Advisory note on reception of displaced persons Ukraine - surveillance security

The war in Ukraine continues and with it the municipal reception of displaced persons. At the locations Stationsstraat 33 in Geldrop and Goorsedijk 4a in Mierlo, supervision is required due to (fire) safety. Due to the longer duration of the reception and the associated costs, the rules of the procurement policy become applicable. For 2024, the comprehensive procurement strategy can still be determined. In spring 2024, BIZOB will start a procurement process for the period thereafter.

The College decides:
1. To adopt the Purchasing Strategy Supervision/Security Reception Sites Ukrainian Displaced Persons;
2. To commission BIZOB to supervise the procurement from 2025;
3. To inform the council via a Council Information Letter.

Advisory note on evaluation

Prior to the turn of the year, working agreements were made to limit the nuisance and damage around the turn of the year. After the turn of the year there was an evaluation of how the turn of the year went. The evaluation shows that the turn of the year was average in terms of incidents, damage and destruction. The total number of reports of fireworks (nuisance) was higher than at the previous turn of the year. The amount of damage caused by fireworks was higher than at the previous turn of the year. Notable incidents in our municipality around the turn of the year were the incident in which two police officers in our municipality became victims of violence against employees with a public duty and the 5 car fires that were probably not fireworks related.

The College decides:
1. To take note of the evaluation of the turn of the year 2023 - 2024 (Annex 1).
2. To acquaint council members with the evaluation via the attached council information letter (Appendix 2).
3. To answer questions/requests from the media and citizens regarding information around the turn of the year based on the evaluation.

Budget PlatOO 2024

School Board PlatOO, according to its bylaws, has submitted the 2024 budget to the municipality for consultation.
It is proposed that the college take note and agree.

The college decides to approve PlatOO's 2024 budget.

Board proposal article 36 questions SAMEN on updating annual performance agreements 2024

Responses to SAMEN's Article 36 questions on updating annual performance agreements 2024 are submitted to the college.

The College decides:
1. To approve the attached response to the article 36 questions posed by the SAMEN Group about updating the annual performance agreements 2024.
2. To forward the answers to the council.

Advisory note Subsidy scheme for disconnecting rainwater on private property 2024

In 2022 and 2023, residents could use a subsidy scheme for disconnecting stormwater.
To continue the scheme in 2024, the college must reauthorize the scheme.

The College decides:
1. To adopt the subsidy scheme "disconnecting rainwater on private property Geldrop-Mierlo 2024";
2. To adopt the attached grant application and grant determination forms for grant applications;
3. To mandate the Team Manager Realization to implement the "Subsidy Scheme for disconnecting rainwater on private property Geldrop-Mierlo 2024" in accordance with the attached concept;
4. To open the electronic way for applications under the 'Subsidy Scheme for disconnecting rainwater on private property Geldrop-Mierlo 2024';
5. To set a subsidy ceiling of € 50,000 for 2024, to be charged to fcl 67200012.

Adviesnota aanpassing GR VRBZO 2024 na zienswijze

As of July 1, 2022, the Joint Arrangements Act has been amended. This makes it necessary to amend the Joint Arrangement Security Region Brabant-Zuidoost (VRBZO). After the councils have been given the opportunity to present an opinion, VRBZO has tightened up some changes. The college is now being asked to approve the 2024 Joint Arrangement. The Joint Arrangements Act stipulates that colleges do not proceed to change an arrangement until after obtaining the consent of the municipal councils. The consent can only be withheld because of conflict with the law or the public interest.

The College decides:
1. To submit the council proposal to amend the Joint Regulations for the Safety Region Brabant-Zuidoost, containing the following decision points, to the council for decision-making: 

  1. To take note of the draft Joint Arrangement Veiligheidsregio Brabant-Zuidoost 2024 after views ;
  2. To authorize the college to adopt the amendment to the Joint Regulation Safety Region Brabant-Zuidoost 2024.

2. After obtaining the consent of the council to approve the Joint Arrangement Security Region Brabant-Zuidoost 2024 and to notify VRBZO of this by means of the attached concept letter.

Advisory note on licensing policy and implementation program 2024

In the Omgevingswet, its implementing decrees (Environment Decree with the so-called process criteria U&H documents)and the Provincial Ordinance Systematic Supervision Information North Brabant, requirements are laid down that every professional U&H organization(formerly: VTH organization)must meet. These requirements aim to ensure that provinces, municipalities and water boards set up their U&H organization in such a professional manner that a good quality of the execution of these tasks is guaranteed. By this the legislator means in particular that the U&H tasks are performed in a strategic and programmatic manner with attention to mutual coordination of the activities. With intergovernmental supervision, the province contributes to a resistant and safe Brabant with a strong quality of public administration. Timely and proper compliance with the process criteria U&H is not only legally required. It is also important for good management of the U&H policy cycle and for maintaining a professional U&H structure to prevent risks in the field of public health, safety or irreversible damage to the living environment.The ambition of the province, together with municipalities and water boards, is to ensure that all U&H documents are100% up to date and on time and meet the process criteria U&H.

The 'Licensing Policy and Implementation Program Geldrop-Mierlo 2024' to be adopted defines the manner in which the implementation of the aforementioned statutory tasks is carried out

The College decides:
1. To take note of the IBT supervisory assessment Environmental Law 2023.
2. To agree with the updated 'Permit Policy and Implementation Program Geldrop-Mierlo 2024'.
3. To inform the Province of North Brabant by means of the attached letter.
4. To inform the council by means of the attached council information letter about this.

Advisory note annual enforcement report 2023 and enforcement implementation program 2024

The annual report and the implementation program are part of the enforcement policy cycle. The annual report reflects on the results achieved on the basis of which the balance sheet can be drawn up. 

This balance sheet, together with the enforcement policy and the objectives agreement, forms the basis for the 2024 implementation program that outlines how supervision and enforcement will be implemented in the coming year with associated interventions and intended results.

The College decides:
1. To approve the Annual Enforcement Report 2023 and Enforcement Implementation Program 2024.
2. To inform the City Council by means of the attached council information letter.
3. To inform the province of North Brabant hereof.
4. To adopt the National Enforcement Strategy for Environmental Law (LHSO) as the sanction strategy within Environmental Law.

Council information letter Regional annual report compulsory education RMC school year 2021-2022

The regional annual report describes the activities and results of the deployment of compulsory education officers and RMC career counselors in the Southeast Brabant region in the 2021-2022 school year. On June 12, 2023, the annual report was adopted by the executive committee "combating school absenteeism and early school leaving" of the GGD Brabant-Zuidoost. This committee consists of all aldermen of education of the 21 municipalities in the region. 

For the annual compulsory education report for the 2022-2023 school year, we aim to inform earlier.

The College decides:
1. To take note of the regional annual report compulsory education/ RMC 2021-2022 Combating school absenteeism and early school leaving.
2. To inform the city council about the regional annual report and the state of affairs in Geldrop-Mierlo via the attached council information letter (Appendix 1).

Childcare Plus

There are children in Geldrop-Mierlo who, in order to develop optimally, need slightly different guidance/approach than is available within the regular childcare offer. It is important to offer our children, close to home, the Health and guidance they need. This proposal contributes to the municipality of Geldrop-Mierlo to ensure that children who need extra support, can receive this as much as possible, close to home and in an appropriate setting, so they can develop optimally.

The College decides:
1. To adopt the subsidy scheme appropriate child care: "child care plus" Municipality Geldrop-Mierlo 2024;
2. To set the surcharge per hour of day care plus and out-of-school care plus at € 14.79 and € 16.15 respectively;
3. To dispose of a subsidy for appropriate childcare in 2024 to Kluppluz, to provisionally set the subsidy amount for 2024 at € 111,296.31;
4. To fund the subsidy from the resources for educational disadvantage policy (OAB) (fcl 6430003: OAB/VVE).

Grant Determination Senzer 2023

The Ministry of Social Affairs and Employment has made resources available for the calendar year 2023 for a number of statutory regulations, the implementation of which has been delegated to Senzer by the municipality. It concerns the BUIG resources for benefits and wage subsidies, the Participation budget for the implementation of reintegration processes, among other things, and the Wsw resources for social employment. For 2023, the subsidy will be definitively determined through your decision on this advice note.

The College decides:
1. To agree to grant an additional subsidy of €1,048,750 over 2023 to work company Senzer for the provision of benefits to residents who are (temporarily) unable to support themselves or the provision of wage subsidies as referred to in the Participation Act;
2. To agree to provide an additional subsidy of €1,430 over 2023 to work company Senzer for the performance of BBZ viability tests;
3. To agree to recover €1,035,253 from work company Senzer for the Wsw as referred to in the Participation Act;
4. To notify the General Board of work company Senzer of the final subsidy by means of the attached decision.
