Advisory note to RV view draft budget 2024 and 1st budget amendment 2023 VRBZO

Pursuant to the Joint Regulation Security Region Brabant-Zuidoost, the councils of the participating municipalities are given the opportunity to express their views on the draft budget and/or a budget amendment with consequences for the financial contribution of municipalities, before the General Board adopts the budget or amendment thereof. The draft budget 2024 VRBZO and the 1st budget amendment 2023 were sent to the councils on March 20 for these views.

The college decides to approve the council proposal view draft budget 2024 and 1st budget amendment 2023 VRBZO, in which the following decision points are presented to the council:

  1. To take note of the draft budget 2024 and the 1st budget amendment 2023 of Veiligheidsregio Brabant-Zuidoost;
  2. To agree not to submit an opinion and to inform Veiligheidsregio Brabant-Zuidoost with the enclosed letter;
  3. To incorporate the financial consequences in the framework memorandum 2024-2027 and the 1st interim report 2023 of the Municipality of Geldrop-Mierlo.

Advisory note draft resolution VRBZO participation in Safety Regions Guarantee Fund Foundation

For all 25 security regions, a national Safety Regions Risk Management and Insurance Foundation will be established from the national project. As was the case for participation in the Risk Management Foundation for Safety Regions in 2022, the municipal councils will be given the opportunity to make known any wishes and objections regarding the representation of the public interest to be served thereby of participation in this foundation (Section 31a of the Act on Joint Arrangements).

The college decides to submit the council proposal Draft decision VRBZO participation in Foundation Guarantee Fund Safety Regions, containing the following decision points, to the council for decision:

  1. To take note of the draft decision Security Region Brabant-Zuidoost to participate in the Security Regions Guarantee Fund Foundation;
  2. To make no wishes and objections known to the General Board VRBZO.

Advisory note on updating APV 2023

Due to new developments, it is desirable to update the APV.

The College decides:
1. To adopt the council proposal and place it on the agenda for the November 2023 council cycle.
2. To propose to the council that the APV 2022, last amended by council resolution of June 7, 2022, be repealed from the date the APV 2023 takes effect.

Advice note college_view work program 2023-2024 and budget 2024_1.1

The executive board of the MRE cooperation gives the councils the opportunity to express their views on the MRE 2023-2024 work program and the MRE 2024 budget. It is customary for the college to submit a draft opinion to the council, which the council can modify or supplement as it sees fit. It is proposed to the college to submit the prepared council proposal including the elaborated draft opinion to the council. The college decides to agree with the submission to the council of the council proposal "draft view MRE work program 2023-2024 / budget MRE 2024".

You have before you the revised budget 2023, draft budget 2024 and multi-year estimate 2025-2027 of ODZOB. The sending of these documents gives the council the opportunity to express any views on this draft budget by June 8, before the General Board adopts this budget.

The College decides:
1. To agree to the attached council proposal, with the following decision points:
a. To agree with the revised budget 2023 of ODZOB and not to submit a view.
b. To agree with the draft budget 2024 and multi-year estimate 2025-2027 of ODZOB and not to submit an opinion.
c. To agree with the draft letter drawn up and to send it to ODZOB.
d. To incorporate the financial consequences in the first turap 2023 and the multi-year budget 2024-2027 of the Municipality of Geldrop-Mierlo.
2. To forward the council proposal to your council.

Advisory note self-tasking

During discussion of the council proposal for extra budget for the Incentive Loan for Sustainability, a motion was passed to also make self-help possible with the Incentive Loan for Sustainability. This proposal is about elaborating on that, about updating the Regulation and about saving on administrative effort for implementation.

The College decides:
1. To approve the Sustainability Incentive Loan Ordinance 2023 (see attachment) repealing the Sustainability Incentive Loan Ordinance 2016 (see attachment).
2. To agree to the attached council proposal and forward it to your council.
3. To agree to the attached agenda request.
4. To agree to sign Annex 5 of the SVn Participant Agreement on the declaration process (see attachment).
5. To agree to the power of attorney decision on Sustainability Incentive Loan (see attachment).

Advisory Note Action Plan on Socially Responsible Contracting and Procurement

The municipality has signed the national Manifesto for Socially Responsible Contracting and Purchasing 2022-2025. Therefore, the municipality has created a new Socially Responsible Contracting and Purchasing action plan.

The College decides:
1. To approve the Socially Responsible Contracting and Procurement Action Plan.

2. Agree to the attached council information letter and forward it to your council.

3. To approve the attached agenda request and to give the attached presentation to the Council Space Committee.
4. To allow the agenda committee to choose between forwarding the RIB or giving a presentation.

Annual Report 2022 Geldrop-Mierlo

Herewith we offer you the auditor's version of the Annual Report 2022 Geldrop-Mierlo. This shows a preliminary result of € 4,104,045, of which € 4,660,419 relates to the general service and € -/- 556,374 to the land operations. On the basis of these annual documents, the auditor began the audit work on April 11.

The College decides:
1. To note the auditor's version of the 2022 Annual Report.
2. To take cognizance of the preliminary result of € 4,104,045, of which € 4,660,419 relates to general services and € -/- 556,374 to land operations.
3. To take note of the provisional allocation of results, as described on page 5 of the booklet.
4. To agree to the release of the 2022 annual accounts for the purpose of the audit.
5. To agree to send the auditor's version of the Annual Chapters 2022 to the council for information.

Information memo Amending procedures zoning plans

On January 1, 2024, the Omgevingswet will take effect. This will affect how we as a municipality provide planning cooperation for spatial developments. Currently, this is usually done by adopting/revising a zoning plan, but starting next year this will no longer be possible.

Situation from Jan. 1, 2024:
From Jan. 1, two tracks are possible for planning cooperation:
- the environmental plan is amended or
- via a so-called out-of-plan environment plan activity (Bopa), deviation from the (temporary) environment plan with an environment permit.

Transitional law
Zoning plans that are submitted for public inspection as drafts before Jan. 1, 2024, can still be processed under current law (Wro) and adopted after Jan. 1, 2024. Initiators with concrete plans can apply for an environmental permit until January 1, 2024.

Impact and necessary preparation
The submission of a draft zoning plan for public inspection is often preceded by lengthy preparation. Usually, we count six months for this. We realize that initiators often estimate the process optimistically. To prevent zoning plans at an advanced stage from still having to be converted into an environmental plan, this means that (new) applications for zoning plan revisions (provided they are complete) can be submitted until no later than July 1, 2023.

As of next July 1, therefore, in principle, no new zoning procedures will be initiated. This does not mean that nothing more is possible: Initiatives that do not involve a change of function can make use of the bopa. Where there is a change of function, initiators can already work out their plans in an environmental plan on the basis of the new Omgevingswet , which can be put into procedure from January 1, 2024.

In all cases we advise initiators to discuss this with us. To inform initiators (residents) about these changes we will publish the attached text on the municipal website and directly in the intake and pre-consultation phase. It is also important that those internally involved, such as project leaders and case managers, are informed.

The college decides that the attached text(proposal) will be published on the municipal website and possibly Middle Class Interests.

Multi-year budget 2024-2027 Dommelvallei Service and 1st budget amendment 2023

This topic was previously discussed at the March 28 college meeting, when the college held the advisory note because it was not clear whether the municipalities are involved in the studies, as described in the introduction to the multi-year budget. It appears that the Service is indeed involving the municipalities in this. Agreements on this will be made with the DB and AB in the near future. We therefore see no reason to submit an opinion. The DB recently decided to adjust the result appropriation of the 2022 DD financial statements. The deposit from the result in the P&O reserve (for the leave reserve) will be cancelled. This will be included in the 1st administrative report 2023 DD. This will increase the deposit into the I&A reserve by €86,000. This leads to € 86,000 (Geldrop-Mierlo share: € 41,280) less being requested from the municipalities in the year 2025. In other words: in the previous version, the deficit of the information plan in year 2025 for Geldrop-Mierlo was € 80,547,- and now becomes € 39,267,- (€ 80,547,-/- € 41,280,-).

The College decides:
1. To approve the 1st Budget Amendment 2023 and Multiyear Budget 2024-2027 of Dienst Dommelvallei.
2. To process the financial consequences of the 1st Budget Amendment 2023 Dommelvallei Service for fiscal year 2023 in the 2nd Interim Report 2023.
3. To incorporate the financial consequences of the 1st Budget Amendment 2023 for fiscal years 2024 and beyond and the Multi-year Budget 2024-2027 Dienst Dommelvallei in the multi-year budget of the Municipality of Geldrop-Mierlo.
4. Not to submit a view to the General Board of Dienst Dommelvallei.

Advisory memorandum Evaluation and follow-up neighborhood DG.

In September 2022, Geldrop-Mierlo started a pilot in cooperation with the GGD to roll out the use of district GGD within the municipality. The pilot runs until May 2023 and aims to: * increase the chance that persons with misunderstood and/or worrisome behavior receive the right form of Health and support in time and to reduce the risk of nuisance and further escalation; * create a safe and livable environment for all inhabitants of Geldrop-Mierlo by early detection, prevention and combating incidents of nuisance by persons with misunderstood and/or worrisome behavior in collaboration with various partners; * through the deployment of the district GGD the most appropriate Health and support offer to residents of the municipality of Geldrop-Mierlo who show misunderstood and / or worrisome behavior and thus reduce the use of police in this target group. The GGD has prepared a process and effect evaluation of the pilot through a combination of qualitative and quantitative data which is attached to this paper as an appendix. The results from this evaluation serve as a foundation for deciding on a possible continuation of the pilot.

The college decides to approve:
1. the process and impact evaluation of the pilot neighborhood DG.
2. to continue the district GGD for a period of three years, from June 1, 2023 to May 31, 2026, as a supplement to the existing range of interventions in the field of prevention and early warning. To this end, to make an annual budget of €100,000 available from the budget Public Mental Health Care (OGGZ, FCL6681001).
3. to commission the GGD to continue the cooperation for the deployment of district GGD and to conclude a service agreement for 3 years, in which the sharing and processing of personal data is also guaranteed.
4. the council information letter and to send it to the council.
5. the draft presentation district-GGD for the Society Committee on May 9 and the agenda request.

Advisory note 'Future Perspective Housing and Health 2023-2040'

At the request of the college, the Future Perspective on Housing and Health 2023-2040 goes to the Space and Society committees for image-forming consideration.

The college decides to approve:
1. The draft Future Perspective Housing and Health 2023-2040 as the first paragraph of the program Space & Housing to be further developed.
2. To forward the council proposal to the Space and Society committees of May 8 and 9, respectively, for image-forming discussion.

Cover page college proposal offer annual program SGE 2023 to council

The colleges within the SGE are asked to present the 2023 annual program to the councils. A basic draft has been provided by the SGE Secretariat for this purpose, which has been modified as needed. A council version of the annual program will become available next week, which can be sent to the council with the attached letter of presentation on behalf of the college. This council version lacks the realization paragraph, names of officials and the overview of plus projects.

The college decides to agree to send the offer letter and annual program SGE 2023 to the council.

Advisory note Agenda request council presentation advisory right delegation and mandatory participation

The omgevingswet will take effect on January 1, 2024. The municipality of Geldrop-Mierlo is preparing for that entry into force. We request a date for a presentation - at the request of the council - about the choices and effects in three decisions, which are necessary in the preparation for the Omgevingswet. The purpose of this meeting is to inform the council. An agenda request was made in February for a presentation on March 13, 2023. Due to circumstances, the item was removed from the agenda.

The College decides:
1. To approve the agenda request.
2. To agree to the presentation.

The college of the municipality of Geldrop-Mierlo accounts for the year 2022 on the state of information security within the municipal organization. This is based on the Unique Standards Single lnformation Audit (= ENSIA) system. ln this document the accountability for DigiD and Suwinet

The College decides:
1. To determine that accountability for DigiD has been provided for the Municipality of Geldrop-Mierlo.
2. To establish that accountability for Suwinet has been rendered for the municipality of Geldrop-Mierlo.

Adopt 2022 annual reports view and first BW 2023 and draft 2024 GGD program budget

The General Board (AB) of the GGD sent the Draft Program Budget 2024 and the 1st Budget Amendment 2023 with a request for the council to express a view on them. Also, the GGD has forwarded annual financial statements adopted by the AB. This proposal proposes that the council express an opinion.

The College decides:
