Advisory note adopting Environmental Noise Directive 4th tranche END noise maps

Based on the EU Environmental Noise Directive, the municipality of Geldrop-Mierlo, as part of the Eindhoven agglomeration, must draw up noise maps every 5 years. An action plan must be made based on these Maps . The goal of the action plan is to reduce the number of noise annoyed people within our municipality.

College Decision:

  1. Adopt the END noise maps dated June 2022 and tables showing number of dwellings per noise class. This section is referred to as "Implementation Mapping".
  2. To make the Maps and Tables available for inspection at the town hall and digitally available via the website of the Omgevingsdienst Zuidoost-Brabant (ODZOB) and the municipality's own website;
  3. To agree to the delivery of the noise maps and tables through ODZOB to the central facilities noise data (cvgg) through chain mandating and e-recognition.
  4. Publish the submission for public inspection in the Middle Class Interests, through the municipal website and on the officialnotices.com website

Advisory note cooperation covid monument

This proposal was modified after its initial consideration by the college on August 30, 2022. A number 1.2 has been added in the argumentation. An annex has also been added, which includes the requested clarification of lines of thought and preconditions. Applicant has an idea and asks for cooperation in the placement of a covid related monument centered on gathering. His preference is for a place in the woods between Geldrop and Mierlo, for example at the Katoenpad. The monument is not so much intended to commemorate Covid as a disease but more to reflect on the lack of contact with others during that period. Connection and invitation to come together is its central theme. That place should be suitable for meetings, commemorations or gatherings with small groups. Where it is possible to meet while enjoying some (brought) drinks. The intention is for the monument to be designed by a young local artist/designer. To realize this place, he wants to set up a crowdfunding campaign through the Kommus Foundation. For this he has already contacted financial parties in Geldrop-Mierlo, Gemini and VillageMarketing. Applicant would first like to know if cooperation is possible before proceeding further in the process.

College Decision:

  1. cooperate with this request in principle;
  2. Agree to the directions of thought and preconditions (in Appendix 3), which we will give to initiator.

Fixing grants for professional organizations 2021

Every year, the municipality of Geldrop-Mierlo provides a subsidy to various professional organizations that dedicate themselves to society. Think for example of the Basic Library Dommeldal, the LEV group, Stichting Landgoed Kasteel Geldrop, etc.. Through the attached memo we inform you about the professionalization of these subsidies and the determination of these subsidies to the professional organizations for the subsidy year 2021.

The college decides to take note of the content of the attached memo "determination of grants professional organizations 2021".

Advisory note on auditor's report on determination of grants to professional organizations

Every year, the municipality of Geldrop-Mierlo provides a subsidy to various social organizations that dedicate themselves to society. Think for example of the Basic Library Dommeldal, the LEV group or Stichting Landgoed Kasteel Geldrop. Part of the annual subsidy process is that the municipality of Geldrop-Mierlo receives an account of the social organization in the year following the end of a subsidy year. Part of this justification, for annual grants of €50,000 or more per year, includes an auditor's report. Practice has shown that in many cases this obligation to submit an auditor's report is not included in the decision to grant social organizations. The aim is to include this in all decisions to CSOs from the 2023 grant year for grants of €50,000 or more per year. There are different types of audit reports. Officially a classification has been made for which grant amount we want to include which type of auditor's report as an obligation in the grant decision. By means of this advice memorandum we further explain this classification and ask the board to approve it.

College Decision:

  1. To agree to the requirement to submit an auditor's review report with the application to establish annual grants between €50,000 - €100,000.

Procurement strategy "Digital legal knowledge base"

To work well you need good tools, such as Municipal Law, Construction Law and Text & Commentary. Especially with the arrival of various new legislation, such as Omgevingswet and Open Government Act, it is important to be and stay well informed. This is why a one-year trial subscription to Kluwer Navigator/Public Intelligence was taken out in December 2021. This is a digital legal database where complete and up-to-date information on legislation, case law and professional literature can be found centrally. We are currently investigating whether the trial subscription can be converted into a multi-year subscription. To this end, we are participating in a joint purchasing process with six other parties under the direction of Bizob. Part of this process is the establishment of a Purchasing Strategy. The adoption and signing of this procurement strategy does not commit us to anything yet. It is only a formal 'go' for the start of the procedure but is necessary to ultimately make a decision whether or not to conclude a framework agreement with Kluwer.

College Decision:

  1. To approve the Procurement Strategy Digital Legal Knowledge Base and have it signed by the City Clerk;
  2. To authorize the legal controller to review and adopt procurement documents such as the Notice of Inquiry;
  3. Authorize the City Clerk to adopt and sign the award recommendation;
  4. Authorize the corporate buyer of Bizob to sign the award and rejection letters;
  5. Request the Mayor to grant power of attorney to the City Clerk to sign any framework agreement.

Advisory note Recalibrating budget task force on social domain

In order to achieve a robust and future-proof balanced budget task force social domain, it is proposed to recalibrate the system of the task force and extend it until 2029. This will minimize fluctuations and deficits and make the task force project less vulnerable.

The college decides to approve the attached council proposal; proposing that the council:

  1. Agree to continue to operate the task force under the direction of the college.
  2. Agree to achieve the target in 2028 instead of 2023.
  3. Agree to expand the existing program lines with new projects to meet the mission statement.
  4. Agree to add state contributions for social domain to the regular operation and no longer to the equalization reserve.
  5. Agree that the budget may be adjusted to accommodate organic growth or to allow college or council proposals to be implemented.
  6. Agree to index the budget beginning in 2022.
  7. Agree not to retroactively correct the indexation in the budget.
  8. To agree to eliminate the equalization reserve for social domain.
  9. To agree to deposit the amount by which the (budget) balance of the 2022 budget improves into the general reserve.
  10. To this end, adopt the 10th Budget Amendment 2022.
  11. Reflect the structural impact of the above directly in the 2023-2026 MPB.

College proposal energy surcharge part 2

The energy surcharge is an allowance for additional energy costs in 2022. The government has advised setting the amount of the one-time energy surcharge at €800 per household. This has now been paid to a large part of the entitled households in Geldrop- Mierlo. On July 5 last, the Cabinet decided to increase the energy surcharge one more time by € 500,- (total now € 1,300,- per household).

College Decision:

  1. On the basis of the Beleidsregels Eenmalige energietoeslag Geldrop- Mierlo 2022 and in anticipation of adoption of the 2nd turap, to proceed in mid-September to automatically pay out the one-time energy allowance part 2, being € 500,- and to cover a total of € 750,000,- (1500 minima households (known to the municipality from granted energy allowance part 1) x € 500,- from the September Circular;
  2. Determine that the process of individual applications for energy allowance will continue, however, individual applications assessed after September 8, 2022 will immediately receive the full amount of energy allowance a €1,300.
  3. Determine that if applicant is not eligible for a one-time energy allowance, but the hardship clause applies, it may still be assessed in the individual case that applicant is eligible for a one-time energy allowance;
  4. To agree to the attached council information letter;
  5. To forward these to the council through the Municipal Clerk’s Office .

Advisory Note A Future-Friendly Weaving Museum September 2022

The Weaving Museum has the ambition to professionalize the museum's business operations and underlines in the various conversations and agreements about this that municipal support in these ambitions, is necessary and expected in order to secure the future of the museum.Both administratively and officially, the municipality generally supports the museum's plea to professionalize business operations. The municipality has always ventilated this attitude towards the museum. However, the municipality is of the opinion that an important intermediate step must first be taken in order to actually be able to release such financial contributions from the municipality. We must be able to determine at what level we want to sustainably retain a Weaving Museum for our municipality. The decision-making bodies in the municipality need to be convinced with good analyses and plans and this needs to be worked on initially and as a priority. At this stage, business operations should also be supported in their daily work, as an urgency has arisen there recently. The budget right lies with the council. Therefore, this council proposal is before the college for approval.

College Decision:

  1. Agree to the council proposal 'A Future-proof Weaving Museum: drafting business plan and temporary business operation' which proposes to: Agree to the preparation of the business plan and temporary management: 'A Future-proof Weaving Museum'. To charge the costs of € 50,000 to the budget balance 2022.c)To agree to the 11th budget amendment 2022.
  2. Forward the council proposal (and council decision) to the City Council for (judgmental) discussion in the Society Committee Oct. 4, 2022 (incl. agenda request Society Committee) and adoption at the council meeting Oct. 17, 2022.
