Advisory note view multi-year service plan Senzer

The Municipality of Geldrop-Mierlo - like the other colleges participating in the GR Senzer - has delegated its tasks relating to the Participation Act to Senzer as of 01-01-2023. A new part of the updated joint arrangement is article 3 paragraph 3:

"The public body shall pool resources and manpower for the effective and efficient performance of the tasks transferred to it. It does so on the basis of a joint, coherent and regionally harmonized task assignment from and for the participating municipalities and incorporates this task assignment in a multi-year plan. This task assignment is based on the solidarity principle and enables the public body to organize its executive and policy-preparing tasks as well as its expertise role in a businesslike, professional and cost-efficient manner."

The present proposal oversees Senzer's multi-year plan and gives the municipal councils the opportunity to express their views on it.

The College decides:
1. To approve the view on the Multiannual Service Plan 2025-2028 of the Joint Regulation (GR) Senzer.
2. To forward the Opinion to the City Council for adoption.

Cover page college proposal 2nd update APV 2023

On April 11, 2023, your college decided to propose to the council in November (instead of May) to adopt APV 2023 in accordance with the draft presented at that time. In addition, your college then decided to propose to the council to repeal APV 2022, last amended by council decision of June 7, 2022, from the date the APV 2023 takes effect. Decision number 1628806. The reason for advancing to November is that the Omgevingswet has already been incorporated into the draft APV and it does not take effect until 1-1-24. Because the council is busy with the budget in November, it became December instead of November. In the meantime, a few more minor changes were added to the APV at the request of colleagues. Also, the designation decisions were not ready at the time. These have now been added as an appendix. These changes are in addition to the changes submitted in April. Then it was about the processing of the Omgevingswet in the APV, the adjustment of the order of the articles and article names, in accordance with the VNG model, the addition of an article to enforce abandoned shopping carts, the explicit naming of the fair at events, trailers that may not be on the public road for longer than 24 hours and the adjustment of the dimensions of large vehicles. The college decides to propose to the council to approve the latest draft version of the APV, as found in the appendix, including related implementation and designation acts from the appendices.

Cover page college proposal Updating Regulation of Objection and Complaint Committee

Due to new developments, it is desirable to update the Regulation Complaints and Objections Committee 2023. It now conforms to the latest VNG model. And the new procedure regarding sound recordings and establishment of chambers has been implemented. Also, the reference to the regulations regarding travel expenses has been updated again (regulations referred to in current regulation no longer exist). Based on the new regulations, the travel allowance does decrease. The proposal is to increase the allowance per session night. Not only because of the decrease in travel expenses, but also because it has not been increased for years and we are on the low side compared to other municipalities.

The College decides:
1. To propose that the council adopt the Complaints and Objections Committee Ordinance 2023 in accordance with the draft offered.
2. To propose that the council repeal the Complaints and Objections Committee Ordinance 2018, adopted on July 2, 2018, from the date that the Complaints and Objections Committee Ordinance 2023 takes effect.
3. To agree to increase the fee per session night for both the chairperson and members of the committee.

Adoption of zoning plan Heiderschoor 2, Broekstraat 79-83 Mierlo

The pig farm at the location Heiderschoor 2, Broekstraat 79-83 in Mierlo was remediated in 2021 under the Pig Farm Remediation Subsidy Scheme (Srv). As a result, all agricultural farm buildings have been demolished and the environmental permit has been revoked. In order to provide the site with an appropriate rezoning, a zoning plan was prepared. The draft zoning plan was available for public inspection for 6 weeks starting July 28. No views were submitted.

The college decides to request the council to adopt the zoning plan "Heiderschoor 2, Broekstraat 79-83 Mierlo" with plan identification number NL.IMRO.1771.BPBroekstr79- VA01 unchanged.

Advisory note Budget amendment Cure 2023

We have received a budget amendment from Cure for the year 2023. For our municipality, the consequences are minimal. They are estimated at a positive difference of € 20,000.

The College decides to agree to the attached council proposal and submit it to the Space Committee and to the Council accordingly.

Council recommendation awarding Local Broadcasting license

Every five years is a new designation procedure for the license to the Local Broadcaster for the municipality of Geldrop-Mierlo. The new period starts from November 4, 2023. No later than December 22, 2023, the municipal council must issue a recommendation to the Media Authority, which has overall direction in this process. For the new designation for the license to the Local Broadcaster, concretely two parties have submitted a designation application. However, only one license can be granted. We hereby submit the recommendation of awarding the license to one of the 2 bidders to the council.

The college decides to agree to forward the council recommendation Local Broadcasting and Broadcasting Authorization 2024-2028.

Policy rules one-time energy surcharge 2023

The one-time energy surcharge 2023 (hereafter: energy surcharge) is intended to partially compensate low-income households for high energy prices. In addition to the energy surcharge, there are other purchasing power measures and compensation schemes. Energy consumption can vary greatly from household to household. In particular, low-income households living in poorly insulated homes can run into financial difficulties due to high energy bills. These and other low-income households can receive the energy allowance.

The college decides to approve:
1. Adoption of the policy rules one-time energy allowance Geldrop-Mierlo 2023. Make public in the manner described above;
2. On the basis of the policy rules once-only energy surcharge Geldrop-Mierlo 2023 and after approval Proposed decision by the council: mid-November to proceed to automatically pay the once-only energy surcharge 2023;
3. Open an application procedure (early December) for the group of entitled persons who do not receive automatic payment;
4. Cover a total of €1,691,407 for this purpose from the December Circular 2023;
5. To hereby adopt the 10th Budget Amendment 2023;
6. To adopt the council proposal containing the following decision points:
In anticipation of the Council Decision dated 11-12-2023 to proceed with the payment of the 2023 energy surcharge and to cover € 1,691,407 for this purpose from the December Circular 2023.
7. Adoption of the council memo Proposed Decision1;
8. To forward it to the council through the Municipal Clerk’s Office .

Advisory note 8 building lots Luchen

There is great demand for building plots in the municipality of Geldrop - Mierlo and also specifically in the Luchen district. In the various subareas of Luchen this need for building plots has been taken into account. The moment at which these building plots can be offered depends on various factors. For example, zoning plans must be established, infrastructure must be built and coordination must take place with construction work for project-based construction. These Requirements are now being met for 8 building lots in Luchen. Plot passports have been prepared describing for each plot the Requirements that must be met and the building possibilities. The proposal is to sell the lots on the basis of a tender procedure with a minimum sales price and allocate to the highest bidder. We want to build for our current and new residents. Therefore, we propose to establish a self-occupancy requirement for a period of 3 years and to be included in the purchase agreement in due course.

The College decides:
1. To approve the sale of the 8 building lots in Luchen, as shown on the lot map (Attachment 1);
2. To agree to the lot passports for the building lots in Luchen (Attachment 2);
3. To agree to the issuance procedure by registration with single bid and sale to the highest bidder (Attachment 3).
4. To agree to impose a self-occupancy obligation for a period of 3 years.

Advisory note One Counter Our Signpost

This year, the digital Our Signpost was launched: The Social Map of the Municipality of Geldrop-Mierlo. Following this, recent work has also been done to create a physical Onze Wegwijzer: The counter for all inhabitants with a broad support question. With this the municipality meets the line described within the theme program Health & Support in the strategy 2024-2027: "There is a uniform and recognizable counter where people can go for broad Health and support questions". The status of the establishment of this physical counter is described in a memo and a council information letter.

The College decides:
1. To take note of the memo "One Stop Shop: Our Signpost".
2. To agree to the council information letter "One Counter: Our Signpost" and to forward it to the council.

Advisory Note on Social Return

Social return is an instrument for municipalities in particular to achieve social objectives in tenders and when granting subsidies and permits. It often involves the creation of (extra) workplaces for the target group of the Participation Act and the Employment Agreement from the Social Agreement or other groups with a distance to the labor market. Regionally, since 2021, a project leader has been appointed on behalf of the regional portfolio holders of social affairs (Poho Soza) to focus on the (further) development of a regional uniform SROI policy and governance structure.

The College decides:
1. To adopt the policy framework SROI 2024-2027 Arbeidsmarktregio Helmond - de Peel.
2. To withdraw the policy framework Social Return labor market region Helmond-De Peel 2018.
3. To adopt the Governance proposal SROI Arbeidsmarktregio Helmond - de Peel.
4. To agree to cover Geldrop-Mierlo's share of the annual costs for the regional service desk SROI of €53,384 from the budget for SROI included in the budget as of 2024. This subject to the approval of the budget of Geldrop-Mierlo and subject to the agreement of the other municipalities in the labor market region to the present handling documents.
5. To agree to send the attached council information letter on October 26.

Advisory note 2nd interim report 2023

The 2nd Interim Report 2023 shows the development of budgets in the first 8 months of 2023. Overspends and underspends expected to differ from the budget at the end of the year are presented to the council. Once approved, the changes are made to the budgets.

The college decides to agree to the attached council proposal and present it to the council for decision.

Advisory note on Gladness Control Plan 2023/2024

From the region, with the municipality of Eindhoven as coordinator, reports are received for the execution of a gritting action.
Through this system, gritting vehicles go out on the road in all member municipalities, so that gritting is carried out simultaneously throughout the region.

The college decides to approve the 2023/2024 smoothness control plan so that the safety of road users can be ensured in case of slipperiness.
