Climate adaptation implementation agenda

We have been preparing a climate adaptation plan and implementation agenda for some time, as prescribed in the Delta Program on Spatial Adaptation. Previously, climate stress tests were made for this purpose, a climate dialogue took place and the level of ambition was coordinated with both the college and the Spatial Planning Committee. Based on this, the climate adaptation plan & implementation agenda 2023 has been finalized so that it can be submitted for adoption.

College Decision:

  1. Agree to the content and ambition level climate adaptation plan & implementation agenda 2023;
  2. To forward the attached council proposal on adoption of Climate Adaptation Plan & Implementation Agenda 2023 to the council.

College proposal RIB Housing ordinance SGE

Since 2016, in the Stedelijk Gebied Eindhoven (SGE) ten corporations and nine municipalities have been working together in the allocation of social housing to urgent housing seekers. The legal basis for this is an identical 'urgency' chapter included by each municipality in the local housing ordinance. The current housing ordinance runs until January 1, 2024, and the regional starting point is to again jointly arrive at an identical housing ordinance with an 'urgency' chapter. In the regional POHO Wonen SGE the attached council information letter has been adopted to be sent to the 9 municipal councils.

College Decision:

  1. To agree to the Council Information Letter Housing Ordinance
  2. To send the Council Information Letter to the City Council.

Advisory note on ambition level Open Government Act

This advice note concerns active disclosure under the Open Government Act (Woo). At this time, it is important to set a level of ambition for this, as the strategy for implementing the Woo largely depends on it.

College Decision:

  1. Agree to ambition level basic (meet legal minimum) for the implementation of the Open Government Act;
  2. To actively inform the council through a council information letter.

Advisory note on granting 2023 Entrepreneurship Fund grant

Stichting Centrummanagement Geldrop and Stichting Centrum- en Lintenmanagement Mierlo have submitted a request for grant Entrepreneur Fund 2023.

College Decision:

  1. To grant Foundation Centrummanagement Geldrop grant of € 90,071
  2. Grant Foundation Center and Ribbon Management Mierlo grant of €41,945

Participation in experimental scheme education-care arrangements

On April 11, 2022, agreement-based consultations (OOGO) took place regarding the Support Plan SWV Helmond-Peelland 2022-2026 . In these consultations, the aldermen for education of the municipalities involved indicated that they had no predominant objections to the adoption of the support plan. The support plan includes 12 spearheads of policy. One of these spearheads concerns a covering supply so that every child has a suitable place and no one is stuck at home for a long time, whereby the ambition of 0 homeless people has been set. In the meeting the municipalities were asked to work together on this spearhead since there is a clear link with the deployment of youth aid for which the municipalities are responsible. This cooperation resulted in the desire to submit an application to the Ministry of Education, Culture and Science (OCW) and the Ministry of Social Affairs and Employment (SZW) within the framework of the Experimental Arrangements for Educational Care. In order to make this application, an agreement of the municipalities is needed by signing a declaration of intent. This recommendation discusses the application and the signing of the declaration of intent in more detail.

College Decision:

  1. To agree to the signing of the declaration of intent With Each Other for Every Child, because every child has a right to education between municipalities from the Helmond-Peelland PO (SWV) cooperation region, the SWV PO, the SWV VO, the care office, educational boards and care providers;
  2. Authorize the Alderman Education and the Alderman Youth to sign the Memorandum of Understanding on behalf of the College of Mayor and Alderman .

Advisory note Amending Terms of Reference for Program Manager A 10 for Youth v3

The authority scheme of the program manager A 10 for Youth should be amended, this advisory note argues for and regulates that change.

The college decides to approve the attached amendment decision.

D66 submitted questions to the college based on Article 36 about the new national initiative RefugeeWork. Please read the questions and answers attached.

Council proposal view budget 2023 MRE

On March 1, 2023, the General Board of the Eindhoven Metropolitan Region (MRE) will discuss the MRE 2023-2026 cooperation agreement. The Executive Board of the MRE will now first submit the draft agreement to the councils of the 21 municipalities to give them the opportunity to submit an opinion. An opinion has been prepared for presentation to the council on February 6, 2023.
The college decides to adopt the council proposal on the opinion on the cooperation agreement MRE 2023-2026.

Advisory note Supervisor legality youth

Within the 10 voor de Jeugd-regio it was decided to appoint a supervisor of youth legitimacy. This person will be employed by GR Peelgemeenten, but will work for the entire 10 for Youth region. A legal basis is needed to appoint a youth supervisor. The Youth Act does not provide for this, and means that a legal basis must be provided by amending the Youth Assistance Ordinance. With this legal basis, it is then possible, and practically necessary, to mandate the General Director of Peelgemeenten to appoint a supervisor.

The College decides:
1. To agree to the proposal to amend the Youth Assistance Regulations retroactively as of October 1, 2022 as proposed.
2. To agree with the proposal to grant the General Director of Peelgemeenten the mandate to appoint supervisors Youth with effect from October 1, 2022 and to issue and sign the proof of identity for the supervisor.

Advisory note on grants to professional organizations 2023

By means of this advisory note, we ask to approve the proposed subsidy amounts for the year 2023 to Basic Library Dommeldal, Stichting Landgoed Kasteel Geldrop, Stichting De Wiele, Stichting Kunstkwartier, MFA Mierlo and Stichting LEV-group. The subsidies to Stichting Weeffabriek (Hofdael) and Laco are not part of this advisory note. The advice memorandum and Appendix 1 explain why this is the case and what the next steps are. These grants are before the Board for decision because the Board must agree to the grants to eight professional organizations since 2022: Basic Library Dommeldal, Stichting MFA Mierlo, Stichting Landgoed Kasteel Geldrop, Hofdael, Stichting De Wiele, Stichting Kunstkwartier, Stichting LEV-group, Laco. This is because in 2021 the mandate regulation was changed for this purpose. For professional organizaties not mentioned in this proposal, the mandate lies with the Department Manager of Society.

Advisory Note Day Care Behind the Mill

Residents Jeanne and Anton have come up with the initiative (bottom up) to expand their catering company at Elderse Molen 8 in Mierlo into a day experience with a social purpose in the supporting field. This initiative is in line with developments within the Social Domain including creating more supply, near home, in the supporting field. From a spatial perspective it requires an exemption. To actually realize the initiative it is important that the college agrees to an exemption regarding the permit, with an exemption from the use provisions of the current zoning plan and the granting of a subsidy to the relevant party.

College Decision:

  1. To approve the initiative and the necessary grant of an exemption to the permit for it and to grant a waiver of the use provisions within the current zoning plan.
  2. Agree to grant €80,500 subsidy to day experience 'Behind the Mill' for the year 2023 and 2024, to be forgiven from the budget for preliminary facilities WMO (FCL 6610013 / ECL 43600).

Advisory note Subsidy scheme compensation energy tariffs social organizations Geldrop-Mierlo

On Dec. 12, the council approved the council proposal "Measurement of Purchasing Power Loss." This advice includes a sum of €300,000 for compensating civil society organizations for rising energy bills due to rising tariffs. As an elaboration of the "Maatwerkaanpak koopkrachtverlies" this subsidy scheme "compensation scheme energy tariffs social organizations" has been drawn up.

College Decision:

  1. To adopt the subsidy scheme "compensation scheme for energy tariffs for civil society organizations" for compensation of energy tariffs for civil society organizations.
  2. Start the application process on January 1, 2023.
  3. To establish the validity of arrangement over the period from October 1, 2022 to March 31, 2023, with the possibility of extension through a new College resolution until no later than December 31, 2023.

Advisory note establishing program sustainability

Much is happening in the field of sustainability. These new developments require an update of the municipal sustainability policy. Therefore, we have prepared a sustainability program. This program seeks to connect to the most recent national goals and the Vision of Geldrop-Mierlo 2040. This program details what we will do in the next four years to stay on track to achieve our sustainability ambitions for 2040 and 2050.

College Decision:

  1. Agree to the attached sustainability program
  2. To agree to the attached council proposal
  3. To present these to the council for adoption
  4. To include the estimated budget and capacity requirements in the 2024-2027 Framework Memorandum

Service Agreement Villagemarketing Geldrop-Mierlo

The service agreement (DVO) of the Villa Marketing Foundation (SVM) has been amended. We want this agreement to take effect from January 1, 2023 for the duration of 4 years. With this adjustment, the 

Foundation ensure greater continuity and, in doing so, has prepared an appropriate 2023-2026 policy plan that reflects its ambitions.

College Decision:

  1. To approve the amended Service Agreement for the Village Marketing Foundation;
  2. Grant mandate to the Departmental Space Manager to amend, in writing, Appendix 1.3 during the term of the Service Agreement, insofar as such amendments are to add new objects or remove objects;
  3. Agree to the updated bylaws of the Villagemarketing Foundation;
  4. To approve the 2023-2026 Village Marketing Policy Plan.

Renew administrative agreements and mandate Protected Housing 2023

Cooperation in the region in the field of Protected Housing should be continued for the calendar year 2023, due to the delayed decentralization. It is proposed to adopt updated administrative agreements and mandates. The update is very slightly different from the current administrative agreements and mandates and are both in line with the regional vision adopted by the council. Updating has taken place on the themes of governance, implementation program, financing, access and innovation.

The college decides to approve:

  1. Extension of the updated Administrative Agreements Protected Housing (BW) until January 1, 2024.
  2. The extension and adjustment of associated mandate for Protected Housing and Reception to the Municipality of Eindhoven, in accordance with the attached draft municipal bulletin.

Advisory note B&W amendment decision environmental permit office building Emopad 9

An objection was filed by the Mill Foundation to a permit for an office building at Emopad 9 due to a violation of the "Mill Protection Zone" double zoning. The permit holder has agreed with the Molenstichting to modify the building plan to accommodate the objection. Licensee has submitted a new building plan. This requires a modification decision. After modification, the Mill Foundation is willing to withdraw the objection.

College Decision:

  1. Amend the decision granting environmental permit (17711111355) in accordance with the attached amending decision;
  2. Thereby drawing the permit holder's attention to the high archaeological expectation value of the lands of this business park;
  3. To publish the amendment decision;
  4. Inform the Mill Foundation;
  5. To inform the Objections Committee.

Advisory note memo press contacts

As a municipality, we want to communicate more actively and differently. This means that in the process of making a decision, explicit consideration is given to who, why and how communication is taken up in order to then be able to set out targeted actions/press moments after the proposals are adopted.
Since corona, both formal and informal contacts with the press have decreased. We see each other less, therefore there is less connection and the press looks for new ways to get information. Directors say they miss the connection and the structured contacts. Our media contacts also have this need. With the actions in this memo we want to improve the connection and cooperation with the press.

College Decision:

  2. Agree to the guidelines/agreements in the memo.

Advisory note on environmental vision for Geldrop-Mierlo

The Municipality of Geldrop-Mierlo is working on the Environment Vision Geldrop-Mierlo in preparation for the Omgevingswet. The draft environmental vision has been available for inspection and an opinion has been received on the Plan EIA. With this proposal, the environmental vision and the note of views are submitted for decision-making.

College Decision:

  1. To agree to the Notice of Views.
  2. To submit the Geldrop-Mierlo Environmental Vision to the council for adoption
  3. Send the calendar request
  4. To inform the council of the EIA Committee's opinion and our response via the attached information letter.
  5. Advise the council to maintain Chapters 7 and 8 of the Structure Vision of the Municipality of Geldrop-Mierlo until the Land Policy and Cost Recovery Program takes effect.
