College proposal adjustment policy rules Meedoenregeling

On November 14, 2023, your college adopted the policy rules Meedoenregeling Geldrop-Mierlo 2024. After adoption, the policy rules were published and took effect on January 1, 2024.

Unfortunately, it has recently been pointed out to us that the interpretation of Article 2, paragraph 1a leads to confusion and provides insufficient clarity. After consultation with the legal advisor, it was decided to advise your college to make a textual adjustment. This is a technical adjustment in favor of the resident.

Current text:
Article 2, paragraph 1a: has an income no higher than 120% of the net benefit standard applicable to him or her for single persons and family / cohabitants, or in the case of a single parent has an income no higher than 90% of the married couples standard.

Proposed textual amendment as of February 1, 2024:
Article 2, paragraph 1a: has an income no higher than 120% of the net benefit standard applicable to him or her where the benefit standard for a single parent is set at 90% of the married standard. 

Of course, the proposed change has also been made in the article-by-article notes.

The college decides:
1. To agree with textual adaptation of policy rules Meedoenregeling Geldrop- Mierlo 2024;
2. To publish the policy rules adopted by you in the prescribed manner.

Advisory note on designation of contact person for Open Government Act

On May 1, 2022, the Open Government Act (Woo) entered into force.
As of this date, governing bodies are also required under Article 4.7 of the Woo to designate one or more contact persons to answer questions about the availability of public information.

The college decides to designate the Open Government Act legal advisor as the contact person under the Woo.

Advisory note PDO Akert

On August 21, 2023, COA and St. Sint Anna Zorggroep were granted environmental permits for the temporary use (for a period of 3 years) of the Appelaar 35 building in Geldrop (formerly the Akert residential care center) for the housing of 54 unaccompanied minor asylum seekers and 56 students and coassistants, respectively.
A large number of objections were received against these decisions.
On the basis of this advice note, a decision will be made on these objections.

The Municipal Executive decides:
1. to declare the objections directed against the environmental permit granted on August 21, 2023 to St. Sint Anna Care Group with reference 17711766866 admissible, but unfounded in accordance with the advice of the Committee for Objections;
2. to declare the objections directed against the environmental permit granted on August 21, 2023 to Centraal Orgaan opvang Asielzoekers with reference 17711768147:
a. Declare the objections listed in Appendix I attached to the opinion of the Objections Committee inadmissible in accordance with the opinion of the Objections Committee;
b. Declare the remaining objections, in part contrary to the opinion of the Objections Committee admissible but unfounded with further explanations, additions, clarifications and tightening as included in the draft decision on objection.

Advisory note on decision on objections to environmental permit for padel courts TC De Helze

Three appeals were filed against an environmental permit for padel courts at tennis club De Helze. The Objections Committee recommends that two objections be declared inadmissible. The remaining objection does not constitute a reason to revoke the permit granted. The proposal is to adopt the advice of the Objections Committee when deciding on these objections.

The college decides:
1. To declare two objections inadmissible and a third objection admissible, in accordance with the advice of the Objections Committee;
2. To uphold the environmental permit granted for padel courts at tennis club De Helze, also in accordance with the advice of the Objections Committee;
3. To inform objectors of the possibility of appealing to the court and requesting a suspension from the preliminary relief judge;
4. To inform the tennis club of the decision taken;
5. To take up the tender and implementation.

Advisory note DO accessible bus stop Eindhovenseweg-Papenvoort

On December 5, 2023, the college decided in accordance with advice on the preliminary design and release for regular public participation of the above topic. The design for making the bus stops accessible has now gone through the regular public participation. Communication about this has taken place as expressed in the college proposal of 23-11-2023. No views were submitted on this. No objections were received against the logging permit, which is now irrevocable. We therefore recommend that the original design be adopted unchanged as the final design for the modification of the Eindhovenseweg/Papenvoort bus stops. The college decides to approve the final design dated 7-2-2024.

Labour Party questions on good landlord law

PvdA asked Art 36 questions about the Hotline on the Good Landlord Act.

The college decides:
1. To approve the attached response to the written questions of PvdA ;
2. To forward the response through the Municipal Clerk’s Office to the City Council.

Advisory note Meldpunt Good Landlord Act

On July 1, 2023, the Good Landlord Act went into effect. This law introduces a basic standard for good landlordship. Every landlord or housing corporation must comply with it. Under this law, the college must also establish a municipal hotline where complaints about undesirable rental behavior can be reported. This includes complaints from tenants, but also from house seekers and local residents. Every Dutch municipality must set up this hotline by January 1, 2024.

The college decides:
1. To agree with the establishment of the hotline Good Landlordship for the municipality of Geldrop-Mierlo whereby a report can be made via a digital report form on the municipal website;
2. To agree with the information letter by which the landlords and housing corporations known to the municipality are informed about the municipal hotline;
3. To agree with the contents of the attached council information letter and forward it to the council.

Agenda request Space Committee on Prioritizing (housing) initiatives

The housing task for our municipality for the period 2022-2030 is 1,465 housing units. The plan stock over this period is approximately 2,500 housing units. The new housing to be built is spread over more than 70 sites. The development of sites takes commitment of people and resources. To ensure that construction takes place and the pace of construction is maintained and that the right homes are built, it is necessary to make choices and prioritize. That prioritization is done as objectively as possible, using criteria. In the Space Committee we want to explain the system of prioritization and have a substantive discussion about the criteria.

The College decides To agree to the agenda request to the City Council to discuss the content and systematics of prioritization of (housing) initiatives.

Advisory note amending decision to repeal decision to grub up beech Beuk Mierlo

The Objections Committee, in dealing with an objection to a felling permit for 12 trees on the Beuk in Mierlo, made the suggestion to see if objections could be resolved through consultation. However, that led to another objection from another person. The Commission is now offering another opportunity for an amending decision that can be considered when advising on the objections.

The college decides:
1. To amend the felling permit dated April 11, 2023 for 12 trees on the Beuk in Mierlo (17711637395) and the official revocation decision thereof in accordance with the attached amending decision (ex art. 6:19 Awb);
2. To request the Objections Committee to issue an opinion on the objections, subject to this amending decision.

Advisory note Adopt Annual Report on Early Childhood Education

In Jan. 2024, we received the annual questionnaire from the Ministry of Education, Culture and Science.
The Inspectorate of Education asks municipalities to comment on the implementation of the legal tasks around educational disadvantages policy (annual reporting LEA & VVE).
Your Board must adopt this questionnaire.

The college decides to adopt the annual Educational Disadvantage Policy.

Social domain task force quarterly report Q4 2023

Every quarter the council is informed about the progress of the social domain task force. Attached is the quarterly report through Q4 2023 containing the preliminary 2023 figures.

The college decides:
1. To approve the content of the attached quarterly report on the social domain task force Q4 2023.
2. To forward it to the council by means of a RIB. If the council sees fit, it may decide to put it on the agenda for substantive discussion.
