Advisory Note Reducing Energy Burdens

From the state, municipalities received funds to address energy poverty in 2022. These funds are intended to help residents facing energy poverty reduce their energy bills and make their homes more sustainable. This paper proposes how these funds will be spent by the municipality of Geldrop-Mierlom through the project "Reducing Energy Burdens.

College Decision:

  1. Agree to the plan of action 'Reducing Energy Burdens'
  2. To agree to the attached council information letter
  3. To forward these to the council through the Municipal Clerk’s Office .

Advisory note Arts quarter activities in social domain

Stichting Kunstkwartier receives an annual grant from us for its work. For this, the municipality draws up an implementation agreement jointly with this partner. In the implementation agreement 2022 and 2023 (in draft) it is stated that the organization will/must move more in the social domain. The organization calls this 'social domain'.

College Decision:

  1. Agree to provide a one-time grant to Foundation Arts Quarter of € 19,214.50 to be charged to the Public Health Program (fcl/ecl 6710000/43600).
  2. To award the grant through the attached draft decision, subject to the condition that we subsidize on a participation basis.

College proposal Annual Sustainability Report 2022

In the past year a lot has happened in the field of sustainability. We would like to inform the council and our residents about this. We have therefore prepared the attached annual report. It contains an overview of the sustainability actions we carried out in 2022.

College Decision:

  1. Agree to the attached annual sustainability report
  2. To submit the attached Annual Sustainability Report to the council for information through the Municipal Clerk’s Office .

Advisory note on implementation note on tackling human trafficking

Municipalities play an important role in the comprehensive approach to human trafficking. At the national level, it has been agreed that by 2022 every municipality should have policies in place to address human trafficking. This is mainly about increasing resilience, recognizing signals and how to deal with them. In addition, care, support and aftercare must be provided for victims of human trafficking. The implementation memorandum on human trafficking indicates how national and (sub)regional cooperation in tackling human trafficking is taking place and how this will be further implemented at the local level. In particular, the Human Trafficking Officer has an important directing role.

The college decides to approve the implementation memorandum addressing human trafficking.

Council information letter Service Agreement Villagemarketing Foundation

On December 13, the College of B&W approved the new Villagemarketing Foundation Service Agreement (DVO). This DVO has now been concluded for 4 years in which the foundation has also prepared a policy plan for the period 2023-2026.

The college decides to approve the council information letter.

Advisory note on property management plan

The municipality of Geldrop-Mierlo is responsible for the management and maintenance of the municipal real estate. The real estate portfolio consists of over 75 objects with a gross floor area of approximately 70,070 GLA. This management plan shows how property management works with the resulting required financial resources. The amount that is annually added to the provision has not increased in recent years. The council has already determined that the annual allocation to the provision will be increased by € 400,000 per year as of 2023. As substantiated in the management plan, the required deposit into the provision is € 446,000 per year, bringing the annual total amount paid into the provision to € 1,320,000. And thus the provision will cover costs for the implementation of IMP for the next 10 years.

College Decision:

  1. To agree on social property management plan.
  2. To continue the maintenance level of municipal buildings in accordance with previously adopted council decision in February 2015 at the level 'reasonable', as defined in the Dutch standard NEN 2767.
  3. To agree to an additional allocation to the provision of €46,000, in addition to the annual allocation of €400,000 already established in the budget.

Art. 36 questions 2022.36.035 from SAMEN

The College of B&W recently extended the period of physical coronasteun in the form of terrace expansion and canopies at the hospitality industry until early 2024. Council party SAMEN asked questions (Art. 36) about these possibilities for the hospitality industry. Attached are the questions and answers.

The college decides to approve the answers to the questions.

College proposal unsolicited advice pupil transport

The Wmo Advisory Council can give the college solicited and unsolicited advice. The Wmo Advisory Council has issued an unsolicited advice regarding the regulation on funding pupil transport. The unsolicited advice concerns the description of the use of pick-up points. The response has been discussed with some members of the Wmo Advisory Council but in order to give a formal response we hereby submit the response to the college.

The college decides to approve:

  1. Taking note of the WMO Advisory Council's unsolicited opinion;
  2. the response to the unsolicited opinion.

College proposal reorientation and debt relief for business owners

Since June 1, 2021, there is a cooperation between the five Peel municipalities, Geldrop-Mierlo and Helmond for the implementation of Reorientation & Debt Assistance to entrepreneurs. This service is carried out by Senzer. The service in the field of debt assistance to entrepreneurs in dire straits sees to the provision of the various trajectories necessary for the reorganization and/or liquidation of the business of the independent entrepreneur with the aim of a financially healthy entrepreneur/resident of the region. This is based on the latest amendment to the Municipal Debt Relief Act (Wgs), which made debt relief for entrepreneurs a statutory task. Reorientation focuses on coaching, counseling, tutoring or retraining so that an entrepreneur can (again) provide for his or her own income.

College Decision:

  1. To agree to enter into the attached Service Agreement (DVO) Reorientation of & Debt Assistance to Independent Business Owners 2023-2025.
  2. To agree to the attached mandate decision granting Senzer the authority to perform the debt assistance task for the target group of self-employed entrepreneurs for the duration of the DVO.
  3. Agree to include €100,000.00 in the interim report for the purpose of implementation as articulated is decision point 1.

Advisory note on objections to house numbering near Burgemeester Pankenstraat

On October 12, 2021, the college decided to revoke the adoption of the street name "Mayor Berkhout Street." Following this, on December 21, 2021, the college decided to revoke the granting decision of July 27, 2021, and to withdraw the revocation decision of October 12, 2021, and decided to grant the street name "burgemeester Berkhouthof" with house numbers 1 through 4 for the benefit of four new residences in the extension of Burgemeester Pankenstraat in Mierlo. These decisions have been objected to by several local residents. This advice note deals with the decision to be taken on the objection.

The College decides:
1. In accordance with the advice of the Committee on Objections the objections:
a. Declare them admissible;
b. to declare the objection of November 23, 2021 directed against the decision of October 12, 2021 unfounded insofar as it concerns the lack of a conversation prior to the decision;
c. declare the objection of January 23, 2022 directed against the decision of December 21, 2021 unfounded insofar as objectors claim that the letter of December 6, 2021 is not in accordance with the core agreement; d. declare the objections otherwise well-founded.
2. Revoke the decisions of October 12, 2021 and December 21, 2021;
3. In place of the revoked decisions:
a. from the t-junction in Mayor Panken Street at house numbers 16 and 18, rename the street to "Mayor Berkhouthof" under the following renumbering:
i. mayor Pankenstraat 18, 20, 20a, 20b and 20c to house numbers 1 through 5;
ii. mayor Pankenstraat 20 e and 20d to house numbers 11 and 10;
b. renumber Mayor Berkhouthof 1 through 4 to house numbers 6 through 9.
4. To compensate the owners of the residences Mayor Pankenstraat 18, 20, 20a through 20 e, and the residents of the four new residences for the costs to be incurred as a result of the street name change and renumbering with € 150,- or with € 650,- if one or more businesses are located at the address in question at the time of decision-making according to the Chamber of Commerce.

Developments files 21 for Youth (regional procurement of youth aid)

Annually, the "Work Plan 21 for Youth" is adopted with agreements on the youth aid that is procured regionally and for which files are coordinated regionally. These are dossiers of specialized youth aid that are taken up at the level of the youth care region of Southeast Brabant based on a legal obligation. The files are prepared in the region in terms of policy and the content is implemented in regional coherence. Safe Home Safe Home is the hotline in our region for domestic violence, child abuse and elder abuse. On October 1, 2022, the foundation Veilig Thuis Zuidoost-Brabant and the foundation Veilig Thuis Brabant Noordoost merged. Together they form the new foundation Safe Home East Brabant. The merger creates new opportunities for Safe Home to work together to break the chain of domestic violence, child abuse and elder abuse in the region and to work on (sustainable) safety.

College Decision:

  1. Agree to the agreements, budget and distribution of resources from the "Work Plan 21 for Youth 2023.
  2. Agree to the renewed cooperation agreements between municipalities, local teams and Safe Home.
  3. To authorize Stichting Veilig Thuis Oost-Brabant to deploy crisis assistance and to make this effective retroactively as of October 1, 2022 in accordance with the attached draft municipal bulletin with simultaneous revocation of the "Authorization Stichting Veilig Thuis Zuidoost-Brabant".

Board proposal children's mayor Geldrop-Mierlo

As a municipality, Geldrop-Mierlo wants to connect with its young people and actively involve them. The city council wishes to investigate whether and how we could establish a Youth Mayor in Geldrop-Mierlo, in addition to a Youth Council. We have investigated the possibilities for this, what this step would mean and which parties should be involved. This has led to this proposal to establish a Children's Mayor together with a draft profile for this position.

The college decides to approve the establishment of a children's mayor in Geldrop-Mierlo and the draft profile of the children's mayor.

Advisory note Emopad

The Council asked the Board to investigate the possibilities of relocating existing businesses from the Emopad business park and developing a residential area there. Three options will be looked at, namely moving only the Pali Group, transforming the area framed in yellow (see council information letter) and the option of transforming the entire Emopad business park
