Letter Decision on objection unfoundedOn October 27, 2021, the college decided to grant an environmental permit for the construction of 22 homes at Vlinderlaan and Landkaartje in Mierlo. An objection has been lodged against this decision. This advisory note seeks a decision on the objection. The College decides to declare the objection admissible and unfounded and uphold the contested decision. |

Advisory note on liability Parallelweg GeldropOn December 5, 2021, the owner of the house on Parellelweg filed a claim for damages. The owner holds the municipality of Geldrop-Mierlo liable for subsidence of floors and walls of the first floor. The plaintiff claims that during the work on the Parellelweg in Geldrop, a well was installed in front of the house and that the pumping away of the groundwater caused damage to the house. The settlement of the liability claim took longer than desired. As a result of the final report (July 21, 2022), the CAR insurers of the Municipality of Geldrop-Mierlo launched an additional investigation. On October 14, 2022, the investigation results were received and the CAR insurers arrived at a final proposal.College Decision: 1. To agree with the proposal of the CAR insurers to proceed with the payment of the damage amount of €44,850 to the owner of the house on the Parellelweg in Geldrop.2. Authorize the realization team manager (space department) to issue the payment order. |

Advisory note on rent increase 2023In the rental agreements for municipal business premises and plots of land, it is contractually stipulated that an annual indexation takes place. The CBS rent index is used for this purpose. Considering the Consumer Price Index (CPI) of September 2022, the rent increase for commercial premises and plots as of January 1, 2023 comes out at 14.5%. We looked at how other municipalities deal with this extreme rent increase. This varies; one municipality sticks to 14.5%, another goes below it or no rent increase is applied at all. We would recommend sticking to a measurable figure. For this, we look at last year's index (2.7%) and core inflation (6.5%).The College decides to deviate from the Consumer Price Index (CPI) September 2022 and apply the percentage of the 2022 index (CPI September 2021) (2.7%) for the indexation of the rent of municipal business premises and parcels in 2023 one time. |
