Advisory note Decision on objection regarding obligation to provide parking lot at senior housing Landkaartje

The objector is a future resident of the Landkaartje in Mierlo. He objects to the obligation to construct a parking space on his own property. The committee recommends that the objection be declared inadmissible. The decision is not (manifestly) directed against a decision in the sense of the General Administrative Law Act. To the extent that the objection was directed against the environmental permit for the construction of 16 dwellings at Landkaartje, it was submitted too late. The objector did not make use of the opportunity to clarify which decision the objection is directed against and/or to explain the delay.

The College decides:
1. To declare the objection inadmissible.
2. Inform the objector that this decision is subject to appeal to the court.

College proposal delay amendment GR Dienst Dommelvallei

The Common Arrangements Act (Wgr) was amended in 2022. As a result, all common arrangements must be amended before July 1, 2024, including the GR Dienst Dommelvallei. Although this is an arrangement of the college and the mayor, the council has a role in deciding the amendment of this GR. The discussion on governance has led to preparations being made to modify the legal form. In doing so, we are exceeding the July 1, 2024 deadline set by the Wgr. However, there are no consequences attached to not meeting that deadline.

The college decides to approve the Council Information Letter.

Advisory note leasing land De Kleine Dommel

For quite some time we have wished to harmonize the rental agreements for allotment associations within the municipality of Geldrop-Mierlo. A number of agreements had been arranged verbally and a number of agreements had been laid down in writing. However, over the years differences had arisen between the various agreements. By drawing up the new rental agreements, all agreements are now laid down in the agreement. This advice note only concerns the rental agreement for Garden and Recreation Association De Kleine Dommel.

The college decides:
1. To approve the attached lease agreement for De Kleine Dommel within Geldrop-Mierlo with an effective date of January 1, 2024.
2. To agree to the inclusion herein of an obligation to find an alternative location and a relocation fee in the event of a possible redevelopment of the location.

Advisory note Annual report 2023 The Right Home

The Right Home is a partnership with municipalities, housing corporations, Health and welfare organizations and the elderly with the aim of: stimulating solutions that allow the elderly to live happily independently for longer by sharing knowledge regionally, experimenting, inspiring and - above all - connecting municipalities, corporations, care institutions, developers and the elderly. With the attached council information letter and accompanying annual report 2023 of "The Right Home" we inform you about the results achieved in 2023.

The college decides:
1. To take note of the attached annual report 2023 of The Right Home (attachment 1);
2. To agree to and forward the attached council information letter annual report 2023 of The Right Home (attachment 2);
3. To agree to the attached draft letter on behalf of Alderman Sanders-de Jonge as administrative lead of The Right Home, to all participating municipalities in order to inform the administrators of these municipalities (Attachment 3).

Advisory Note Service Agreement Social Return on Investment (SROI).

Social Return on Investment (SROI) is a labor market instrument that can be used to achieve social objectives when awarding contracts. Municipalities enter into contracts with contractors (in all kinds of fields, from Health to lampposts). Depending on the content, duration and scope of this contract, it includes an SROI obligation. This means that the contractor must provide a percentage of the contract sum to people with a distance to the labor market. The municipalities in the labor market region of Helmond-De Peel agreed administratively in 2023 to place the implementation of the SROI policy with a regional service desk and the employer role for the three employees (SROI coordinator, advisor and support person) with the Municipality of Helmond. The present proposal oversees the necessary service and cooperation agreement.

The College decides:
1. To agree to enter into the attached Service and Cooperation Agreement with the Municipality of Helmond for the regional implementation of the Social Return on Investment policy for the period from March 16, 2024 to March 16, 2027.
2. To agree to the attached power of attorney and authorization decision 'Service- and cooperation agreement in the framework of Social Return on Investment (SROI) municipality Geldrop-Mierlo.

Cover page college proposal flex living

GroenLinks has asked questions about the progress of the Flexwonen project, for which the municipality has a plot on Goorsedijk in view. This proposal provides answers to the questions.

The college decides to approve the response to the Art. 36 questions from the Green Left on the progress of the Flex Living project and forward them to the council.

Advisory note First reception of displaced persons Ukraine

The reception of displaced persons from Ukraine by municipalities will continue for the time being. In anticipation of the entry into force of the Temporary Act for the Reception of Displaced Persons Ukraine, it has been agreed at the national level that from 2024, work will be done according to a new Administrative Agreement Framework. This means that the role of the security regions will be taken over by municipal partnerships or center municipalities. The municipality of Eindhoven will be the center municipality for our region. The center municipality coordinates the initial reception and receives compensation for this under the Bekostigingsregeling eerste opvang ontheemden Ukraine by regional public bodies. The regional municipalities authorize the center municipality for this purpose.

The college decides:
1. to agree to the role of Eindhoven municipality as center municipality for the coordination and initial reception of displaced persons from Ukraine;
2. to sign the authorization form Bekostigingsregeling eerste opvang ontheemden Ukraine door regionale openbare lichamen and send it to Eindhoven municipality.

Views 1st bw 2024 and Multi-year budget 2025-2028 Dommelvallei Service

The Executive Board of Dommelvallei Service has sent the 1st Budget Amendment 2024 and the Multi-Year Budget 2025-2028 to the councils for their information and invites the councils to submit an opinion on them. A draft opinion has been prepared. The proposal to you is to submit it to the council.

The college decides:
1. To agree with the draft outlook on the 1st Budget Amendment 2024 and Multiyear Budget 2025-2028 Dommelvallei Service;
2. To submit the council proposal "Outlook on 1st Budget Amendment 2024 and Multiyear Budget 2025-2028 Dommelvallei Service" to the city council for decision.

The VVD asked Article 36 questions about the Integrated Housing Plan for Education.

The college decides:
1. to approve the answers to the Article 36 questions posed by VVD about the Integral Housing Plan for Education;
2. to approve forwarding the answers to Article 36 questions to the council.

Cover page college proposal subsidizing Local Broadcasting

In June 2023, the process around the assignment license Local Broadcasting 2025-2028 started. A postponement was granted on this process after the City Council decided to reject the proposal from the Board, namely designation of Studio040 as a local broadcaster, and to issue a preferential recommendation for Studio24. We are still awaiting the final decision of the Media Authority (CvdM). Given the importance of the presence of a local broadcaster in Geldrop-Mierlo, it is desirable that Studio040 continues to provide the local media offer until the final decision is made. Studio040 currently provides the local news offer, but is not subsidized for this. Studio040 is applying for a subsidy for this.

The college decides:
1. To agree to grant a subsidy of local broadcasting with a maximum of € 28,674 based on the entire subsidy year 2024 to Studio040, maximum until the decision date of the Media Authority.
2. To agree with the council information letter.
