Board proposal art. 36 questions 2025.36.010 by DGG on Architectural state of monument 't Vossenhol

DGG asks ex art. 36 RvO some questions about the monument 't Vossenhol. This monument has fallen into disrepair. DGG wonders how it could have come this far, and what can still be saved.

The college decides to answer the questions as per the attached proposal.

Advisory note self-build lots Luchen 3a

The different sub-areas of Luchen have taken into account the need for self-build plots. The moment at which these self-build plots are offered on the market depends on various factors. For example, the zoning plan must have been adopted, infrastructure must have been built and coordination must have taken place with the construction work/planning for project-based construction should this also be the case in the same area. 

For 13 building lots in Luchen 3a these Requirements are now met. Plot passports have been prepared which describe for each plot which Requirements must be met and which building possibilities are available (based on the zoning plan and image quality plan). The proposal is to sell the plots on the basis of a registration procedure. If there are several interested parties per plot, a draw will be made by a notary.

The college decides:
1. To put on sale the 13 self-build plots in subarea Luchen 3a, as shown on the plot map (Appendix 1).
2. To use the plot passports (Appendix 2) in the sale of the 13 plots.
3. To use the proposed issuance procedure (Appendix 3) in the sale of the 13 lots.

Advisory note on changes to green maintenance contracts by work companiesShow

Since January 1, 2019, social work company Senzer and social work company Ergon ( hereinafter referred to as Senzer and Ergon) take care of the total green maintenance in the municipality of Geldrop-Mierlo. Both companies account for an equal share of the area. The contract was for 4 years with 3 times an extension of 2 years by mutual agreement. As of January 1, 2025 Ergon will take care of the total maintenance of the public green space.

The college decides:
- To agree to the attached memo.
- To forward this memo to the council.

Draft 2026 program budget GGD Brabant-Zuidoost

The General Board (AB) of the Common Scheme (GR) GGD Brabant-Zuidoost has sent its draft program budget for 2026. In accordance with Article 35 of the Act on Joint Schemes and pursuant to Article 36 of the Joint Scheme GGD Brabant-Zuidoost, the municipal council is given the opportunity to express its views on this program budget. Also, the financial consequences of the draft program budget 2026 should be included in the multi-year budget 2026-2029 of the municipality of Geldrop-Mierlo.

The college decides:
1. To take note of the draft program budget 2026 GGD Brabant-Zuidoost.
2. To agree to process the financial consequences of the draft program budget 2026 GGD Brabant-Zuidoost in the multi-year budget 2026-2029.
3. To agree to forward the council proposal and accompanying view to the committee Samenleving of June 4, 2025, and to that end
4. To agree to send the agenda request to the Society Committee of June 4, 2025.

College proposal RIB quarterly report WBI 1st quarter 2025

We inform the council quarterly on the progress of the Housing Impulse grant through a council information letter. The attached quarterly report covers the 1st quarter 2025.

The college decides:
1. To take note of the attached council information letter and quarterly report;
2. To forward the council information letter with the quarterly report to the council.

College proposal Brabant Post-separation Initiative

Since 2020, the municipalities of 's-Hertogenbosch, Helmond, Meierijstad, Oss and GR Cure (involving Eindhoven, Geldrop-Mierlo and Valkenswaard) have been working together with the province of North Brabant to investigate whether post-separation of household residual waste can contribute to achieving the national waste targets. The final manifestation of the Brabant post-separation initiative is an addendum to the existing standard agreement between Midwaste and its members. The public-public partnership between Midwaste and its members, including GR Cure on behalf of the Municipality of Geldrop-Mierlo, offers advantages in terms of control, policy freedom and social costs compared to a regular tender with one party. Participating municipalities will all submit an advisory note to the same effect at the April 15 council meeting. A council information letter will be sent to all councils on April 16, unless a college has a clear reason to ask its council for an opinion. For Geldrop-Mierlo, an opinion is not an issue, because entering into such a cooperation falls under the responsibility of the GR Cure - thus a RIB suffices.

The college decides:
1. To issue an agreement in principle to GR Cure to enter into the public-public cooperation with Midwaste for the post-separation of household residual waste, to complement the current cooperation for source separation of household residual waste.
2. To send the attached Council information letter on April 16.
3. To authorize the Alderman for Waste to sign the addendum to the existing agreement with Midwaste, which will incorporate the agreements from the agreement sheet, next September.

Advisory note follow-up process closure Bridge Street

By judgment of the District Court of East Brabant of August 23, 2024 on the traffic decision for the closure of Brugstraat of November 10, 2022 (amended December 20, 2022), the decision on the objections of October 24, 2023 to that decision was annulled. The court ordered that - in compliance with its ruling - a new decision be made on the objections. Given that the reason for annulment was that it was insufficiently demonstrated and substantiated whether, despite the increase in traffic movements on Industrieweg and Geldropseweg, an acceptable living and working environment would be guaranteed, the ODZOB was asked to perform additional acoustic research. ODZOB has completed the acoustic research. Based on the further investigation, the required new decision on the objection will be made based on this advice note.
In the further investigation ODZOB has concluded that with this large increase in traffic intensity the required noise level at the residences can no longer be met. Only when the noise increase at the facades of the residences is limited and the noise levels do not exceed the legal limit value can we legally uphold the traffic decision to close the Brugstraat to motorized traffic.

The college decides:
1. To take note of the status of the procedure to close the Brugstraat in Mierlo;
2. To agree with the follow-up process to be able to close the Brugstraat;
3. To agree with the application of the asphalt type ZSA-SD on the Industrieweg and on the Geldropseweg between the traffic circle Industrieweg and the Eindhoven canal;
4. Declare admissible the objections against the decision of November 10, 2022, amended on December 20, 2022, to close the Brugstraat to through traffic (VKB 2022-09) received on November 23, 2022 (2x), December 19, 2022 (3x), December 2022, December 21, 2022 (2x), December 23, 2022 and January 30, 2023, and uphold the contested decision with improvement and addition of the motivation as to the guarantee of an acceptable living and working environment for objectors in accordance with the attached draft decisions;
5. To include the costs for replacing the asphalt Industrieweg in the project for the reconstruction of the traffic circle Brugstraat-Industrieweg and to enter this as one project for the MPB2026-2029;
6. To agree to charge part of the costs (€100,000) to the Operational Maintenance Plan Roads 2024-2025 and to finance from there the replacement of the asphalt of the Geldropseweg between the traffic circle Industrieweg and the Eindhoven canal.

On April 1, 2025, the municipality will again switch to another reporting app: the MijnGemeente app will be replaced by BuitenBeter. Remarkably, the opposite choice was made in 2023, with similar reasoning. This repeated switch raises questions.

The college decides to agree to answer the questions.
