Advisory note Service and Cooperation Agreement Procurement and Contract Management Youth CarePlus Landsdeel Zuidoost

The municipalities of Landsdeel Zuidoost want to go through a new procurement procedure regarding JeugdzorgPlus (also called closed youth care) for the contract period starting January 1, 2026. At the end of 2024 consensus was reached within Landsdeel Zuidoost that the municipality of Eindhoven will carry out this new procurement on behalf of all the municipalities of Landsdeel Zuidoost. The municipality of Eindhoven thus takes over the role of central municipality from the municipality of Roermond. It is therefore proposed to conclude the attached new Service and Cooperation Agreement. You have previously agreed to this on May 6, 2025, but there have been two changes so for the sake of completeness the advisory note is again submitted to you.

The college decides:
1. To take note of the departure of Region Hart van Brabant from Landsdeel Zuidoost to Landsdeel Zuidwest on January 1, 2026.
2. To agree to the addition of Region Zuid-Limburg to Landsdeel Zuidoost Nederland on January 1, 2026 under the Requirements set forth in Appendix 2 to this advice.
3. To enter into the Service and Cooperation Agreement Procurement and Contract Management Youth CarePlus Landsdeel Zuidoost Nederland with the regions and municipalities of Landsdeel Zuidoost for the period from June 1, 2025 to December 31, 2029 (see Appendix 3a) and to sign it as part of region Zuidoost Brabant (see Appendix 3b).
4. To give assignment, mandate, power of attorney and authorization to the college of mayor and aldermen of the municipality of Eindhoven in accordance with the attached draft municipal gazette (see attachment 4), each insofar as it concerns his powers, to:
a. decide, on behalf of the municipality of Geldrop-Mierlo, to enter into or terminate agreements with service providers regarding JeugdzorgPlus as described in the DVO referred to in decision point 3;
b. To decide to amend the Agreements referred to under a. under the condition that:
I. the total financial impact of this amendment per Agreement does not exceed 10% the total original contract value;
II. the total financial impact of this amendment per Agreement does not exceed the European Threshold; and
III. the amendment of the Agreement does not otherwise result in a substantial change within the meaning of the Procurement Act 2012.
5. To request the Mayor to give power of attorney to the Mayor of the Municipality of Eindhoven to sign the Agreements mentioned in decision point 4 in accordance with the attached draft Municipal Gazette (Annex 4). These agreements are also binding for the municipality of Geldrop-Mierlo.
6. To grant permission to the College of Mayor and Aldermen of the Municipality of Eindhoven, each insofar as it concerns its powers, to grant submandates to subordinates for the powers referred to in decision point 4 and 5 in accordance with the attached draft municipal gazette (Annex 4).
7. To remove JeugdzorgPlus from the scope of the Service Provision and Collaboration Agreement 21 municipalities of Southeast Brabant concerning Jeugdbescherming & Jeugdreclassering (JBJR), Safe Home (VT), Crisis Intervention Team (CIT), Coordination Crisis Aid and JeugdzorgPlus (JZ+), (also called DVO 21) by entering into the addendum of annex 7a and signing annex 7b.
8. To adopt the new mandate decision with the citation "DVO21 ZOB as of June 1, 2025" with simultaneous repeal of the mandate decision "Mandate decision DVO21 ZOB" (Annex 8).
9. To incorporate the financial aspects of the new DVO in the municipal budget (see appendix 5).
10. To revoke the decision of the college "DVO Purchase and contract management Jeugdzorg+" dated May 6, 2025 (2575914).

Advisory note repealing policy rules cooperation contrary use 2010

Two policy rules were adopted on June 15, 2010, in anticipation of the enactment of the Environmental Law (General Provisions) Act (Wabo). One policy rule related to deviations from zoning or management regulations. The other on deadlines for supplementing an incomplete application for an environmental permit. Meanwhile, the Omgevingswet has entered into force. These policy rules are obsolete.

The college decides:
1. To revoke the 'Policy rule on cooperation with applications for environmental permits for contrary planning uses in residential areas within the built-up area of Geldrop-Mierlo 2010'.
2. To revoke the 'Policy rule completeness test application for environmental permit for building a structure Geldrop-Mierlo 2010'.

In this memo you will find SAMEN's explanation (black text) and the response by GR Cure and the task area Waste (green text). This response will be sent to SAMEN through the Municipal Clerk’s Office .

Adoption war grave British Field of Honor Mierlo

Eighty years ago, 655 British, 5 Australian, 4 Canadian and 1 Dutch war dead were buried on the British Field of Honor. As a tribute, many graves were honored at that time. This created a natural form of adoption of graves. From the old adoption records, kept until about 1970, data appear to be incomplete and no longer current. A number of initiators in our municipality have set up the Foundation Adoption Graves Mierlo with the aim of adopting all graves, doing research and contributing to educational training and information. Gemeente Geldrop-Mierlo wants to adopt one of the graves.

The college decides:
1. To agree to adopt a grave on the British Field of Honor on behalf of the municipality of Geldrop-Mierlo.
2. To agree to a one-time donation as a contribution to the costs. The guideline amount for this is €25.

On May 6, 2025, a request was received from PlatOO to approve the 2024 annual report which includes the 2024 financial statements.

The college decides to approve PlatOO's 2024 annual report and financial statements.

Advisory note rental land D'n Baron z'n Plak

For quite some time we wish to harmonize the rental agreements for allotment associations within the municipality of Geldrop-Mierlo. A number of agreements were arranged verbally and a number of agreements were laid down in writing. However, over the years differences have arisen between the various agreements. By drawing up the new rental agreements, all agreements are now laid down in the agreement. This advice note only concerns the rental agreement for Garden and Recreation Association D'n Baron z'n Plak.

The college decides:
1. To approve the attached lease agreement for Garden and Recreation Association D'n Baron z'n Plak with an effective date of January 1, 2025.
2. To agree to include herein a commitment to find an alternative location and a relocation allowance in the event of a possible redevelopment of the site.

Advisory note rental agreements indoor and outdoor space Emopad 15 - Houta and Van den Hoornbuigtechniek

On July 2, 2025, the transfer of the purchase of both plots (including buildings) from the Pali Group at Emopad 15 and Industriepark 10 will take place. The property at Emopad 15 is currently leased to Houta Bouw and Van der Hoorn Buigtechniek. We intend to continue this lease after the transfer.

The college decides:
1. To approve the lease agreements between the municipality of Geldrop-Mierlo and Houta Bouw and Van der Hoorn Buigtechniek for the location Emopad 15 in Geldrop with an effective date of July 2, 2025.
2. To agree to the publication of the intention to lease to existing tenants under the Didam ruling.

Cover page college proposal termination True Friend

This proposal concerns the termination of cooperation with True Friend, which conducts activities around talent development and citizenship of young people. In recent years, True Friend has established activities and built a network with various schools and community partners. However, we see a shift in the focus of youth policy towards vulnerable youth, while the current offer is mainly aimed at broader youth. The municipal budget for this collaboration has previously been cut structurally as part of retrenchment measures.

The college decides:
1. To agree to terminate cooperation with True Friend and True Friend Forever by July 31, 2025 (end of school year 2024-2025).
2. To agree to forward the council information letter to the City Council.

Cover page college proposal Annual Accountability for Child Care 2024

Childcare includes the following facilities: Child Day Care Centers (KDV), Extracurricular Care (BSO), Guest Parenting Agencies (GOB) and Facilities for Guest Parenting (VGO). Under the Childcare Act, municipalities are responsible for supervising and enforcing the quality of childcare facilities. The Board of Mayor and Aldermen accounts for the execution of its tasks annually to both the City Council (the horizontal supervisor) and the Inspectorate of Education (the inter-governmental supervisor). Accountability to the Inspectorate takes place via the attached annual report.

The college decides:
1. To adopt the 2023 Annual Child Care Account.
2. To agree to inform the City Council by means of the attached Council Information Letter, including the Child Care Annual Account 2023.

Advisory note on designation decision election advertising Geldrop-Mierlo 2025

In the last elections in 2024, the municipality of Geldrop-Mierlo held a pilot in which the pasting of election posters was replaced by having election banners printed. The evaluation showed that this pilot was positively received. As a result, we want to permanently change to having banners printed. This requires a new designation decision.

The college decides to agree with designation decision election advertising Geldrop-Mierlo 2025.

The college decides to agree to answer the Article 36 questions posed by DPM regarding the National Affordable Housing Fund.

Housing initiatives within hamlet of Gijzenrooi

There are two private initiatives for housing within the hamlet of Gijzenrooi. The municipality also has ideas for housing construction as a means of financing the planned development measures to strengthen the nature and landscape in Gijzenrooi. The feasibility and desirability of the various initiatives have been assessed in relation to each other and from both a spatial and a social point of view. Your college is requested to take a position on this that will serve as a starting point for the continuation of the developments.

The college decides:
1. To cooperate in principle with the plans of Wooncollectief Gijzenrooi, provided a maximum of 8 homes are added on balance.
2. To grant in principle cooperation to the addition of one new dwelling east of Gijzenrooi 3-3a.
3. To assume the construction of a residential farm with 2 dwellings on land belonging to the municipality (parcel K1142) south of the brink.
