The decision list of the public college meeting of October 10, 2023, is adopted as presented.

Advisory note Sanghorst 9

The initiators want to stop the activities related to the pig farm and convert the destination to an agricultural related company. From then on, the main branch will be the landscaping company c.q. contracting company and in addition a shed of 1000 m² of static storage will be built.

The College decides:
1. To determine that the plot Sanghorst 9 be rezoned to "Agricultural Related Business," with room for landscaping activities (including small-scale earth moving), static storage and arable farming;
2. To provide that outside storage outside the building area is not allowed, in order to guarantee that the associated earth movement remains sufficiently small-scale;
3. To provide that the current pig stables be demolished;
4. To agree to the construction of a new 1000 sq. ft. shed at the location of the pig stables;
5. To agree to a plan cost letter;
6. To initiate a spatial procedure for this purpose.

Answering questions CDA on future plans for Josephinehof

CDA asked Article 36 questions about Josephinehof's future plans. Answers to these questions are now being submitted to the college.

This proposal was previously held up by the college because the college wants clarity on the primary decision that temporary housing would be possible until 2026. However, the origin and existence of said decision has not been superseded:
- No permit was ever issued regarding this temporariness (zoning is "residential").
- Wooninc (owner) is not familiar with this said decree and indicates that such a thing was never recorded.
- Wooninc (former owner) is not aware of this said decision and indicates that nothing has been recorded about this.

In consultation with portfolio holder, the proposal was otherwise reintroduced unchanged.

The College decides:
1. To approve the attached response to CDA's council questions.
2. To forward the response to the council.

Answers to follow-up questions SUMMARY

On Sept. 13, 2023, the college answered SAMEN's questions about area plans. The answers to some of the questions
come across as vague and evasive. Therefore, SAMEN asked follow-up questions about the area plans.

The college decides to approve the responses to SAMEN's follow-up questions.

Advisory note on reintegration regulation Participation Act

On July 1, 2023, the Implementing Broad Offensive Act took effect. This law requires municipalities to elaborate in the
reintegration regulation and further rules. The aim is to adopt the present reintegration regulation with retroactive effect as of July 1, 2023. In the other municipalities in the labor market region there is a similar proposal for decision-making. Senzer has already been acting in accordance with the principles of the present regulation since July 1, 2023. The College of B&W has delegated the authority to adopt the detailed rules to the Executive Board of the Senzer Joint Arrangement and will take place at the end of 2023.

The College decides:
1. To approve the present Re-integration Ordinance Participation Act Geldrop-Mierlo 2023 and forward it to the City Council for decision;
2. To agree to have the Re-integration Regulation Participation Act Geldrop-Mierlo 2023 enter into force retroactively as of July 1, 2023;
3. To agree to simultaneously submit the repeal of the Re-integration Ordinance Participation Act Geldrop-Mierlo 2018 and
Verordening loonkostensubsidie Participatiewet Geldrop-Mierlo 2018;
4. To agree to publish the Re-integration Ordinance Participation Act Geldrop-Mierlo 2023 after adoption by the
City Council.

Advisory note on appointing members Municipal voting committee TK 2023

For each election, the College of Mayor and Aldermen establishes a Municipal Election Board (CSB).
The job of the Gsb is to review the polling station minutes during a public session one day after the election and determine the results of the election at the municipal level.

The College decides:
1. To appoint the persons listed on Annex 1 as members and/or alternate members/supporters of the Municipal Voting Committee TK 2023.
2. To designate the Town Hall as the location where the Municipal Voting Committee will hold office.
3. To determine that the Municipal Voting Committee will hold its session on Thursday, November 23, 2023 beginning at 9:00 a.m.

Cover page college proposal Approach to Accountability

In the auditor's report accompanying the 2022 financial statements, the auditor made a comment on the legitimacy reporting.
In the response to this report, a commitment was made to prepare a plan of action for this purpose.
This plan is attached as an appendix.

The college decides to accept the plan of action for notification.

Advisory Note on Optimizing Working Methods Area Directors

Every year the area directors dispose of about thirty grant applications from residents of the municipality of Geldrop-Mierlo.
At the moment, a relatively large amount of time is spent in the administrative work process of area-based subsidies.
This applies to both the area directors and the grant applicant. We would like to optimize this process.

The college decides to agree to a new working method single grant determination decision without sampling by area directors.

Advisory note on Regulation Water Storage 2023

In recent weeks, the draft Water Storage Ordinance 2023 has been available for review. The received views have been processed in a
consultation memo. The ordinance can now be submitted to the council for decision-making.

The College decides:
1. To adopt the consultation note for the draft Hemel and Groundwater Ordinance 2023;
2. To adopt the consultation memorandum for the draft Water Storage Ordinance 2023;
3. To forward the draft Water Storage Ordinance 2023 to the council for decision.

Advisory Note Decision on Objections to Traffic Decision VKB2022-09

On November 10, 2022, the college decided, through a traffic decree, to close a section of Brugstraat in Mierlo to through traffic. On December 22, 2022, the college issued an amendment decision, which replaces the November 10, 2022 decision. The November 10, 2022 decision and the December 22, 2022 amendment decision were objected to by several local residents. This advisory note deals with the decision to be made on the objection.

The College decides:
1. declare the objections received on November 23, 2022 (2x), December 19, 2022 (3x), December 2022, December 21, 2022 (2x),
December 23, 2022 and January 30, 2023 be declared admissible and that the contested decision be upheld with improvement and addition of reasons as included in this decision;
2. that the petitioners of the objection received on December 20, 2022 are entitled to a penalty payment in the amount of € 1,442 for not deciding on the objection in time;
3. declare inadmissible the objection received on April 8, 2023;
4. adopt the draft decisions on objection.

Council information letter status of event policy

The events policy is under review. It was originally planned to present the updated policy to the council for decision on December 11, 2023. Meanwhile, the plan is to present the policy to the council in March/April 2024, at the time of decision-making on the
theme program Economic Strength.

The college decides to approve the attached council information letter and forward it to the council.
