Enforcement Policy
Enforcement is important, but preferably the municipality stays ahead of problems. Together with residents and other departments of the municipality, we try to address and solve problems faster. The enforcement policy plan is therefore called "Enforcement with focus!".
Enforcement means checking for compliance with the rules and warning or fining if necessary. The municipality conducts inspections in the following areas:
- Housing and living (dog nuisance, illegal logging, parking and illegally dumped garbage, etc.)
- Building and housing supervision (building permits, illegal land use and overdue maintenance complaints, etc.)
- Fire safety (buildings with specific functions, events, accessibility, etc.)
- Environment (permit businesses, noise standards during events, etc.)
- Alcohol law (age, establishment requirements, manager, etc.)
Boa's
To monitor compliance with the rules, the municipality also employs special investigating officers (boa's). A special investigating officer (boa) is an official with investigative powers. Among other things, this means that he or she may investigate whether certain criminal offenses have been committed. Boa's may arrest suspects, verify someone's identity, draw up official reports and issue fines. Boas respond to reports from residents and organizations and address nuisance situations based on their own observations. On the street, boas are appointed to combat nuisance, degradation and all kinds of common annoyances that affect the safety and livability of the streets. Supervisors also monitor the Basic Registration of Persons.
Fines
You can be fined for criminal law (rules) violations in particular. For example:
- Parking in disabled parking space without a disabled parking permit
- Failure to have a parking disc showing the time when parking began in places where it is required (blue zone) and/or the time has expired
- Parking where not permitted or parking without a parking permit when necessary
- Parking a camper, caravan, trailer, etc. where not permitted, or longer than allowed
- Failure to leash a dog outside designated places on a road within a built-up area
- Walking a dog in places where it is prohibited or failing to clean up dog poop
- Not having on hand cleanser to remove dog poop
- Improper disposal of waste
- Illegal dumping of waste
Fine amounts can be found in the Prosecutor's Office's fines database.
Policy
The approach of the municipality of Geldrop-Mierlo is characterized by trying to prevent enforcement. Preventing a problem is often better and more effective than solving a problem. This is done, for example, by:
- Premediation: an employee of the municipality enters into conversation with a citizen or company. In this way, we try to get ahead of conflicts and avoid penalties and legal proceedings.
- Working with citizens to identify where the problems are. Sometimes enforcement does not solve anything, but public space must be modified or a situation must be ended.
- Together with the LEV group, the neighborhood mediation project was started. With the help of volunteers, who have been specially trained for this purpose, neighborhood mediation can be requested. With this we try to resolve neighborly quarrels before they escalate.
- Development sites. Instead of being behind the times, the municipality wants to address problem sites at an earlier stage. Whether that means redevelopment, closure, demolition or something else varies by situation.

The municipality has a hotline for complaints about, for example, dog nuisance or residential nuisance. You can make your report via the public space form. You can also call during office hours to the phone number 040 289 38 93.
