Advisory Note Annual Report on Licenses 2024 Geldrop-Mierlo and Annual Report on Enforcement 2024 Geldrop-Mierlo

The annual report on permits 2024 and the annual report on enforcement 2024 are part of the VTH policy cycle. It is a useful tool for reflecting on the results achieved, taking stock and making adjustments in the coming period based on these results. 

Through a cycle, the province annually monitors the quality of the municipality's performance of the statutory VTH tasks. It checks whether we are doing so well and, if necessary, indicates areas for improvement, with the aim of continuing to develop and optimize the quality of licensing, supervision and enforcement. By means of this advisory note, you are asked to approve the 2024 annual report on permits and the 2024 annual report on enforcement, so that these can then be shared with the province of North Brabant.

The college decides:
1. To adopt the 'Annual Report on Licenses 2024 Geldrop-Mierlo'.
2. To adopt the 'Annual Report on Enforcement 2024 Geldrop-Mierlo'.
3. To inform the City Council by means of the attached council information letter.
4. To send the annual reports to the province of North Brabant for information.

Advisory note Brabant Water 2025-2030 Agreement.

In 2014, a groundwater monitoring network, consisting of 49 measuring points (monitoring wells) with automatic measuring equipment, was installed in our municipality. This was done within the "Waterportaal Zuidoost Brabant," a partnership between 11 municipalities, Brabant Water and the Dommel Water Board. Since then, Brabant Water has carried out the operational management of the measurement network. Since the underlying agreement for this expires, we need to conclude a new agreement.

The college decides to approve the agreement with Brabant Water for the management of the groundwater monitoring network and managing the measurement data.

Advisory note amending decision environmental permit Overakker 16 Mierlo

An objection was filed by Heemkundekring Myerle against the environmental permit for a new home on the Overakker 16 property in Mierlo. When the permit was granted, a condition should have been added regarding the archaeological value of the land. Through an amendment decision, this condition can still be added to the permit. In this way the objection can be met.

The college decides:
1. To amend the environmental permit 17712283091, as granted on March 3, 2025, in accordance with the attached amending decision;
2. To determine that this decision will enter into force the day after its first publication;
3. To publicize this amending decision by sending a copy of it to the objector (Heemkundekring Myerle) and to the permit holder, and by publishing it in the digital Municipal Gazette (on 'overheid.nl').

Advisory note adopting model agreement Enexis

In recent months, Enexis and the MRE municipalities have Map the various options and Requirements to arrive at model agreements for the transfer of land for transformer stations. Two options have been worked out; sale and right of superficies. It is up to each municipality to express their preference. The MRE has requested that the choice be submitted for decision.

The college decides:
1. To express preference for sale of land for future transactions.
2. To agree to the MRE model purchase and sale agreement for the sale of land to Enexis for the realization of transformation station.
3. Adapt the model purchase and sale agreement per project to local municipal policy.

Board proposal additional credit redevelopment Bekelaar

The final design of the "Bekelaar redevelopment" was adopted by the college in 2022. The original planning was execution works in 2023. The replacement of the bridge over the Eindhoven canal by the municipality of Helmond has influenced the planning for the redesign of the Bekelaar. Both works could not be carried out simultaneously due to the accessibility of Mierlo. In the end, the bridge was not replaced until 2024. Work will begin, in accordance with specifications, on May 12, 2025 and the work will be completed on December 5, 2025. 

The budget includes a credit of €1,600,000 for the redevelopment. During the preparation of the estimate of the final specifications (March 2025), it was suspected that the work will cost more than the current available credit. Opening the tender documents revealed that the tenders did not deviate much from our estimate. As a result, it became clear that there is a deficit €325,000 to carry out the work.

The college decides to forward the council proposal to the council.

The college decides to agree to enter into the hunting lease agreement as per offered draft.
