The decision list of the public college meeting of September 12, 2023, is adopted as presented.

Resignation membership CPM

Mr. Jan Joosten has given written notice of his resignation as chairman of the Participation and Minima Clients' Council (CPM) effective August 15, 2023.
During meeting CPM on August 14, member Rob Mostert was appointed as successor chairman. Mr. Pieter Kluijtmans was appointed as secretary.

The College decides:
1. To approve the enclosed farewell letter on behalf of the college;
2. To take note of the appointment of Rob Mostert as president CPM;
3. To take note of the appointment of Pieter Kluijtmans as secretary CPM.

Advisory note Extension pilot Heppie (t)House Sept. 19, 2023

In the June 27 Heppie (t)Huis committee meeting, an image-forming discussion was held on the council memo "Scenarios for extending the Heppie (t)Huis pilot" dated May 30, 2023 containing the various scenarios that could apply to extend the Heppie (t)Huis pilot. In anticipation of this, the same committee meeting discussed the evaluation of the current pilot, which was also included in this council memo. After this image-forming committee meeting, the judgment-forming committee meeting of September 5, 2023, took place, as a prelude to the decision-making moment in the city council of September 25, 2023. The legal seal of the pilot extension Heppie (t)Huis is in fact a matter for the City Council of Geldrop-Mierlo. This advice note deals with the preparation of the decision to be taken by the council, taking into account the results of the opinion-forming and opinion-forming committee meetings. While initially (for the purpose of the judging committee meeting) the college submitted a council proposal with a preferred variant for 2B, the judging committee meeting voted overwhelmingly in favor of the other scenario 3B. The request of the judging committee meeting was ultimately for the college to take back the outcome of this meeting and come up with a new council proposal that would extend the pilot.

The College decides:

1. To agree to the council proposal 'Extension of the pilot Heppie (t)Huis' in which it is proposed to agree to the pilot extension Heppie (t)Huis in accordance with the preferred scenario 3B and thereby:
a. agree to increase the basic amount by € 82,915 due to factors in the Heppie (t)Huis operation (higher personnel costs, costs not passed on, etc.), bringing the level of the basic amount in 2024 to € 856,812 (excluding indexation). This increase will be charged to the budget result of the relevant years;
b. to agree to the annual increase of the budgets Heppie (t)Huis with the indexation used within the care region One 10 for Youth. Coverage for this annual increase can come from the adjustment item for wage and price development;
c. agree to extend the Heppie (t)Huis pilot for a period of 5 years;
d. agree to an evaluation after 3 years of the pilot extension Heppie (t)Huis;
e. agree to the associated Service of General Economic Interest (SGEI).
2. To agree to forward this council proposal 'Extension of the pilot Heppie (t)Huis' to the City Council.

Advisory note closing passage Hill September 2023

In this proposal, we recommend that you reach a final solution for a closure of the passage between the Achter de Kerk site to the pedestrian area on the Heuvel in the center of Geldrop.

The college decides to place removable bollards in the passageway between the parking area Behind the Church and the Hill (rear of St. Brigida Church) according to the attached drawing dated 2023-09-01 Removable Bollards Hill.

Advice note decision on objection felling trees Cherry Street Mierlo

A notice of objection has been filed against the decision of the college granting an environmental permit to grub up three ornamental cherries in the public area in Mierlo. The Objections Committee has recommended that the reasons for the contested decision be supplemented by a report from a person with expertise in the matter and, on the basis of this report, to assess whether the contested decision can be upheld.

The College decides:
1. To declare the objection admissible;
2. To supplement the statement of reasons in the contested decision with a tree report;

3. Uphold the contested decision.

Advisory note on decision on objection to designation of a protected tree

A notice of objection was filed against the decision of the college designating a tree on private property in Mierlo as a protected timber stand. The Objections Committee recommended that the objection be declared admissible and that the contested decision be revoked.

The College decides:
1. To declare the objection admissible;
2. To revoke the contested decision.

College proposal coordination decision Mierloseweg 40

On July 11, 2022, the council adopted the Mierloseweg 40 zoning plan. On May 31, 2023, this decision was overturned by the Council of State. Additional consultations were held between the developer and the petitioner of these grounds for appeal about the reason the zoning plan was nullified. An agreement has been reached between the two parties on the conditions under which the plan can still go ahead. This will be reported back to the municipality in writing by the petitioner. Because of the great shortage of housing on the housing market, it is desirable to make speed with the realization of the plan. This is partly because an investor has also been found for the plan in the form of Stayinc. and that all lights are now green to bring the plan further into development. The developer has submitted a request for application of the coordination scheme pursuant to Section 3.30 of the Spatial Planning Act (hereinafter Wro). This project contributes to the realization of an element of the municipal spatial policy. In order to apply the coordination scheme, the council must adopt a coordination decision. A coordination decision cannot be appealed against.

The College decides to forward the attached council proposal to the City Council.

College proposal consent forwarding RIB Local Broadcasting.

Every five years is a new designation procedure for the license to the Local Broadcaster for the municipality of Geldrop-Mierlo. The new period starts from November 4, 2023. No later than December 22, 2023, the municipal council must issue a recommendation to the Media Authority, which has overall direction in this process. For the new designation for the license to the Local Broadcaster, concretely two parties have submitted a designation application. However, only one license can be granted.
Before the final decision is submitted to the City Council, we would like to give them the opportunity to make known any comments on the criteria.

The college decides to agree to forward the council information letter Local Broadcasting and Broadcasting Authorization 2023.

Advisory Note Specific Allowance (SpUk) Local Approach to Insulation

As part of the National Insulation Program, the state has opened up a Specific Payment (Spuk) for municipalities to set up their own insulation approach for poorly insulated owner-occupied homes; also known as the Spuk NIP. Our municipality can apply for a total amount of €769,420 for the years 2023 and 2024 until October 31, 2023.

The College decides:
1. To approve the insulation approach described in this proposal;
2. To approve the draft application attached in the Appendix;
3. To authorize the Space Department Manager to submit this application on behalf of the College in accordance with the attached mandate decision.

College adapt council proposal council response to draft amendment GR MRE

At the General Affairs Committee meeting on September 12, 2023, the portfolio holder undertook to modify the prepared response. This was in response to suggestions made at the committee meeting.

The College decides:
1. To agree to present the amended response letter to the council at the council meeting on September 25, 2023;
2. To agree to add the prepared memorandum to the council proposal.

Adjusted Council proposal + Viewpoint common regulation GGD

In the committee meeting General Affairs on September 12, the proposal 'Adjustment GGD-BZO' was discussed. A promise was made in this meeting to remove the passage article 24a WGR from the Opinion and the council proposal. The signature of the Opinion has been changed from College to City Council. Attached are the adjusted documents. It was decided that the adjusted proposal could proceed to the council meeting of September 25 as a hammer piece.

The college decides to agree to the amended documents (view and council proposal) and forward them to the council meeting on Sept. 25, 2023.

Board Proposal Parking Ordinance

On Monday, September 4, the discussion of the Parking Ordinance was on the agenda of the council's Space Committee. In this committee meeting some questions were
which would be answered in writing.
In addition, in this committee meeting a request was made to make some adjustments to the council proposal:
- Adjustment of the decision point. The policies are not adopted by the council.
- Removal of sentence about preventing the purchase of a second car.
- Added comment about a blue zone

The College decides:
1. To take note of the amended council proposal Parking Ordinance Geldrop-Mierlo 2023;
2. To take note of the written answer to the questions from the council committee Space of September 4, 2023 about the parking ordinance.
