Advisory note on the Painted Lady butterfly

After the demolition of the industrial buildings at Distelvlinder 1/Luchen 13a, the remaining office building was occupied and expanded. The initiator wants to demolish the office and rebuild a semi-detached house. The environmental plan must be amended in order to realize this project. In view of the above, the present draft amendment to the environmental plan has been drawn up.

The council decides:
1. To approve the draft environmental plan amendment Distelvlinder;
2. Not to have an environmental impact assessment drawn up for the draft environmental plan amendment Distelvlinder 1.

Advisory note on updating GR Senzer; approval procedure

The Senzer joint arrangement has been updated. The participating municipalities were given the opportunity to express their views on the draft amended joint arrangement. A number of these views led to adjustments being made to the draft amended Senzer joint arrangement. The Memorandum of Views states the points on which the draft has been amended. Before the municipal executives can adopt the amended Senzer joint arrangement, the municipal councils must give their approval.

The council decides:
1. To adopt the Memorandum of Views on the draft of the amended Senzer 2025 joint arrangement previously submitted to the municipal council. 
2. To express its intention to enter into the final version of the amended Senzer joint arrangement, as amended in response to the opinions submitted, with the municipal councils of Asten, Deurne, Geldrop-Mierlo, Gemert-Bakel, Laarbeek, and Someren. 
3. To request the municipal council's approval, by means of the attached council proposal, to enter into an amended Senzer 2025 joint arrangement with the municipal executives of the aforementioned municipalities.

Advisory Note Holly 124

The developer Ruimte voor Ruimte has submitted an initiative for the redevelopment of agricultural land at Hulst 124. The aim is to transform the current agricultural plot into both housing and suitable nature conservation areas. 1.3 hectares of agricultural land will be sold to the municipality of Geldrop-Mierlo for nature development. In addition, five residential units will be added. In order to realize this plan, the environmental plan must be amended, for which the present draft environmental plan amendment has been drawn up.

The council decides:
1. To approve the draft TAM environmental plan Hulst 124.
2. Not to have an environmental impact assessment drawn up for the TAM environmental plan Hulst 124. 
3. To approve the attached council information letter explaining the Hulst 124 visual quality plan and to forward it to the municipal council.

Advisory note on the sale of space for space rights

In 2008, the municipality purchased ten Space for Space titles from the province for the purpose of housing construction on Burgemeester Termeerstraat in Mierlo. The adoption of the Groot Luchen zoning plan in 2015 made housing construction possible at that location without Space for Space rights. The rights thus became available for sale. At present, the municipality still has one of the building titles purchased in 2008. We can now sell these. The Ruimte voor Ruimte title will be used for the construction of a house at Dellerweg 16 in Someren.

The council decides to approve the sale of a space-for-space right for €125,000 for the construction of a house at Dellerweg 16 in Someren.

Advisory memorandum on formal decision BW Land policy program and cost recovery 2026

This decision establishes the new appendices to the 'Land Policy and Cost Recovery Program' ('Appendix 2026').
The Municipal Executive is the competent authority for Omgevingswet (appendices to) programs as referred to in the Omgevingswet . 
On November 10, 2025, the municipal council approved the new annex 'Land Policy and Cost Recovery Program 2026'. Once adopted, the new 'Land Policy and Cost Recovery Program 2026' can be published in accordance with the rules of the Omgevingswet.

With the approval of the council on November 10, the college decides to immediately adopt this draft for 'Appendix 2026', with the proviso that:
a. This 'Appendix 2026' to the 'Land Policy and Cost Recovery Program' will then come into effect the day after its publication on the Digital System Omgevingswet January 1, 2026; 
b. The 'Appendix 2025' to the 'Land Policy and Cost Recovery Program, Municipality of Geldrop-Mierlo', as published on July 7, 2025, will be withdrawn on the date stated under a.

Advisory note on damage to tree structure for construction of bus lane on Mierloseweg

Six trees will have to be felled and structural greenery will disappear for the planned construction of a bus lane on Mierloseweg. This will affect the tree structure. According to the green policy plan, damage may only occur after the municipal executive has decided, following an extensive and verifiable weighing of interests, that another interest justifies the damage to the tree structure. This advisory note weighs the importance of the bus lane against the importance of the tree structure.

The council decides:
1. To determine that the importance of constructing a bus lane along Mierloseweg justifies the damage to the existing tree structure.
2. To plant six new trees just outside the planning area along Mierloseweg as compensation. 
3. To cover the financial compensation of €18,560 for the six trees to be felled from the Mierloseweg bus lane construction project (702910) by transferring budget to the Green and Tree Compensation project (70288) and to process this in the first budget round of 2026.
4. To cover the financial compensation for the loss of green space in the tree structure, amounting to €47,250, from the Mierloseweg bus lane construction project (702910) by transferring budget to the Green and Tree Compensation project (70288) and to process this in the first budget round of 2026.

Advisory memorandum on the award decision for the Species Management Plan (SMP)

On September 9, 2024, the municipality of Geldrop-Mierlo published a tender for the drafting of a species management plan (SMP) and the application for an area exemption for economic and spatial developments and for species protection. No parties responded to this tender. In order to still be able to enter into an agreement with a party regarding the drafting of an SMP, we switched to a different tender procedure, the so-called negotiation procedure without prior announcement. This allows for private contracting, provided that the Requirements the original contract do not change significantly. This has led to the attached quotation.

The council decides:
1. To approve the awarding of the contract for the preparation of an SMP and the application for a regional exemption to Sweco.
2. To apply the review clause to expand the number of species to be investigated and to exclude all industrial estates in Geldrop and Mierlo and the new residential area of Luchen from the SMP.

College proposal for area vision for the Zesgehuchten district

On November 11, your council reviewed the results of the Zesgehuchten area vision. In order to involve the council in this process, it is important to first give an informative presentation (by Verhoeven de Ruijter) on January 12, 2026, in which the vision is explained. In view of the above, the council is requested to send the attached agenda request to the Municipal Clerk’s Office.

Advisory memorandum on the Framework for Household Raw Materials and Waste 2026-2030

The current waste policy in the form of the 'Soil and Waste Materials Plan 2022-2025' expires on December 31, 2025. The 'Framework for Household Soil and Waste Materials 2026-2030' will follow on from the current plan. The Framework explicitly incorporates the impact and considerations of waste policy in a social and spatial context. 

The council adopts the Framework, after which the municipal executive draws up an annual 'Household Waste Implementation Agenda' as input for the GR Cure budget and the multi-year budget of the Municipality of Geldrop-Mierlo.

The council decides:
1. To submit the 'Framework for Domestic Soil and Waste Materials 2026-2030' to the Municipal Council for approval. 
2. To apply the Framework annually in the form of an 'Implementation Agenda for Household Soil and Waste Materials' as a starting point for the GR Cure budget and the Multi-Year Plan budget of the Municipality of Geldrop-Mierlo.
