Advisory note Backstop agreement WSW

As of August 1, 2021, a new improved backstop agreement has already taken effect. All backstop agreements concluded between WSW and the municipality before August 1, 2021, continued to exist alongside the 2021 backstop agreement. WSW and the Association of Netherlands Municipalities ("VNG") jointly concluded that it is, however, not desirable to have different backstop agreements coexisting. Therefore, WSW and VNG are now introducing a new backstop agreement between WSW and the municipality to replace all previous backstop agreements, so that only one set of Requirements with the municipality still applies.

This agreement serves as a safety net for housing associations in the Netherlands. It provides financial support in case a housing corporation cannot meet its financial obligations. Despite its existence, this backstop agreement has never had to actually intervene.

The college decides:
1. To agree to enter into a new backstop agreement, as listed in Appendix 2, between the municipality and the WSW, effective May 1, 2024, whereby:
a. The new backstop agreement replaces all previous agreements;
b. The new agreement contains improvements over the pre-Aug. 1, 2021 agreement;
c. A limited number of additional changes have been made from the agreement in effect as of Aug. 1, 2021;
d. There are no changes to the rear risk allocation key.
2. To agree to send a validly signed backstop agreement to the WSW.

Advisory note_adopting amended GR MRE

The general board of the MRE released the amended common regulation MRE on February 28, 2024 for approval by the councils and colleges. It is proposed to the college to approve the amended regulation and also to propose to the council to approve the amended regulation.

The college decides:
1. Subject to the council's approval, to agree to the establishment of the amended Joint Arrangement Metropoolregio Eindhoven, in accordance with the attached draft arrangement;
2. In anticipation of the entry into force of the Joint Arrangement Metropoolregio Eindhoven, to take note of the proposed amendments to the Statute for Consultative Bodies Metropoolregio Eindhoven;
3. To submit the council proposal 'Instemmen met gewijzigde gemeenschappelijke regeling MRE' to the municipal council for decision-making.

Advisory note Mandate register 2024

On February 15, 2022, the Mandate Regulations and the associated Mandate Register were adopted. In doing so, it was agreed that the mandates will be reviewed annually and adjusted as necessary. The purpose of the periodic adjustment is to keep the register current and legally correct and to grant mandates that make the best possible business.

The college decides:
1. To adopt the Mandate Register 2024 Geldrop-Mierlo
2. To revoke the Mandate Register 2022 Geldrop-Mierlo established on February 28, 2023.

Cooperation Agreement Urgency SGE 2024-2027

On December 11, 2023, the Housing Ordinance Municipality of Geldrop-Mierlo 2024-2027 was readopted by the City Council. Through this Cooperation Agreement Implementation Urgency 2024-2027 (hereinafter Cooperation Agreement) municipalities and housing corporations make agreements on the implementation of the urgency regulation in the Housing Ordinance. The content of this Cooperation Agreement has not been changed from its predecessor, as the content of the Housing Ordinance has not been changed either.

The college decides:
1. To approve the Cooperation Agreement Implementation Urgency SGE 2024-2027;
2. Authorize Alderman G.J.G. van Gestel to sign the Cooperation Agreement Implementation Urgency 2024-2027 on behalf of the municipality.

Mandate regulation Omgevingswet gemeente Geldrop-Mierlo 2024

The Mandate Regulation Omgevingswet Geldrop-Mierlo 2024 (further regulation) indicates which powers the college of mayor and aldermen (hereinafter: the college) and the mayor have given to the municipal organization. This regulation meets the needs within the current organizational structure where ownership is the starting point, an employee has the responsibilities and freedoms belonging to his position within the limits of the agreements we make or have made as an organization about this.

The college decides:
1. To adopt the Mandate Regulation Omgevingswet Geldrop-Mierlo 2024;
2. To revoke the mandate decision applying extensive procedure dated January 16, 2024.

College proposal Structural deployment of Children's Mayor

As a municipality, we want to connect with and actively involve our youth.
After the success of Annalot van Neerven as our first children's mayor, continuation of this initiative is a logical next step.

The college decides to agree to structurally appoint a children's mayor in Geldrop-Mierlo who will be re-elected each school year.

Advisory note signing agreement of intent for OER

On December 8, 2022, the coalition Klimaatcorridor A67 was established. The municipality of Geldrop-Mierlo participates in this. At the same time, the State started the program Opwek Energie op Rijksvastgoed (OER). The program is a cooperation between Rijkswaterstaat (RWS), the Rijksdienst voor Ondernemend Nederland and the Rijksvastgoedbedrijf, commissioned by the Ministry of Economic Affairs and Klimaat, with the aim of exploring where and how large-scale energy can be generated on government land with the support of the environment. In 2023, the EER study started on the A67 between Deurne and Bladel. We are now at the stage of submitting a letter of intent for this route for signature

The college decides:
1. To participate in the exploration phase of OER (Opwek Energie op Rijksvastgoed) as a non-core team municipality;
2. To agree with the declaration of intent OER (Opwek Energie op Rijksvastgoed) as part of the Climate Corridor A67;
3. To this end, to authorize Alderman Frans Stravers to sign it on behalf of the municipality of Geldrop-Mierlo.

Advisory note on adoption of GR ODZOB 2024

On August 8, 2023, your college approved the Draft GR ODZOB 2024 and forwarded it to your council for an opinion procedure. In the council meeting of 25 September 2023, the council decided not to submit views on the Draft GR ODZOB 2024. Some other participants did submit views. This led to changes in the final regulation compared to the draft regulation.
The General Board of ODZOB submitted the new GR ODZOB 2024 to you on March 13, 2024, with the request to make a proposed decision to adopt the new GR ODZOB 2024, subject to council approval. The council can refuse consent only on grounds of conflict with the law or public interest.

The college decides:
1. To approve the new GR ODZOB 2024 subject to council approval.
2. To agree to the attached council proposal, with the following decision points
a. To take note of the new GR ODZOB 2024.
b. To authorize the adoption of the new GR ODZOB 2024 by the college.
3. To forward the council proposal to your council.

Board proposal objection replacement bridge Geldropseweg

The Municipality of Helmond plans to replace the bridge at Geldropseweg over the Eindhoven canal. The preliminary planning for this work assumes start of work at the end of May and completion before the end of this year. The closure of this important connection between Helmond and Mierlo has a major impact on traffic flows both locally and regionally. Also, such a long closure affects the local middle class in Mierlo. The Municipality of Helmond has issued a traffic decree to regulate the "temporary" closure of the Geldropseweg. We have been in discussions with the Municipality of Helmond for quite some time in order to arrive at additional measures desired by the Municipality of Geldrop-Mierlo. The traffic decision gives us the opportunity, by means of filing an objection, to legally still manage to limit the execution time of the works and to take the desired additional traffic measures.

The college decides:
1. To approve the draft pro-forma objection addressed to the Municipality of Helmond against the traffic decision for the replacement of the bridge Geldropseweg.
2. To agree to file a notice of objection with the Municipality of Helmond if no agreement is reached in the administrative meeting with the Municipality of Helmond on March 28.

College proposal Cooperation agreement opening up Emopad Tilborghs Betonstaal B.V.

Tilborghs Betonstaal B.V. (Industriepark 9) wants an additional access to the company on Emopad. This is in violation of our policy rules for exits. Policy rules may only be deviated from in special cases. A Cooperation Agreement has been drawn up. This contains the Requirements under which the policy rules may be deviated from in this case.

The college decides:
1. To conclude the attached Cooperation Agreement on the access of Tilborghs BV on Emopad with the parties involved, subject to their signature;
2. To give the portfolio holder a text mandate to amend this agreement;
3. To revoke the "opportunity intended for the immediate loading and unloading of goods" (with sign E7) near Emopad 5.
