Advisory note PDO LOD cooperation 2

An order for incremental penalty payments was imposed on the person in question for use contrary to the planning regulations. During inspections of compliance with this order, the supervisor requested the submission of business information and documents (as referred to in 5:17 of the General Administrative Law Act). The party in question did not wish to cooperate with the supervisor's request. In order to force cooperation, a separate order under penalty was imposed. Since this order did not result in cooperation either, the contested decision imposed a second order subject to a penalty in order to induce the party concerned to cooperate. An objection was lodged against this order. On the basis of this advice note, a decision will be made on this matter.

The College decides to declare the objection admissible and uphold the contested decision with the addition of the reasoning in the draft decision on objection.

Regulations Civil Status Municipality of Geldrop-Mierlo 2025

The current regulations from 2019 are no longer in line with current legislation. Previously a (special) registrar was appointed by the College of B&W, as of 01-01-2020 the Normalization of Legal Status of Civil Servants Act (WNRA) came into effect. This means that babes are now appointed and there is an employment contract with the babes. This was not yet taken into account in the 2019 regulations.

The college decides to adopt the new Geldrop-Mierlo 2025 civil registry regulations.

Advisory Note Custom Water Storage Luchen 3A

The 'Regulation Water Storage 2023' sets an obligation for water storage in new construction. In the first instance this also applies to the 'Uitwerkingsplan Luchen subarea 3a'. During the development of the area the public storage is designed to meet the storage requirements set by the Municipality and the Water Board. As a result, it is not necessary to realize individual storage on one's own property. An exemption from the requirement will be granted for the parcels in this subarea with a custom stipulation.

The college decides to adopt the customized water storage regulation Luchen 3a.

Board Proposal Review Subsidy 2024 Foundation Estate Castle Geldrop

An error has been found in the calculation of the subsidy for 2024 to Stichting Landgoed Kasteel Geldrop. Due to a double indexation of 5.9%, the granted grant amount of € 295,153.00 is incorrect and should be adjusted to € 289,546.00. In addition, the disbursement date in the decision regarding the renovation of the children's farm should be corrected, as it has already expired.
By means of this advisory note, the college is asked to approve the revision of the 2024 grant award decision. The final decision is attached

The College decides to agree to amend the 2024 General Grant Award Decision to Castle Estate Foundation.

Evaluation Terrace Coverings

Part of the local corona support package was to temporarily allow the expansion of terraces and temporary facilities such as canopies at catering establishments. Due to limited capacity, no policy on terraces has yet been drafted. Entrepreneurs are again asking for clarity regarding the tolerance situation of terrace canopies. The purpose of this memorandum is to provide clarity to entrepreneurs.

The College decides:
1. To extend the current agreements around terrace covers and terrace extensions until April 1, 2027;
2. To present the terrace policy to the Council in 2025, including a transitional arrangement if the policy deviates from the current agreements.

Advisory note PDO unfounded Kievitstraat 48

Objection and notice of default regarding the granting of an environmental permit to build a dwelling at 48 Kievitstraat.

The College decides:
1. To declare the objection admissible.
2. To declare the objection unfounded.
3. Reject the request for procedural costs.
4. To reject the appeal to the Penalty Payment Act.
5. Inform objectors that this decision is subject to appeal to the court.
