The decision list of the public college meeting of September 13, 2022, is adopted as presented.

Motion to appeal

On August 18, 2022, the District Court of East Brabant, under case numbers SHE 22/1387 and SHE 22/1388, ruled on the appeal regarding a reconsideration sanction directed against room-to-room rental. In that ruling, the appeal was upheld and the reconsideration decision regarding this re-sanction was annulled. This ruling is incorrect because the District Court failed to recognize that roomwise rentals violate the Management Order. Therefore, the College is proposed to appeal the ruling to the Council of State.

College Decision:

  1. Appeal to the Council of State against the judgment of the District Court of East Brabant dated August 18, 2022 with case numbers SHE 22/1387 and SHE 22/1388.
  2. To agree to the attached (draft) notice of appeal.

Continued grant LEV Group Reception of Ukrainians

LEVgroep supports refugees from Ukraine, some of whom are accommodated in municipality shelters and some are staying with host families. It is now clear that the refugees will stay longer in the Netherlands. In order to continue providing the necessary support, LEV is applying for a subsidy.

College Decision:

  1. To agree to provide a one-time grant to LEVgroup for the reception of and support for Ukrainian refugees, as per proposal LEVgroup Guidance for the reception of Ukrainian refugees G-M;
  2. To cover the cost of this, namely an amount of € 77,613 from FCL 6650002/38103 (cost of receiving displaced persons Ukraine).

Advisory Note Views on Draft RVP.

The East Brabant Regional Safety Plan (hereafter RVP) is the joint plan of 32 municipalities, the Public Prosecutor's Office and the police to tackle (supra)local problems in the area of safety. The present draft RVP covers the period 2023 - 2026. In accordance with provisions in the Police Act, the municipal councils are given the opportunity to submit views prior to the adoption of the RVP. By means of a council information letter, the draft RVP is presented to the municipal council for the submission of views.

College Decision:

  1. To take note of the draft East Brabant Regional Safety Plan 2023-2026
  2. Agree to the attached council information letter offering the draft RVP East Brabant 2023-2026 and advising that no views should be submitted.

Advisory note memo questions to council Neighborhood development plans

A number of neighborhood plans have been prepared in recent years. After the elections last spring, an objectives agreement was drawn up. This includes the ambition to create a neighborhood plan for all neighborhoods in the coming council period. The form was left more free. Moreover, the agreement recognized that there are differences between neighborhoods and that this should be reflected in the approach. That is why we will take stock of the neighborhoods in the coming period. We also want to get a better picture of what the council intends and expects from a neighborhood (development) plan.

The college decides to approve the attached memo to council groups with questions about the purpose, content and form of a neighborhood (development) plan.
