Advisory note establishing tightened frameworks Center Impulse Geldrop

Several decisions have now been made about the Center Impulse Geldrop. Nevertheless, there are still more choices to be made. These include choices about housing numbers, locations, parking, climate adaptation and other space users such as events and greenery.

The College decides:
1. To approve the attached council proposal (incl. attachment);
2. To forward the council proposal to the City Council.

Advisory note Vasstelling zoning plan Bezorgershof

Within the framework of Centrumimpuls Geldrop (CIG), the council established spatial frameworks for the future (housing) development around the Bezorgershof in Geldrop in 2022. These frameworks must be legally translated into a zoning plan. In order to prevent undesirable developments during the zoning plan procedure, the council adopted a preparatory decision (again) on May 31, 2023. Following this, a draft zoning plan was put into the procedure in December 2023. The zoning plan is now ready for adoption.

The college decides:
1. To approve the proposed response to the views.
2. To request the council to adopt the zoning plan 'Bezorgershof Geldrop' as amended.
3. To request the council to adopt the 'Bezorgershof Image Quality Plan' for the grounds around Bezorgershof ('inner ring').

Advisory note adopting post office site structure vision

Ideas about the redevelopment of the post office location in Geldrop have been around since 2006. In recent years, following the adoption of the 'development vision Geldrop Centrum' and the granting of the housing incentive subsidy, the plan development for this location has gained momentum. Among other things, the subsidy award and the housing challenge was reason for your council to establish a preferential right, in accordance with the Municipal Preferential Rights Act (hereinafter WVG) on the land in this area in 2021. In order to perpetuate the WVG, it is necessary to adopt a structural vision within 3 years of the establishment of the WVG. This outlines the development direction of the area in question.

The college decides:
1. To agree to the note of views.
2. To agree with the council proposal.

Advisory note Vasstelling zoning plan

On July 11, 2022, the council adopted the Mierloseweg 40 zoning plan. The plan provides for the new construction of an apartment building with 40 homes. On May 31, 2023, the administrative law department of the Council of State annulled the zoning plan. A new zoning plan is necessary to still make the development (planologically) possible. The new zoning plan procedure was started at the end of last year. The zoning plan is now ready for adoption.

The college decides:
1. To approve the proposed response to the views.
2. To request the council to adopt the zoning plan 'Mierloseweg 40 Geldrop' as amended.
3. To request the council to adopt the 'Image Quality Plan Bleekvelden' for the planning area.
4. To establish higher limit values for the plan pursuant to Article 83 of the Noise Abatement Act.

Advisory note college proposal Privacy policy development and repeal Privacy Ordinance 2016

On December 29, 2015, the Regulation Privacy Gemeente Geldrop-Mierlo 2016 (see https://lokaleregelgeving.overheid.nl/CVDR406015 ) was adopted by our Council. However, since May 25, 2018, the General Data Protection Regulation (hereinafter: AVG) applies throughout Europe, with more responsibilities for organizations that process personal data and with more rights for people whose data are processed.
In the Privacy Policy elaboration, B&W, as the person responsible for the protection of all municipal processing of personal data, indicates how the AVG and the Police Data Act (hereinafter: Wpg) will be implemented. This also allows the municipality to offer transparency to all people whose personal data it processes.
Simultaneously with the adoption of the Privacy Policy elaboration, the Privacy Ordinance 2016 should be repealed.

College Decision:

  1. Adopt the Privacy Policy Update;
  2. To submit to the Council to adopt the Ordinance Privacy Municipal

Geldrop-Mierlo 2016 to repeal.

Advisory note Adoption of zoning plan

A landscaping company is located on the former cattle farm site at Heiderschoor 10 in Mierlo. The business activities conflict with the current agricultural zoning. The owners of the location have therefore previously requested to legalize the existing situation. Your college has previously decided to cooperate with the necessary zoning revision. The initiators had a zoning plan prepared for this purpose. The draft zoning plan was available for public inspection for 6 weeks starting December 22, 2023. No views were submitted.

The college decides to request the council to adopt the zoning plan "Heiderschoor 10 in Mierlo" with plan identification number NL.IMRO.1771.BPHeiderschoor10-VA01 unchanged.

College proposal set up periodic hot spot monitor

Our municipality has already gained experience in naming a hot spot, namely over corona. Now we are taking follow-up steps to structurally secure the process by developing a true hotspot monitor.

Since 2017, municipalities have had to work with the hot spot monitor. One of the Critical Performance Indicators from the Archive and Information Management Improvement Plan 2023-2024 about setting up a hotspot monitor.

The college decides to proceed with the implementation of the hot spot monitor.

College proposal policy abuse and improper use

With the introduction of legitimacy accounting, the college accounts for, among other things, the abuse and improper use (m&o) criterion. The policy concerns the prevention of abuse and improper use of municipal property and financial arrangements. The BBV committee recommends an overarching policy for these management measures.

The college decides to adopt the abuse and improper use policy.

Board proposal Council information letter youth events

On January 30, 2024, the Board of B&W decided to financially support 2 parties that will start organizing 2 new events for young people this year. The objectives agreement 2022-2026 asked for new events for young people and, after extensive participation, two event plans were submitted. Through this council information letter we inform the council about these events.

The college decides to approve this council information letter.

Advisory note on appointment of secretaries Objections and Complaints Committee

The municipality of Geldrop-Mierlo uses an independent committee to advise on objections and complaints. This committee is supported by secretaries. They are currently not formally appointed as secretaries. However, in accordance with the Regulation on Objections and Complaints Committee, this must be done.

The college decides:
1. With retroactive effect from the date of commencement of employment, to appoint the persons nominated for that purpose as listed in the attached designation decision, as secretary of the Objects and Complaints Committee Geldrop-Mierlo.
2. To appoint, with retroactive effect as of the date of commencement of employment, the persons nominated for that purpose as stated in the attached designation decision, as deputy secretary of the Objects and Complaints Committee Geldrop-Mierlo.
3. To provide that the designation shall lapse by operation of law at the time the designated person's work for the Municipality of Geldrop-Mierlo ends.

DPM asked Article 36 questions about the future of the hospitality area of Sporthal de Weijer in Mierlo.

The college decides to approve the answers to art 36 follow-up questions from DPM on future hospitality of sports hall de Weijer and to send them via the Municipal Clerk’s Office to council members.

Business plan Regional Work Center labor market region Helmond-De Peel

In the labor market region of Helmond-De Peel, we are working from a joint perspective on a future-proof and sustainable labor market. To this end, the regional labor market plan 2023-2027 was adopted in 2023. One of the ambitions in this plan is the realization of a (more) integral and decompartmentalized labor market service to residents and employers in the form of a Regional Work Center (hereafter: RWC). This ambition of the labor market region is in line with the national developments surrounding the reform of the labor market infrastructure. Thus, at the national level, the aim is to have a Regional Work Center for each labor market region. With this business plan a first basis is laid for the RWC labor market region Helmond-De Peel.

The college decides:
1. To approve the business plan for the Regional Work Center Helmond-De Peel.
2. To inform the city council with the attached council information letter.

Cover sheet college proposal white goods regulation

As part of the reducing energy costs/energy poverty project, a temporary white goods scheme is proposed to allow residents to replace their "energy-guzzling" white goods with an energy-efficient appliance. This white goods scheme is part of the reducing energy costs project. After the white goods scheme is realized, we will give substance to other parts of the energy poverty approach, such as the door-to-door approach with small energy-saving measures.

The College decides:
1. To agree with the Policy Rules on the Provision of White Goods Geldrop-Mierlo 2024
2. To agree to the automatic granting, by means of the attached concept letter signed by Alderman Stravers and Alderman Looijmans, of Green Vouchers to the intended target group on the basis of the Policy Rules on the Provision of White Goods Geldrop-Mierlo 2024, being €450, - including VAT per item
3. Approve the costs of € 324,000 ((€ 450 x 720 households) and charge them to the SPUK Approach to Energy Poverty (project number 40107)
4. Adopt the implementation agreements with Van de Weijer and EP excellent Mierlo that are part of the grant decision
5. To approve the attached council information letter and place it in the hands of the Municipal Clerk’s Office for forwarding to the council.

Advisory note on land prices 2024

The land policy states that we annually submit the land prices to you for determination.
The valuation reports have been prepared by Stec Groep for Geldrop-Mierlo and we hereby submit them to you for approval.

The college decides to approve:
1. To use the current land prices per m2 excluding VAT as described below in option/purchase agreements in accordance with appraisals
2. To continue the working method for the additions and deductions to be applied, whereby:
a. Surcharges of 5 to 20% will apply for plots with a free location to the front, side or rear or a good orientation of the plots;
b. A graduated scale applies from:
i. 500 sq. m. for lots for detached houses (every 100 sq. m. 10% reduction); ii. 300 sq. m. for semi-detached houses (every 50 sq. m. 10% decrease);
iii. 160 m² for row houses (every 25 m² 5% decrease).
3. Set the land price for ground-level social rental housing at €280 per m².
4. For land prices for houses in the rental sector to apply a reduction compared to the owner-occupied sector of:
a. 10% for middle rental (with a maximum rent sum up to € 1123.13);
b. 0% for expensive rental.
5. To use the following rates for land prices for the various business plots;
a. Spaarpot Zuid € 195,- per m²;
b. Emopad € 185 per m²;
c. Beehive € 210 per m².
6. To apply the following rates for unregistered land use:
a. € 139.- per m² for ground strips at the side or rear of the dwelling up to a total plot size of 1000 m²;
b. € 89.- per m² for ground strips at the side or rear of the dwelling when the total plot size exceeds 1000 m²;
c. € 89.- per m² for ground strips in front of the building line with the exception of the driveway;
d. € 39.- per m² for land strips used as driveways.

Advisory note Regional Mobility Vision

Over the past period, regional work has been done to prepare the draft Regional Mobility Vision. The Regional Mobility Vision presents the joint picture of mobility in 2040. Thanks to this image, we can jointly determine what the 21 regional municipalities should focus on to keep the region livable and accessible. The purpose of this proposal is to collect reactions to the Regional Mobility Vision from the various municipalities, so that a decision can be taken before the summer of 2024 about the adoption of the final vision document.

The college decides:
1. To take note of the draft Regional Mobility Vision.
2. To forward the Regional Mobility Vision, for the purpose of wishes and objections, to the Committee on Spatial Planning.
3. To propose to the Rimte Committee not to submit any wishes and objections.

Gymnasiums Strabrecht College

n the council of Sept. 25, 2023, the request of two new gymnasiums was rejected by the council and the assignment to Silfo was to renovate the gymnasiums 4 and 5 according to previous agreement. In early November 2023, Silfo informed the council that renovation of the current gymnasiums to today's requirements was not financially feasible for them. According to Silfo, a contribution from the municipality is necessary for this.

To assess Silfo's request in line with the council, we took several steps. We listed all the decisions in the process from 2018 to the present. We have had an external independent review of the renovation proposal submitted by Silfo. We have had the previously made agreements regarding the renovation included in the analysis.

The College decides:
1. To capitalize the amount of €1,718,717.- as assets owned by third parties and account for it on the balance sheet as intangible fixed assets.
2. To set the depreciation period on the investment owned by third parties to be capitalized at 25 years.
3. To this end, adopt the 3rd Budget Amendment 2024.
