appeal.

4. To approve the letter to Mr. Bax.

Board proposal Questions CDA on waste paper collection

The CDA group has asked questions about collecting waste paper. Up until now this has been done in Mierlo in particular with the help of volunteers from associations. The board of Cure has decided that this method of working must be terminated as of January 1. An alternative will be offered to the associations whereby they will be given the opportunity to collect textile in order to generate income for the association.

The College decides to approve the attached draft responses and send them through the Municipal Clerk’s Office .

Advisory Note The Stayy

On May 23, your college decided to grant cooperation in principle to the housing initiative at Bogardeind 219 (The Stayy). Following this, the initiator has started elaborating his plan and drafting the zoning plan and the municipality is working on an anterior agreement. Through this proposal we inform you of the progress. The initiator also requests to deviate from existing (policy) frameworks on a number of points. Your college is asked to clarify this.

The College decides:
1. To take note of the status of the zoning procedure for Bogardeind 219. \

2. Not to discount the number of parking spaces for the sake of more green space or based on partial mobility.

3. Determine parking requirements for the existing 142 flex studios based on experience figures and parking counts.

4. Agree to the proposed housing program and deviate from the target group ordinance for this purpose under Requirements .

5. To make anterior agreements on land acquisition for future widening of A67.

6. To stipulate anteriorly that any future (additional) costs for acoustic measures will be recovered from the initiator.

7. To agree to deferred payment of fund contributions.

Council information letter in the context of the Scheme of Specific Allowance for Sport and Exercise, Health Promotion, Cultural Participation and the Social Base 2023-2026

On September 12, 2023, the council took note of the Plan of Action under the "Scheme of Specific Allowance for Sport and Exercise, Health Promotion, Cultural Participation and the Social Base 2023-2026." Part of this was the commitment to send a council information letter to keep the council updated and informed about the process followed in applying for this scheme.

The college decides to approve:

1. The council information letter under the "Scheme of specific payment for sport and exercise, health promotion, cultural participation and the social base 2023-2026";

2. Forwarding this council information letter to the council.

implementation of these assignments and we will indicate what you can expect in the near future. Your council has formulated assignments to achieve a

In this council information letter we inform your council about the progress of the
following assignments:

1. A new and clear organizational structure;
2. Trial period for operation of the hospitality industry by Hofdael Foundation;
3. Simplification of financial flows.

College decides to take note of council information letter and forward to council.

On Aug. 24, Miranda Verdouw, on behalf of SAMEN, submitted written questions (article 36) regarding the state of affairs regarding allowances.
In the enclosed answer we inform them about this.

The college decides to approve the attached response and forward it to SAMEN through the Municipal Clerk’s Office Office.

Article 36 questions difference fairs in municipality

The fair is organized by NvdK Events and together with them the questions have been answered as the CDA asked them.
As an organization, NvdK Events has the freedom to organize the event within the framework of an event permit.
Through this answering we try to make this clear to the council.

The college decides to agree to answer the Article 36 questions.
