Advisory Note on Intergovernmental Supervision (IBT) Environmental Law

The province systematically supervises the implementation of statutory tasks by municipalities. This Interadministrative Supervision (IBT) relates, among other things, to the domain of environmental law. Within the municipality of Geldrop-Mierlo the task areas permits, supervision and enforcement are assessed annually. We received the 'Assessment IBT 2022' from the province.

College Decision:

  1. To note the assessment of the IBT;
  2. To agree to send the council information letter.

Council information letter ODZOB deficit 2022

This council information letter informs the council about ODZOB's projected deficit for the current year (2022) of nearly €2 million. The projected deficit is much larger than expected. The financial consequences of the trajectory Grip op de samenwerking (indicative approximately € 1 million) had been taken into account. In addition, ODZOB is now faced with new issues. For example, the consequences of the current wage and price developments are very large and unprecedented. This also applies to the high absenteeism that ODZOB will face in 2022. The deficit resulting from the 2022 Administrative Report can be covered (once only) by a withdrawal from the general reserve. This does not mean that the problems are over. The new developments outlined (high inflation and high absenteeism) will also affect the near future. A request for additional resources for 2023 seems inevitable against this background. In addition, these developments will also be reflected in ODZOB's soon-to-be-prepared draft 2024 budget.

The college decides to approve the attached council information letter and forward it to the council.

Advisory note on designation of valuable trees Geldrop and Mierlo

On May 31 of this year, you approved the intention to include the trees as listed in the Appendix Valuable Trees on the valuable trees list. The interested parties were informed of this by letter. For six weeks there was an opportunity to submit an opinion. Sixteen persons made use of this opportunity. This advice note serves to make a final decision (including responding to the views).

College Decision:

  1. To note the views received on the intention to designate trees as valuable trees.
  2. To agree to the responses to the submitted views as contained in the attached Consultation Note.
  3. To agree to the ex officio changes.
  4. Adopt the valuable tree list as amended.
  5. Authorize the department head to sign the letters, prepared according to the attached sample letter and adapted to the individual situation.

Advisory note Process proposal new culture program

The (draft) Budget 2023 states that a new culture program will take effect from 2023 and the Goals Agreement also mentions this. This proposal describes how the realization will be handled and which content will be used as a guideline for the plan/program. It is also presented here how we intend to get started in 2022.

The college decides to take note of the process proposal new cultural program 2023-2026.

Advisory Note Plan of Action on Quality Framework Violence Belongs Nowhere Home

To enable municipalities to determine whether their local (district) teams are sufficiently equipped to effectively identify and address domestic violence and child abuse and to determine where this needs strengthening, the VNG, supported by the program Violence Belongs Nowhere Home (GHNT), has developed the quality framework Working on Safety for local teams and municipalities. The quality framework was designed by the national GHNT program group in collaboration with local teams in Safe Home organizations. The presentPlan of Action of the municipality of Geldrop-Mierlo (dated October 10, 2022) is an elaboration of the jointly completed scan and analysis of the Quality Framework "Working on Safety for Local (District) Teams "and thus extends earlier versions of the Quality Framework indefinitely. In addition to the self-scan, other local and regional related spearheads (such as, for example, the regional and GHNT vision and implementation plan) have been added to this plan. Thus, with the description of 9 quality standards, a complete picture of the approach to domestic violence, child abuse and elder abuse has emerged.The municipality is already active in countering domestic violence and child abuse and with this advisory note, the work on safety by the local teams in our municipality is sealed, secured and the implementation of the plan to implement the improvement actions can begin.

College proposal DD audit 2022

Before the auditor starts the audit of the 2022 financial statements, it is necessary to adopt the 2022 audit protocol including standards framework.

College proposal 2nd Administrative Report 2022 Dommelvallei Service

The General Board of Dommelvallei Service reports every 4 months to the councils and colleges of the participating municipalities on deviations in the operational tasks. Through this report, they report on the deviations for the first 8 months of 2022. The 2nd Administrative Report 2022 of Dienst Dommelvallei gives no reason for a budget amendment. This administrative report will be forwarded to the City Council.

The college decides to accept the 2nd Administrative Report 2022 Dommelvallei Service for notification.

Advisory note council proposal amendment (addition) Heritage Ordinance 2023Omgevingswet)

The 'Erfgoedverordening gemeente Geldrop-Mierlo 2023' (Heritage Ordinance of the Municipality of Geldrop-Mierlo 2023) should still be supplemented with submission requirements for applications for environmental permits relating to municipal monuments or buildings in protected village sights. New national regulations (Environment Act) no longer appear to provide for this.

College Decision:
  1. To adopt the attached council proposal to amend (supplement) the "Heritage Ordinance Municipality of Geldrop-Mierlo 2023" as adopted on June 7, 2022.
  2. To forward the attached council proposal and draft council decision to amend (supplement) the "Heritage Ordinance Municipality of Geldrop-Mierlo 2023," as adopted on June 7, 2022, to the City Council for adoption.

Advisory note Progress and evaluation process Heppie (t)House

Heppie (t)Huis is the special and prominent care facility for youth in Geldrop-Mierlo that effectively started in 2019 and will have its last project year in 2023. The city council decided in 2017 to commit to this facility for 5 years from its opening. In the interim, in recent years, the organization has accounted for itself in reports, which have also been shared with the council. Through this advisory note, the May report is also shared with the council.In order to determine how we want to continue with this facility from January 1, 2024, it is good to evaluate the facility and agree on an evaluation process.That is also what this advisory note deals with.

The college decides

  1. To agree to the methodology of evaluation of Heppie Home as included in the council information letter.
  2. Agree to the attached council information letter and send it to the City Council.

Quarterly report TF SD Q3 2022

Every quarter the council is informed about the progress of the social domain task force. Due to software problems at the beginning of this year, a quarterly report has not yet been sent in 2022. Attached is the progress report for the first three quarters of 2022.

College Decision:

  1. To agree to the contents of the attached quarterly report Taskforce Social Domain Q3 2022.
  2. Forward these to the council by means of a RIB. If the council sees fit, it may decide to put them on the agenda for substantive discussion
  3. Instead of updating the college monthly on the progress of Task Force SD, adjust the frequency to quarterly.

Advisory note Light mast advertising

On Oct. 25, this advisory note was held. In consultation with the Alderman , the advisory memo was amended. In 2011, a concession agreement was tendered to operate light pole advertising in the municipality for 10 years. At that time, the company NPB Media was awarded the concession for a term of 10 years. The term was subsequently extended twice by one year and expires after Dec. 31, 2022. At the start of the contract, there were 40 light pole advertisements present in the municipality and during the term, the enthusiasm decreased and fell to 17. The expiration of the contract now provides the opportunity, in accordance with the contract, to have all light pole advertisements removed. A new contract for lamppost advertising can then be drawn up and put on the market according to the procurement law. What procedure to follow for this will be further investigated.

College Decision:

  1. To terminate the 2011-33 contract and the agreed extensions in accordance with the contract;
  2. Marketing a new contract for light pole advertising in accordance with the procurement law;
  3. To inform business owners with current contracts of this decision.
