Advisory note Decision on Objection - order under penalty payment

By decision dated June 1, 2024, an order under penalty was imposed for illegal construction. This decision has been objected to. On the basis of this advice note, this objection will be decided.

The College decides in accordance with the advice of the Objections Committee to declare the objection inadmissible.

Advisory note Renewal DVO Senzer Ukraine and collection of own contribution

Senzer provides living allowance payments to displaced Ukrainians in our labor market region. The Temporary Protection Directive (RTB) under which Ukrainians can reside in EU member states has been extended until March 4, 2026. The Temporary Law on Reception of Displaced Persons Ukraine has been tightened and expanded (including an obligation to contribute to the cost of reception for working adults).
These developments are reason to adjust and extend the Service Agreement with Senzer and start charging a co-payment as of Oct. 1, 2024.

The college decides:
1. To agree to the 'Addendum to the Service Agreement under the Arrangement for the Reception of Displaced Persons Ukraine' with Senzer until March 4, 2026;
2. To agree to pay for the reception of displaced Ukrainians from the state allowances received by the municipality for both the displaced persons in the municipal and private reception;
3. To agree to the 'Policy Rules for the Reception of Displaced Persons Ukraine Geldrop-Mierlo';
4. To agree with the 'Mandate Decision on the Implementation of the Regulation for the Reception of Displaced Persons Ukraine Geldrop-Mierlo';
5. To publish the policy rules and the mandate decision in the usual manner;
6. To agree to the attached draft council information letter 'Collection of own contribution displaced persons Ukraine' and forward it to the Council.

Answering art.36 questions painting railroad tunnel Gijzenrooijseweg

Following the implementation of project "Art Route," DGG has asked Article 36 questions. This advisory note seeks the college's approval to answer the questions after which they can be forwarded to the Municipal Clerk’s Office Office.

The College decides:
1. to agree to answer the Article 36 questions DGG.
2. agree to submit the answers to the Municipal Clerk’s Office for transmission to the council.

Advisory Note Short-Term Measures Package 2.

In the Beethoven Valley, agreements were made in the spring of 2024 between the national government and the Region (province of North Brabant, municipalities and business community). Part of these agreements concerns a package of mobility measures that contribute in the short term to the mobility transition and urbanization task for the entire MRE. This is called the Short-Term Measures Package 2 (KTM2). The details of this KTM2 were drawn up during the past period in cooperation with the 21 municipalities and the province of North Brabant and in coordination with the Ministry of I&W. In the Beethoven Covenant it was agreed to present the details of the KTM2 in the BO-MIRT landsdeel Zuid in autumn 2024.

The college accepted the draft KTM 2 (Short-Term Measures Package 2), part of the Beethoven Deal, for notification.

Board recommends preliminary design redesign of Mayor Verheugt Street

In the multi-year budget, the redesign of Burgemeester Verheugtstraat (road section Santheuvel West - School Street) is scheduled for 2024. Also on the program is a sewer replacement and the realization of an infiltration sewer. In addition, the existing trees urgently need to be replaced. These tasks come together in an integral redesign.

We consulted in advance with a sounding board group of interested residents about the principles for the proposed redesign.
Meanwhile, the design for the redesign has been further elaborated and the preliminary design can go through the formal consultation procedure.

The college decides:
1. To approve the preliminary design for the redesign of Burgemeester Verheugtstraat, variants 1 and 2, dated 03-07-2024;
2. To release the preliminary design for the redesign of the public area for public participation.

College proposal Miscellaneous issues Waste

As far as the waste tariffs are concerned, there are still a number of open ends for this year on which decisions must be made before the tariffs can be set because they directly affect the tariffs. This applies, for example, to Cure's response to the opinions expressed on the 2025 budget and on the trials with the mobile waste recycling facility and the collection of GFE in high-rise buildings.
The AZ Committee will be asked for their views. This will be included in a council proposal yet to be drafted for discussion at the council on October 28, 2024.

The college decides to agree to the memo and submit it to the members of the AZ Committee on October 7, 2024.

Advisory note Application for compensation for planning damage Stationsstraat 2 Geldrop

We have received a request for compensation for planning damage related to the granted environmental permit (dated October 1, 2020) for the construction of 27 apartments (Kersenhof) with parking garage at Nieuwendijk 1 in Geldrop. The application concerns the property located at Stationsstraat 2 in Geldrop.
This proposal deals with the continuation.

The college decides:
1. Not to grant the applicant compensation for planning damage;
2. To substantiate the decision with the opinion of Valuation and Consulting Firm Gloudemans.

Advisory note State of Affairs Pactum

This is a council information letter containing process information and a brief status of the financial situation of care provider Pactum and the ongoing Youth Authority process.

The College decides to agree to send the attached council information letter to the City Council.

Conversion of GR Dommelvallei to business operation organization

To strengthen the Dommelvallei Service (DDV), the DDV Executive Board has decided to convert the public body into a business operation organization. To this end, the DDV regulation must be amended. The Board of the DDV has therefore released a draft regulation GR business operation organization DDV for viewing by the municipal councils. Therefore, the college has adopted the council proposal Conversion Service Dommelvallei into business operation organization.

College Decision:

1. To agree to the draft joint scheme Joint Scheme for the Dommelvallei Service Delivery Organization;
2. To adopt the council proposal Conversion of Dommelvallei Service into a business operation organization.

Strategy 2025-2028 and Budget 2025 and multi-year estimate 2026-2028

In July 2024, the 2025-2028 strategy was adopted for notice. That version did not yet include the targets.
This was because the deflections had yet to be worked out and this would potentially affect the targets. Where relevant, goals have been adjusted to those reductions. This means that the 2025-2028 strategy is now up for adoption.

At the same time, the 2025-2028 budget is also up for adoption. The proposal of the budget 2025 is the final piece of the process to achieve a balanced budget 2025 in cooperation between the civil service, the college and the city council. The September Circular 2024 has also been incorporated into the present documents.

The college decides to approve the attached council proposal Multiyear Budget 2025-2028 proposing to:
1. Adopt the Strategy 2025-2028;
2. Adopt the 2025 Program Budget and by extension:
(a) To take note of the 2026-2028 multi-year estimate;
(b) To adopt the 2025 Activity Plan and thereby make the amounts available;
(c) To approve the investment appropriations from the 2025 Activity Plan;
d) Adopt the updated annexes of the Land Policy and Cost Recovery Program;
e) Adopt the 2023 Water Storage Ordinance with a 1st Amendment;
f) Take note of the Memo September Circular 2024 Municipal Fund;
g) Adopt the 1st Budget Amendment 2025;
3. To adopt the 8th Budget Amendment 2024 incorporating:
a) Effect retrenchment proposals for the year 2024;
b) Financial effect September Circular for the year 2024.
