Advisory note New GR Cure

As of July 1, 2022, the Joint Arrangements Act (Wgr) has been amended. The purpose of this amendment is to strengthen the democratic legitimacy of joint arrangements and the framework-setting and controlling role of municipal councils. The amended legislation must be incorporated into all joint arrangements by July 1, 2024. This obviously also applies to the GR Cure. In the present proposal, your college asks the council to express its views on the draft 'new Joint Arrangement Cure'. Because it appeared that other GRs included an extra provision on citizen participation and this was not included in the original proposal, the proposal on GR Cure proposes to do this by giving an opinion. This is done in this way in all three Cure municipalities.

The college decides to approve the attached draft council proposal with attachments.

Policy rules for noise and definition of odor-sensitive buildings under the Omgevingswet

On Jan. 1, 2024, the Omgevingswet will take effect. With the arrival of the Omgevingswet , new, open standards will be introduced and some definitions will be different. Current environmental policies will also expire. Therefore, we propose to adopt new policies. In this way we will smoothly transition to the Omgevingswet and policy choices will not have to be made on a case-by-case basis. These policy rules flesh out the open standards and maintain the current definitions for the time being. The policy rules have been rewritten in a policy-neutral manner as much as possible.

The College decides:
1. To adopt a policy-neutral approach to the definition of odor-sensitive building for odor exposure from livestock farms in out-of-plan environmental planning activities by adopting the Policy Rule on the Definition of Odor Sensitive Building Municipality of Geldrop-Mierlo 2024;
2. To apply the method for noise in focus areas of (rail) roads and (if present) industrial sites by adopting the Policy Rule on Noise under the Omgevingswet municipality of Geldrop-Mierlo;

Advisory note on granting grant 2024 entrepreneurial fund

Stichting Centrummanagement Geldrop and Stichting Centrum- en Lintenmanagement Mierlo have submitted a request for grant Entrepreneur Fund 2024.

The College decides:
1. To grant Stichting Centrummanagement Geldrop a subsidy of € 102,973 for 2024.
2. To grant Foundation Center and Ribbon Management Mierlo a subsidy of € 52,666 for 2024.

Advisory note service agreement East Brabant

Tax and collection tasks are outsourced to the East Brabant Tax Cooperation (BSOB). A service agreement will be entered into for this purpose. In addition, the head of department of the BSOB will be appointed as levy, collection and WOZ official and a number of policy rules of the BSOB will be declared applicable.

The College decides:
1. To agree to outsource the tasks in the field of taxation and collection to the Oost-Brabant Tax Cooperation, by entering into the attached service agreement;
2. To grant the Director of the Dommelvallei Service a mandate to enter into the service provision agreement and the associated processing agreement, on behalf of the Municipality of Geldrop-Mierlo;
3. To request the Mayor to delegate the signing of the Service Agreement and the Processing Agreement to the Director of the Dommelvallei Service;
4. To adopt the Collegebesluit formele aspecten DVO Dienst Dommelvallei - Belastingsamenwerking Oost-Brabant 2024.

Agenda request image-forming presentation committee Space - Frameworks and preconditions Lommerrijk

On January 22 we would like to give an image-forming presentation to the members of the Space Committee on the principles for the urban development vision of the Lommerrijk project. The attached memo explains the purpose of the meeting. The presentation will be discussed with you during the college meeting on January 9.

The College decides:
1. To approve the attached agenda request;
2. To agree to the attached memo.

Advisory note grant The Momentum

By means of this advisory memo, we request approval of the proposed grant amount to Het Momentum for the provision of workshops for family caregivers and volunteers dedicated to residents with dementia. This grant is before the Board for decision because, in accordance with the Terms of Reference, the Board must approve the proposal.

The college decides to approve a grant of €15,340 to Het Momentum from the Broad SPUK.

Advisory note Evaluation Canopies and patio expansion

The additional local coronasteun in the form of the temporary expansion of terraces and canopies at catering establishments will be re-evaluated by the college as agreed.

The college decides that due to the continued absence of the events and terraces policy, the temporary support will not stop now.

Advisory note on Losweg redevelopment

To adopt the DO redesign Losweg and Losweg Park based on the previously adopted Preliminary Design and incorporated comments from the walk-in meeting.

The College decides:
1. To approve the final design for the redesign of the Losweg;

2. Approve the final design for the Losweg Park redevelopment.

Advisory note on adoption of Land Policy and Cost Recovery Program

After deciding on an amendment, the City Council unanimously approved the Land Policy and Cost Recovery Program and its annex on December 11, 2023. Since the authority to adopt a Program under the Omgevingswet rests with the college, the final documents are now presented for adoption so that it can take effect from 1-1-2024. From the coming into force of the Omgevingswet , the Environment Vision and the Land Policy and Cost Recovery Program will then form the new legal basis.

The College decides:
1. To adopt the attached Land Policy and Cost Recovery Program and its appendices;
2. To verbally inform the Space Committee and/or City Council of the College's ability to set higher specific land prices.

Advisory note on draft pheasant avenue west zoning plan

The Luchen Fazantlaan-West urban development plan was adopted in August 2023. In order to implement this plan and thus enable the development of 15 bungalows, 5 detached houses and a maximum of 15 tiny houses, a planning procedure must be completed. Therefore, the draft zoning plan Fazantlaan-West (Luchen) that is before us has been prepared.

The College decides:
1. Not to commission an environmental impact assessment for the draft Pheasant Avenue West (Luchen) zoning plan;
2. To approve the draft zoning plan Fazantlaan-West (Luchen) and to submit this plan for public inspection for a period of six weeks.

Advisory note plan Cedrus Luchen 3A

In 2019, the plan was prepared with Cedrus Realty for the construction of seven senior housing units in Luchen 3a. Due to objections to the zoning plan, this development was delayed. The zoning plan is now irrevocable and the land is ready for construction, allowing progress to resume. Given the changed market conditions between 2019 and 2023, some adjustments have been made to the plan. The decision now before us ratifies the updating of the agreements and is the basis for the conclusion of the purchase agreement.

The College decides:
1. To approve the modified plan of Cedrus Vastgoed b.v. for 7 dwellings in Luchen 3a;
2. To agree to use the 2023 land price in the purchase agreement;
3. To agree to publish the intention to sell according to guidelines of the Didam judgment.

Advisory note PDO Willem Knaapenstraat

With the imposition of an order under penalty of payment, action was taken against illegal use of a garage/storage room. An objection has been lodged against this order. This advice note serves to make a decision on the objection received.

The College decides, in accordance with the advice of the Objections Committee, to declare the objection admissible but unfounded with the addition of the reasons as included in the draft decision on objection.

Advisory note on draft Bezorgershof zoning plan

Within the framework of Centrumimpuls Geldrop (CIG), the council established spatial frameworks for the future (housing) development around the Bezorgershof in Geldrop in 2022. These frameworks must be legally translated into a zoning plan. In order to prevent undesirable developments during the zoning plan procedure, the council adopted a preparatory decision on May 31 of this year. Following this, the present draft zoning plan must be brought into the procedure.

The College decides:
1. Not to draw up (or have drawn up) an environmental impact assessment for the Bezorgershof Geldrop zoning plan;
2. To agree to the draft zoning plan 'Bezorgershof Geldrop';
3. To agree with the Bezorgershof Image Quality Plan.

Advisory Note Working Plan 21 for Youth

This proposal seeks agreement on two matters organized on the scale of youth aid region Southeast Brabant (called 21voordejeugd).

College Decision:
1. Agree to the 21fortheYouth work plan and associated budget for 2024 at €22,575 (Annex 1). This amount is budgeted in FCL 6672011, ECL 38043. 
2. To agree to the updated continuation of the DVO as a cooperation construct for the period January 1, 2024 to December 31, 2025 with 4 tacit renewal options of one year to December 31, 2029 at the latest in accordance with the attached draft service agreement and- cooperation agreement 21 "youth protection & youth probation (jbjr), safe home (vt), crisis intervention team (cit), coordination crisis aid and youth care plus (jz+)" Southeast Brabant 2024 to 2025 with annexes (DVO21) (Annexes 2 to 6). 
3. To agree to mandate the College of Mayor and Aldermen of the Municipality of Eindhoven, each insofar as its powers are concerned, in accordance with the attached draft Municipal Gazette (Appendix 7), to: 
a. to decide, on behalf of the municipality of Geldrop-Mierlo, to enter into or terminate agreements with service providers regarding "youth protection & youth probation (jbjr), safe home (vt), crisis intervention team (cit), coordination crisis aid and jeugdzorgplus (jz+)" as described in the DVO21 referred to in decision point 2; 
b. decide to amend the agreements referred to in a. under the condition that; 
i. the participating municipalities were informed in a timely and reasoned manner prior to those changes; and 
ii. that change per agreement has a financial impact of less than 6.6% of the total contract value per calendar year for all DVO21 participating municipalities (Annex 3 (Annex 1 of DVO21)). 
4. To request the Mayor to give power of attorney to the Mayor of the Municipality of Eindhoven to sign the agreements mentioned in decision point 3 in accordance with the attached draft municipal gazette (Annex 7). These agreements are also binding for the municipality of Geldrop-Mierlo. 
5. To authorize the College of Mayor and Aldermen of the Municipality of Eindhoven, each insofar as its powers are concerned, to grant submandates to subordinates for the powers referred to in decision points 3 and 4 in accordance with the attached draft Municipal Gazette (Appendix 7). 
6. To agree to the increased costs of the purchasing organization and the individual contribution of the regional municipalities (Annex 5a and 5b (Annex 3a and 3b of the DVO21)) compared to 2023 as a result of indexation and updating of population numbers. For the municipality of Geldrop-Mierlo it concerns an increase compared to 2023 of 1,308.00 euro. This amount is budgeted on FCL 6672011, ECL 38043. 
7. To agree with the increased costs of coordination costs crisis costs and the individual contribution of the regional municipalities (Annex 6a (Annex 4a of the DVO)) compared to 2023 as a result of indexation and updating population numbers. For the municipality of Geldrop-Mierlo it concerns an increase compared to 2023 of 1,084.00 euro. The budget does not take this Health into account. The budget on FCL 6672012, ECL 34111 will therefore have to be increased by 14,020 euro and will be presented to the Council via the 1st interim report 2024. 
8. Agree to the increased costs compared to 2023 as a result of indexation and updating population numbers Availability Financing (= vacancy) stay Crisis and the individual contribution of the regional municipalities (Annex 6b (Annex 4b of the DVO)). For the municipality of Geldrop-Mierlo it concerns an increase compared to 2023 of 10,714 euros. The budget does not take into account this Health. The budget on FCL 6672012, ECL 34111 will therefore have to be increased by 20,883 euro and will be presented to the Council via the 1st interim report 2024.

Grant application POH GGZ Youth 2024.

GPs, as legal referrers for youth care, have an important role in the implementation of the Youth Act. The Youth Act stipulates that general practitioners, youth doctors and medical specialists can refer the youth to second-line youth care. The Act also stipulates that municipalities make agreements with general practitioners about cooperation and that an integral approach is sought. This proposal elaborates on that.

The College decides:
1. To agree to grant a subsidy of € 64,299 for the calendar year 2024 to Zorggroep Stroomz for the financing of the GP GGZ Youth practice support worker;
2. To agree to grant a subsidy of € 20,254,00,- for the calendar year 2024 to Zorggroep Stroomz for the financing of intensification of cooperation within the YouthHealth) professionals Youth, in order to implement one of the pillars of the Youth Reform Agenda;
3. To fund the grant from the item "Ambulatory Health Youth" FCL 6672005.
